Dear President The Of?ce for Civil Rights (OCR) of the U.S. Department of Education (Department) is responsible for enforcing Federal civil rights laws that prohibit discrimination on the basis of race, color, national origin, sex, disability, and age by educational institutions that receive Federal financial assistance. OCR is responsible for investigating individual complaints of discrimination and is also required to conduct periodic proactive compliance reviews of recipient practices to determine whether they comply with the laws that OCR enforces. Compliance reviews are designed to address systemic issues and ensure that violations are readily identi?ed and eliminated. Compliance review sites are selected based on various sources of information, including statistical data and information from parents, advocacy groups, the media, and community organizations. I write to advise you that OCR has selected the University of Montana~Missoula (the University) for a compliance review under Title IX of the Education Amendments of 1972, 20 U.S.C. ?1402 et seq. (Title IX). Title IX and its implementing regulation at 34 CPR Part 106 prohibits discrimination on the basis of sex in programs and activities operated by recipients of Federal financial assistance. The University receives funds from the Department and, therefore, is subject to Title IX and its implementing regulation. OCR will conduct this review in collaboration with investigations, including a Title IX compliance review, launched by the U.S. Department of Justice earlier this week. The review will assess whether the University's policies and procedures and the University?s implementation thereof ensure the elimination of sexual harassment and sexual violence, appropriately respond to such harassment and violence, and eliminate the hostile environment and its effects that result from such harassment. The review will also examine whether the University responded immediately and appropriately to complaints of sexual harassment and sexual violence. In addition, OCR will incorporate into this compliance review allegations of Title IX violations raised in a pending complaint (Case No. 10-12-2033).
