The Commonwealth hereby ?les this nolle prosequi pursuant to Mass. R. Crim. P.
16(a). As set forth more fully in the Commonwealth?s Response To Defendant?s Motion
For A New Trial, Docket Entry 26, based on a thorough re-investigation of this case over
the past two years and after a review by the Conviction Integrity Committee of the
Middlesex District Attorney?s Of?ce (MDAO), the Commonwealth has uncovered newly
discovered material and credible evidence that ?casts real doubt on the justice of the
Commonwealth v. Grace, 397 Mass. 303, 305 (1986). Since ?it appears
that justice may not have been done? in this case, Mass. R. Crim. P. 30Cb), the
Commonwealth assented to the allowance of the defendant?s motion for a new trial. The
defendant?s motion was allowed by the Court on February 26, 2015.

In view of the totality of the facts and circumstances, including the GVidence

uncovered by the Commonwealth over the past two years, the Commonwealth believes

that it is in the best interests of justice not to re-prosecute this case. Accordingly, the

Commonwealth files this nolie proscqui pursuant to Rule 16(a).
