Texas Ranger Brad OLIVER was assigned to assist additional Texas Rangers with the investigation of said shooting. Ranger OLIVER assisted with processing the crime scene, collecting evidence and obtaining witness statements. No evidence retained requires a disposition. File closed. DETAILS: 1.1 On Monday, 09?21?2015, at approximately 7:46 PM, Texas Ranger Brad OLIVER was assigned by Texas Ranger Company Headquarters to assist Texas Ranger John VANCE with the investigation of an on?duty police shooting which had just occurred near the Paris Regional Medical Center in Paris, Texas (Refer to Ranger Texas Ranger Division file for complete details). Ranger OLIVER learned Texas Highway Patrol Trooper Timothy KEELE had been involved in the shooting, which resulted in the death of a male subject (later identified as Garrett Steven MCKINNEY, DOB: 12?09?1993). Ranger OLIVER further learned Trooper KEELE had sustained some type of injury and had been transported to the Paris Regional Medical Center. TROOPER TIMOTHY RAY KEELE, 39 yoa 4. 09/21/2015 Monday) was telephonically contacted by Texas Highway Patrol Senior Corporal Kevin VERNER. Corporal VERNER provided an update on Trooper condition, indicating the trooper had a dislocated shoulder. At Ranger request, Corporal VERNER stopped the video recording from Trooper marked patrol vehicle (Ranger VANCE would subsequently take custody of the video recording). L3 On Monday, 09?21?2015, at approximately 8:46 PM, Ranger OLIVER arrived at the scene of the shooting, which was located in the 600 block of DeShong Drive, southwest of the parking lot of the Paris Regional Medical Center. The hospital, which was located north of U.S. Highway 82/Loop 286, had a large campus area. The front entrance of the hospital faced to the south, toward the highway. It was dark, however, there were lights through the parking lot which aided one in seeing. L4 Ranger OLIVER entered the parking lot to the Paris Regional Medical Center from the east, off of Stillhouse Road. Ranger OLIVER observed numerous marked Texas Highway Patrol vehicles parked, with emergency lights on, along the west bound service road of U.S. Highway 82/Loop 286. Ranger OLIVER drove west through the parking lot where Paris police vehicles were parked with their emergency lights activated. Ranger OLIVER stopped near a Paris Police unit, which was parked in front of yellow crime scene tape, which had been erected in a manner around trees to encompass a large area of DeShong Drive and an open grass area to the north of DeShong Drive. L5 At approximately 8:46 PM, Ranger OLIVER, while wearing latex gloves, crossed the yellow crime scene tape. Paris Police Officer Mark BOSWELL made notation into the crime scene log of Ranger entry. Ranger OLIVER observed the following: A). A marked black and white Texas Highway Patrol vehicle (Crown Victoria) was parked facing east on the south side of DeShong Drive. The passenger side tires were just off the pavement and onto the grass. A white Dodge pickup (later determined to be an unmarked Lamar County Sheriff's Office vehicle belonging to Lieutenant Johnathan SMITH) was parked facing west on the north side DeShong Drive, just east of the front of Trooper patrol vehicle. There was ample room between the two (2) vehicles for an additional vehicle to drive. B). Numerous yellow photograph/crime scene markers were scattered throughout the crime scene. Said markers had been placed by responding Paris Police officers. Ranger OLIVER met with Lieutenant SMITH, who indicated Trooper duty belt, handgun and ballistic vest had been secured inside Lieutenant's vehicle (said items had been removed by medical personnel at the scene while accessing the trooper's injuries). C). Ranger OLIVER carefully began walking through the scene, accessing visible evidence which had the yellow photograph/crime scene markers. It was readily apparent a violent and physical confrontation had taken place from the way items were scattered from the front of the trooper's unit, along the north side and behind the vehicle. Trooper hat was located on the ground behind the trooper's vehicle, along with a Taser. Copper wire leads from said Taser were visible along the ground, the flap from a pocket from Trooper uniform shirt was in a different location on the ground and close by were two (2) spent .357 Sig shell casings. D). Directly north of Trooper patrol vehicle, in the grass, was the deceased body of MCKINNEY. The body was covered in a sheet. L6 Ranger OLIVER learned, while accessing the scene, a witness (later identified as Samantha HOUSE, DOB: 07?28?1982) had approached a Paris police officer on scene and indicated HOUSE had information pertaining to the shooting. TROOPER TIMOTHY RAY KEELE, 39 yoa 4. 