Miami Seaquarium statement August 19, 2016 In June of this year, the U.S. District Court in Miami granted a summary judgement victory to Miami Seaquarium, thereby rejecting and dismissing all of PETA's claims and allegations in their lawsuit. The court agreed with Miami Seaquarium that there is in fact no harm or harassment of Lolita, and that Miami Seaquarium was in full compliance with all applicable laws, including the Endangered Species Act and Animal Welfare Act. PETA’s latest “press release” simply rehashes their prior, false and inflammatory arguments, all of which were dismissed by the Court. PETA continues to ignore the factual reality that Lolita has received top-tier care, has exhibited remarkably good health, and that there has been a complete absence of any showing that she suffers mental or physical harm in any manner. She is, in fact, one of the healthiest orcas ever examined, whether in the wild or in a facility. Her facilities are all legally compliant, and (contrary to PETA’s assertions), she greatly enjoys her Pacific White Sided Dolphins as companions. Finally, PETA’s calls to place Lolita in a sea pen is deeply disingenuous; not only would such a move and relocation be cruel and likely result in Lolita’s swift demise, but no such sea pen even exists. Miami Seaquarium has lovingly cared for Lolita for close to 46 years, and will continue to give her world class care and attention. Lolita plays an important role in the mission of the park to educate the public about the need to conserve the marine environment and its residents.
