BLACK ZN REM Plaintiff, State of New Jersey, by Esther Suarez of Hudson County, with offices located at the Administration Building, 595 Newark Avenue, Jersey City, New Jersey, by way of Complaint says: 1. The Prosecutor of Hudson County is charged with prosecuting the matters of the State of New Jersey versus the defendants named in the Complaint herein, who are charged with violating the criminal laws of the State of New Jersey. 2. The County of Hudson is a governmental agency of the State of New Jersey and is the entity funding the Offices of the Prosecutor of Hudson County. The Prosecutor is -also charged with prosecuting Forfeiture matters pursuant to N.J.S.A. 2C:64?l Egg; 3. Cash was seized from the defendants named in this action ill the amounts and CH1 the dates and iJ1 the municipality listed in the individual counts herein, which were the proceeds of and were used in the illegal activities for which these.defendants were charged. COUNT ONE In November 2015, members of the Hudson County Prosecutor?s Office began an investigation regarding the distribution of controlled dangerous substances. During the course of the investigation, police observed an individual identified as Daniel T. Hooban driving a 1991, red, 2?door, Chevrolet Camaro with New Jersey Registration Z37GDA, Vehicle Identification Number 1G1FP23E5ML119975. The vehicle was registered to Hooban. On or about January 13, 2016, police arranged a controlled buy of narcotics from an individual by the name of Nicky L. Wojnikiewicz. Detective Cruz of the Hudson County Prosecutor?s Office arranged to meet with Wojnikiewicz. Hooban was also under surveillance at that time. Hooban entered the Camaro at 46 East 14?lstreet in Bayonne and traveled to the location where Wojnikiewicz was located at Broadway near 173?Street. Hooban exited the vehicle and walked to Wojnikiewicz?s location where Hooban handed an item to Wojnikiewicz in exchange for United States currency. Hooban then returned to the vehicle as surveillance was maintained. On or about January 21, 2016, members of the Hudson County Prosecutor?s Office obtained arrest and search warrants from the Honorable Joseph V. Isabella, J.S.C. for the person, vehicle and residence of Daniel T. Hooban. The Hudson County Prosecutor?s Office Narcotics Task Force executed and the Bayonne Police Department Narcotics Uni the search warrants. The search warrant for one red Chevrolet Camaro bearing New Jersey registration Z37GDA was executed on January 21, 2016 at approximately 4:15 P.M. A search of the vehicle revealed two cellular telephones. Hooban gave a voluntary statement to police in which he admitted that he would occasionally help a friend identified as Nicky L. Wojnikiewicz. Hooban indicated he would provide Wojnikiewicz with heroin free of charge to either sell or consume. Upon arrest, Wojnikiewicz also gave a statement indicating that he would purchase heroin from Hooban and that Hooban would make deliveries with a gold Buick Century or a red two?door vehicle.
