I cannot comment as to what Mr. Wolfsmith is doing or not doing in San Jose. I am handling his criminal case only. Generally speaking however, every man and woman has the inalienable right to support their family, How that is done and under what circumstances are decided by someone other than the District Attomey's Office and hopefully with some degree of due process. This issue is generated from the criminal case filed against my client arising out of his Wolfpak in Morgan Hill. We are currently reviewing the evidence in this case which has taken some time to acquire. From my initial observations, it appears that the detective assigned to the case conducted her interviews with a predetermined result in mind. I am astonished at the suggestive nature in which witness interviews were performed. This was not an objective fact finding search for the truth which one would expect from law enforcement. She has stated that she had made her mind up after the second day conceding she had a number of witnesses yet to interview including my client. Fact analysis is an important skill which an investigator needs to develop. Here it was replaced with a suggestive, biased and unfair approach. Imagine telling one Witness what other witnesses have said. When another could not corroborate her view of the case, she proceeded to poison that witness with information from other individuals and her own opinion. This investigation went beyond being merely suggestive. It was less than objective from the start at a time when Mr. Wolfsmith's position had yet to be obtained. Given that this occurred in a small town where everyone knows everyone else, this approach is toxic. It is not an effort fair or consistent with due process. A detective who interjects her own viewpoint with witnesses, especially those who do not agree with her theory of the case, Cannot conduct the investigation fairly. An objective, fair and honest investigation is the least one can expect where they have been accused of serious crimes. There are many sides to this story but we will not try our case in the public forum. Mr. Wolfsmith has been an upstanding member of the community with a proven record as an excellent trainer He has a wonderful family and a wealth of friends who support him in this matter. We maintain his innocence in this case.
