The inmate acknowledged understanding the Misconduct Report and Inmate Rights in a Hearing. Finding of Fact On December 23, 2013 Of?cer Hays observed Inmate Courtier coming off of the second tier of E-Block at OSP. Inmate Courtier is assigned to the third tier and is not authorized to be on this tier. Of?cer Hays called Inmate Courtier to his location and observed that he was concealing a brown paper bag in his coat. Of?cer Hays directed Inmate Courtier to surrender the bag and all items from his pockets. Of?cer Hays reported that the bag contained; nine soda tickets. sweetener, address book, four bags of kettle popcorn, and a bag of marshmallows. Of?cer hays then conducted a pat down of Inmate Courtier and located a plastic bag in Inmate Courtier's right pocket. The plastic bag contained two paper bundles marked "Dude" and Inmate Courtier was sent to the control ?oor waiting room. Of?cer Hays photographed then opened the paper bundles and found that they contained a green leafy substance. Of?cer Hays reported that per his training and experience, be believed the substance to be marijuana, a controlled substance. A search was conducted of the cell assigned to Inmates Courtier and paper containing tobacco and an ink pen body containing a brown residue concealed under the mattress of the top bunk (Assigned to Inmate gun and ink. Of?cer Bonin located a rolled . Of?cer Bonin also located a gray sock containing an inmate made tattoo Of?cer Hays utilized a Narcotics Identi?cation Kit to test the green leafy substance. Of?cer Hays reported that the substance tested positive for marijuana and he placed it in SIU evidence locker for con?rmation. On December 26, 2013 Inspector Lowe retrieved the evidence from SIU evidence locker and conducted a con?rmatory test. The substance tested positive for marijuana. Inspector Lowe reported that per his training and experience the substance also appeared to be marijuana base on appearance and odor. Inspector Lowe reported that the two bundles of marijuana weighed .46 grams. I was in the block of?ce sorting the mail and observed inmate Courtier, Russell Orlando 12065508 walking towards the second tier landing high side of E-2. He was at about cell [3-254 when I saw him walking towards the tier landing. I knew that he was in an unauthorized area because he used to live on the E-2 high side. Inmate Courtier is currently housed in cell He is housed with inmate I gave inmate Courtier a direct order to come down the E-1 high side of the tier. I observed a small brown paper bag that was under his coat that he was hiding. I asked for him to hand over the bag and take everything out of his pockets. In the bag that he was hiding under his coat it contained 9 soda pop tickets, sweetener, address book, 4 bags of kettle popcorn, and one bag of marshmallows. (Photos were taken of canteen and sent to property) I conducted a routine clothed pat down. In Courtiers right pocket I recovered a plastic bag that had an unknown substance. I ?nished the pat down and sent him to the control ?oor holding area. I took the unknown substance out of the plastic zip lock bag and observed two pieces of paper that was taped shut and labeled, (Dude) and I noti?ed the of?cer in charge Captain Stephen B. of the packages that I recovered from inmate Courtier. I took pictures, and opened the packages. In both of the packages they contained a green leafy substance. From my correctional experience the green leafy substance smelled and looked like marijuana. I informed Of?cer Bonin D. what was recovered on inmate Courtier and informed him that we were going to search cell E-366. I came to cell E-366 and inmate was on the top bunk bed. I told him to get down and I conducted a routine unclothed search. Nothing was recovered and he was sent to the control ?oor holding area. During the search of cell Of?cer Bonin recovered a hand rolled cigarette that contained tobacco, an inmate Pen that was hollowed out that smelled like burnt tobacco, and Tattoo paraphernalia (Needle, Motor, barrel, black powder for ink, and a sock cut in half that contained the tattoo paraphernalia) in Cell E-366. I took the green leafy substance and hollowed out pen to Master Control and conducted a NIK test on the substance. (I have completed the training for NIK testing controlled substances.) I performed NIK test A first to see if there were any other substances in the contraband. NIK test A tested negative for other substances. I conducted NIK test E, which is strictly for marijuana, hashish, and THC. I placed a small amount of the substance in the corner of NIK test E. I sealed the package and broke the left ampoule and waited a minute. There was no change in color. I proceeded and broke the middle ampoule and observed the color change to a dark blue or violet color. I waited one minute and then I broke the last ampoule. I observed a grey upper layer over a violet layer upon breaking the third ampoule. I informed the Of?cer