09/21/2015 Monday) L7 About this time, Ranger VANCE arrived on scene and was briefed on all known facts at the time by Ranger OLIVER pertaining to the shooting. Ranger OLIVER and Ranger VANCE walked over to where body was located and removed the sheet covering the body, allowing total viewing. Ranger OLIVER noted MCKINNEY was laying supine on the ground. The body was linear, with the head pointing to the north and the legs pointing to the south. MCKINNEY was dressed in a dark colored short sleeved t?shirt and light blue cargo style shorts. There were multiple gunshot wounds to the upper torso, an apparent gunshot wound to the left arm and a gunshot wound to the right hand (Ranger VANCE had been assigned as the lead investigator, refer to Texas Ranger Division file for complete details). L8 Ranger OLIVER was tasked with interviewing HOUSE. Ranger VANCE began photographing the scene (shortly thereafter, Texas Ranger Reuben MANKIN arrived on scene and began assisting Ranger VANCE with processing the shooting scene). Prior to conducting said interview, Ranger OLIVER met with Lieutenant SMITH and took possession of the following items which had been removed from Trooper KEELE on scene by paramedics: A). Evidence #l.l Sig Sauer P226 handgun, serial DPS #405?412067 (included was a DPS issued black duty belt, with two (2) additional Sig Sauer P226 magazines). B). Evidence #l.2 Ballistic vest. C). Evidence #l.3 Texas DPS uniform shirt. Evidence #1.1 through #1.3 were secured in Ranger vehicle (said items would be transferred to Ranger VANCE). Ranger OLIVER inspected Trooper handgun (Evidence noting the following: The 12 round factory magazine was removed, counting seven (7) rounds in the magazine. There was a round in the chamber, which was removed, making a total of eight (8) rounds in the handgun. If so, there were five (5) rounds missing from the handgun. L10 Ranger OLIVER informed Ranger VANCE of the ammunition count found in Trooper handgun. Ranger OLIVER had recalled seeing two (2) spent shell casings inside the crime scene earlier. Ranger OLIVER learned an ambulance had driven into the crime scene in the exact location where the two (2) shell cases were observed. It was unknown if additional empty shell casings had been run over and stuck into the tires of the ambulance. L11 At approximately 9:32 PM, Ranger OLIVER walked over to the Paris Health Care Center and conducted an audio recorded statement (Evidence with HOUSE. The following information was gleaned from the interview (for complete details, refer to Evidence A). HOUSE worked the 2:00 PM to 10:00 PM shift. Between 7:20 PM to 7:30 PM, HOUSE took a lunch break and left the nursing home with Jeffery BURCHFIELD, DOB: AS HOUSE and BURCHFIELD were traveling east on DeShong Drive, HOUSE observed Trooper marked police unit parked along DeShong Drive. HOUSE indicated no emergency lights were activated on the police vehicle. HOUSE stated it was still daylight outside. B). As HOUSE and BURCHFIELD drove directly beside Trooper vehicle, HOUSE, who was sitting in the front passenger seat, Observed the trooper to be standing very close, face to face, talking to MCKINNEY, who was holding a to?go food box, in front of the trooper's vehicle in the grass area. HOUSE observed something, possibly a knife, hanging from the right side of pants (Ranger OLIVER recalled seeing a green flashlight at the scene of the shooting near a white Styrofoam to?go box containing food, near the front of Trooper vehicle). C). At approximately 9:46 PM, Ranger OLIVER conducted an audio recorded interview (Evidence with CUMMINGS. The following