Formal Ethics Complaint regarding Rep. John Martin’s Conduct: To Maine House of Representatives ethics oversight committee, I am requesting that the ethics committee investigate the unethical conduct of Representative John Martin for his misuse and abuse of power regarding: 1. 2014 – 2015, Rep. John Martin attempted to influence Assistant District Attorney James Mitchell of the Caribou DA’s Office by telling him to dismiss all of the charges of a criminal investigation, a 2012/2013 Allagash Warden Service Undercover Operation “Operation Red Meat.” Rep. Martin followed the prosecution of the cases through the court system and attempted to influence the presiding Judge, Honorable Judge E. Allen Hunter, by writing a letter to influence the fine and jail sentence of defendants (Both ADA Mitchell and Judge Hunter were men of integrity and were not influenced, See Court Transcripts). 2. 2015 – 2016, Rep. John Martin made it known through his legislative circles that he was going to go after Warden Service’s Special Investigative Unit (Undercover Operations). Rep. Martin told fellow legislators that he was planning to introduce a law prohibiting an Undercover Operative from violating Title 12 laws (Making covert operations impossible to conduct). Rep. Martin made it known again through his legislative circles that he needed to create support for his upcoming bill. Rep. John Martin communicated and conspired with a reporter, “story teller” Colin Woodard to create a fabricated false story against Warden Service and their Special Investigations Unit. On May 8, 2016, the initial false story was printed titled “North Woods Lawless” significantly and publically exposing Warden Service’s Covert Operations. Rep. Martin’s plan was successful at creating a false narrative causing the intended public outcry. Likewise, State Senators and Representatives also reacted as if the false story was true. In a knee jerk reaction, politicians responded to fix the fictionally created problem. On June 1, 2016, I.F. &W.’s legislative committee conducted a public fact finding hearing that again highly exposed Warden Service’s Undercover Operations. Rep. John Martin’s Motives: I am still unsure of Rep. Martin’s exact motives. I am unsure if he was offended Warden Service conducted the investigation in his area without him knowing, if he was offended because he was unable to influence the Prosecutor or the Judge, if he was offended because he was distantly related to some of the defendants, or if his motives were just simply for his own personal political advantage. Results of Rep. John Martin’s Misconduct: Warden Service as an organization was wrongfully and falsely publically discredited. Warden Service’s most effective tool at apprehending Maine’s worst of the worst wildlife violators may have been irreversibly damaged making future operations too unsafe for officers to conduct. The unethical public exposing of my identity as a Covert Operative to include a photograph of me in two separate news articles insured my inability to ever work covert investigations in Maine again. Regarding our natural resources Warden Service is charged to protect, it will likely be impossible to measure the enormous negative impact Rep. John Martin caused to our Maine wildlife for future generations. The two most damaging consequences of Rep. Martin’s misconduct to me personally was to my family. My wife and my children that still live in Maine are in constant fear of retaliation from past UC investigation defendants (20 years of Undercover Investigations). My son shares the same name, William Livezey, causing him to be harassed and contacted inappropriately. The false stories created a feeding frenzy by the public that also empowered and emboldened criminals of several past investigations. My reputation was publically persecuted by the false allegations in the multiple front page stories printed in the Portland Press Herald and other media outlets. I have held a leadership position at my local church in a small northern Maine community for many years as well as teaching the high school Sunday School class and being the leader of the church’s Youth Group. My character and integrity that Rep. John Martin conspired to destroy through the false articles is in my opinion, real “Outrageous Conduct.” It is also my opinion that these circumstances are examples of unethical misuses of Rep. Martin’s government powers. I am a conservative republican but it is important to know that I would have forwarded this complaint regardless if Rep. John Martin was a republican, democrat, or independent. The false stories and public persecution has taught me one valuable lesson, “Not to fear men or what men can say or do.” The attorneys I have been communicating with have asked me to go through the false articles line by line and document each false accusation (Attached are three documents containing the refuted false points). I will forward all additional information obtained through any testimony or depositions regarding Rep. Martin’s conduct as a result of the legal process of holding the PPH accountable as well.
