Conclusions of Law While employed by Associated Bank, Ald. Wery exceeded his authority and accessed the bank records of Ms. Jacques and her daughter. Ald. Wery?s actions during his employment at Associated Bank erode the public?s con?dence 1n the integrity of its government, and therefore are not compatible with the best interests of the City pursuant to GBMC 190(1) (3). Because City of?cials and employees are held to a higher standard of conduct than members of the public, the Ethics Board concludes that the application of the ordinance is not limited to actions taken while acting as an of?cial or employee. Public of?cials hold of?ce for the bene?t of the public and the public must have con?dence in the integrity of its government pursuant to GBMC 190(1) (2). Ald. Wery?s actions exceeded his authority during his employment at Associated Bank are therefore in violation of GBMC 190(3). Ald. Wery?s actions demonstrate that the public interest is not his primary concern as required under GBMC 190(2). Based on these ?ndings and conclusions, the Ethics Board has made a probable cause determination that Alderperson Chris Wery has violated Green Bay Municipal Code 190(1)(2) and (3). This matter is therefore referred to the Common Council for appropriate action. Either the complainant or the person charged may ?le an objection to the ?ndings of fact and conclusions of law by 5:00 pm on July 19, 2016 and shall have an opportunity to present arguments supporting the objections to the Common Council.