information was gleaned from said interview (for complete details, refer to Evidence CUMMINGS worked the 2:00 PM to 10:00 PM, shift at the nursing center. At approximately 7:25 PM, CUMMINGS was standing outside the front of the nursing home (north side) with FIELDS, when CUMMINGS heard four (4) or five (5) gunshots coming from an unknown direction. At approximately 10:16 PM, Ranger OLIVER conducted an audio recorded interview (Evidence with Stephen NORMAN, DOB: 06?13?1986, at residence, located at 427 NE Loop 286 which was an apartment complex located directly adjacent (south) of the Paris Health Care Center. The following information was gleaned from NORMAN (for complete details, refer to Evidence A). NORMAN stated earlier in the evening, prior to it becoming dark, NORMAN was standing outside on the east side of the apartment complex practicing his golf swing. NORMAN was facing directly toward Paris Regional Medical Center, when NORMAN observed Trooper KEELE and MCKINNEY fighting on the driver's side of Trooper patrol vehicle, which did not have any emergency lights on. NORMAN described MCKINNEY as, swinging like a wild man at Trooper KEELE. NORMAN indicated Trooper KEELE was trying to defend himself from MCKINNEY. B). NORMAN described hearing three (3) gunshots, however, from location, NORMAN did not see Trooper KEELE shooting. NORMAN was able to see MCKINNEY fall straight down on back. NORMAN observed Trooper KEELE approach MCKINNEY and check pulse. All evidence was seized by Ranger VANCE (Refer to Ranger Texas Ranger Division file for complete details). L15 On Tuesday, 09?22?2015, at approximately 12:08 AM, Ranger OLIVER conducted an audio recorded interview (Evidence with Lieutenant SMITH. The following information was gleaned from Lieutenant SMITH (for complete details, refer to Evidence A). Lieutenant SMITH, while driving home, overheard on the police radio, Trooper KEELE, who was in apparent distress, called out shots fired and need assistance near the hospital and Stillhouse Road. Lieutenant SMITH had heard, on the police radio, the trooper a few minutes earlier state Trooper KEELE was going to check on a white male near the hospital. B). Lieutenant SMITH, who was in close proximity to the hospital when Trooper KEELE called out over the radio for assistance, arrived at the scene of the shooting within less than a minute. Lieutenant SMITH was the first to arrive. Upon arrival, Lieutenant SMITH observed Trooper KEELE kneeling beside the deceased body of MCKINNEY. Lieutenant SMITH approached the trooper and could hear Trooper KEELE telling MCKINNY to, "breathe, just breathe". Lieutenant SMITH observed Trooper head, neck and uniform to be covered in blood. Lieutenant SMITH first believed the trooper had been shot. Trooper KEELE informed Lieutenant SMITH that Trooper KEELE could not move his left arm. C). Lieutenant SMITH observed Trooper patrol vehicle to be parked along DeShong drive, with the emergency lights activated. Paramedics removed Trooper uniform shirt, ballistic vest and duty belt, which Lieutenant SMITH took possession of and secured the items inside Lieutenant vehicle. FIELDS was standing outside with CUMMINGS, when FIELDS heard four (4) to five (5) gunshots coming from an unknown location. L18 At approximately 2:02 PM, Ranger OLIVER conducted an audio recorded interview (Evidence with BURCHFIELD, who worked at the Paris Health Care Center. The following is a summation of the interview (for complete details, refer to Evidence A). BURCHFIELD indicated on Monday, 09?21?2015, BURCHFIELD picked HOUSE up from the nursing home at approximately 7:20 PM, for lunch. At approximately 7:25 PM, as BURCHFIELD and HOUSE were driving east on DeShong Drive, BURCHFIELD observed Trooper vehicle parked. BURCHFIELD indicated the passenger side tires on the trooper's vehicle were parked on the grass. Trooper KEELE was observed standing in front of the vehicle in the grass, talking to a male subject. BURCHFIELD stated the emergency lights on the trooper's car were not activated. BURCHFIELD described the trooper was standing close to the male subject, who was holding a Styrofoam take out container, while talking. B).
