Notice of Claim

Pursuant to O.R.S. 30.275, 1, D. Jeanette Finicum, as the Personal Representative of the
Estate of Robert Lavoy Finicum (the ?Finicum Estate") on behalf of the heirs of Robert Lavoy
Finicum namely me, as surviving spouse, and on behalf of Lavoy?s children and
stepchildren, and in my individual capacity as Finicum's surviving spouse, intend to assert the
following claims seeking damages against the Oregon State Police Department, the State of
Oregon, Harney County, Oregon, City of Burns, Oregon, Deschutes County, Oregon and the
of?cers of the City of Burns Police Department, City of Bend Oregon Police Department,
Harney County Oregon Sheriff?s department, Deschutes County Oregon Sheriff?s department,
and of?cers of the Oregon State Police Department, that were involved in the shooting death of
Finicum and the Supervisors of the respective of?cers that were involved in the shooting death
of Finicum. The claims for damages arise from the shooting death of Finicum on January 26,
2016 on Highway 395 near the Joaquin Miller Horse Camp. Some of the details of the shooting

The claims of the Finieum Estate, Jeanette Finicum, and the children and step children of
Finicum, include and are not limited to, the following claims: (1) negligence; (2) violations of
Lavoy Finicum's federal civil rights under the laws and constitution of the United States of
American pursuant to 42 U.S.C. 1983, 1988, and the First, Fourth, Eighth and Founeenth
Amendments to the Unites States Constitution, (3) Wrongful death pursuant to O.R.S. 30.020 e!