in Charge, Captain Stephen of 1111: results. (Marijuana) The unbalance we: placed lo. Special Investigation Unit loci-a. foo ?urthe investigation. I conducted a NIK test on the substance that was in the hollowed out pen and had negative results. This inmate engaged in an activity that challenges the safety, security, and rules of this institution. The inmate acknowledged understanding the misconduct report and inmate rights in a hearing. Findings of Fact 0n 25/04 Officer Taber reviewed a letter written by inmate Courtier to inmate Officer Taber noted that both inmates were DOC documented affiliates of EurOpean Kindred, a Securityn Threat Group. In the letter Courtier wrote about getting something done and Officer Taber assumed'that he was writing about an EK shield tattoo. Officer Taber contacted Capt. McGraw who subsequently interviewed Courtier. Courtier showed Capt. McGraw that he did have an ER shield tattoo. The last time that Courtier was processed into DSU where he had an unclothed search there was no mention or discovery of this tattoo. Courtier received a tattoo that depicts.the symbol of the European Kindred Security Threat group and by having this tattoo he supported through visual communication an organization which is a Security Threat Group. Ultimate Findings of Fact and Conclusions Inmate supported, displayed, or endorsed through verbal, visual, or written communication, any club, association or organization which is a security threat group or engaged in a petition drive without specific authorization from the functional unit manager, except as specified by OAR 291?145 or by the institution security threat group manager, thereby violating Rule 4n, Unauthorized Organization II. Rule 3c, False Information to Employees II, has been merged with the 4n rule violation(s), as arising from the same act of misconduct. Rule 2m, Tattooing/Body Piercing, has been merged with the 4n rule violation, as arising from the same act of misconduct. Use continuation sheet if needed): On February 25. 2004. while I was working in the Disciplinary Segregation Unit. I reviewed a letter written by inmate Russell Courtier if I 2065508. Inmate Courtier is a documented affiliate of European Kindred. a Security Threat Group. The letter is postmarked February 3. 2004- The recipient of the letter. Inmate is also a documented af?liate of European Kindred. In the letter. Inmate Courtier makes reference to getting something ?done.? On September 23. 2003. I issued Inmate Courtier a misconduct report for Unauthorized Organization for a drawing he had in his possession. The drawing was a shield with the letters in it. The shield symbol is used commonly symbol of European Kindred. The symbol is commonly found tattooed to the calf of individuals af?liated with European Kindred. When I interviewed Inmate Courtier in September. he indicated that he had not yet received his shield tattoo. but that he did intend to get one. He admitted to me that the drawing I had con?scated was. in fact. a tattoo pattem. Upon a physical search of Inmate Courtier. I did not ?nd an shield tattoo anywhere on his body. After reading the letter that Inmate Courtier had sent to inmate it occurred to me that Inmate Courtier was referring to the "El-t" shield tattoo when he wrote. got my shit dune. Remember what i needed to get dune. looks good to." I contacted Captain R. McGraw and requested that he interview Inmate Courtier to ?nd out if he had indeed received his shield tattoo. Captain Mth-aw did interview Inmate Courtier and found that Inmate Courtier had received the tattoo. During the interview. Inmate Courtier stated that he had received the tattoo nine months ago. This statement is false. When Inmate Courtier left Segregation on October 3. 2004. he did not have the "Eli" shield tattoo. Inmate Courtier was placed in Segregation for violating rule Contraband II on November 20. 2004. Inmate Courtier was found to be in possession items of contraband. including a make-shift tattoo gun. extra ink. and other items related to tattooing. No documentation was made at that time regarding any new tattoos found on Inmate Courtier. As of February 25.2004. there is no indication that Inmate Courtier had an shield anywhere on his body prior to this date. Inmate Courtier had what to be a tatto gun along with unauthorized ink pens. Inmate Courtier also had some guitar string and two pairs of canteen purchased shoes he did not purchase. Inmate Courtier claimed he had a receipt for the headphones, however, the original SID number had been scratched off and his SID scratched in the earphone of the headphone. It is noted that Inmate Courtier also has sandpaper in his possession along with a brass staple that was straightened on one end. he was appeared Ultimate Findings of Fact and Conclusions Inmate possessed contraband which creates a threat to the safety, security or orderly operation of the facility thereby violating Rule 1e(A), Contraband II.
