Brown, Joshua C. DaB 04/29/79 and Brown, Molly T. DaB 05/20/80 have been married for about 10 years and have one child in common (Georgia, age 5). Molly has two sons from a previous marriage, Kobe age 16 and Kemper age 13. All of Molly's children live with her except Kemper sometimes stays with his dad. On 05/22/2015, at about 1445 hours, myself and Deputies Kearns and Shears were dispatched to a report of domestic violence at 16214 NE 165th St. Woodinville, WA between a husband and wife. Dispatch advised that the wife Molly called 911 saying Ihat her husband grabbed her wrist. The wife t.hen went to her room and was waiting for police to arrive. We arrived a short time later and contacted the husband, AlBrown, Joshua. Joshua said that we could come inside the home and started asking what was going on. I told him that we received a call about an argument, he looked confused and shook his head. I asked Joshua if his wife Molly was there and he said she was in the back bedroom . I asked Joshua to stay and talk with Deputy Shears while I contacted his wife. I knocked on the door of the master bedroom and tried to turn the handle, but it was locked. I called out to Molly in the bedroom and announced that I was a Deputy with the King County Sheriff's Office. V/Brown, Molly opened the door and identified herself. Molly told me that she and her husband Joshua were in an argument about finances. She said she during Ihe argument she went to check what he had been doing on her computer in the office. Molly said that Joshua came into the office and came at her quickly, scaring her. She reached for the phone on Ihe desk and Joshua grabbed her wrist tightly causing her pain and bruising. Molly said she pulled her arm away and ran to her bedroom where she locked the door and called 911. I looked at Molly's wrist and observed that she had a small abrasion and some bruising that looked likefinger marks. I notified Deputy Shears that I had probable cause to arrest Joshua for DV assaul\. I went out into the living room where Deputy Shears was talking with Joshua. Joshua was sitting down in a chair by his computer. Deputy Shears told Joshua to stand up and put his hands behind his back. Joshua asked what was going on. Deputy Shears told Joshua that we needed to place him in handcuffs. Deputy Kearns told Joshua that he was under arrest. Joshua continued to sit in the chair, and argued that he was not under arrest and that nothing was going on. Deputy Shears and I took Joshua by the arms and he then stood up. Joshua was taken into custody with no further incident. I searched Joshua incident to arrest and found nothing on him except his cell phone. Deputy Shears andl allowed Joshua to change his clothes before,he went to jail, un cuffing him for a brief moment to do so . Deputy Shears spoke with Joshua . Joshua told him that he and Molly were in a disagreement today regarding finances. Joshua said that while he was using the computer, Molly grabbed the phone, Joshua said he tried to grab the phone but grabbed her wrist by accident. Joshua said that he did not try to injure his wife and was surprised the Sheriff's Office was called. See Deputy Shears' attached OWS. Deputy Shears transported Joshua 10 the King County Jail. I completed a DV Supplemental Form including a signed written slatement from Molly. Molly explained in her statement that around 1400 hours, she was in Ihe kitchen making brownies while Joshua was on the phone in her office. Molly said that Joshua was on the phone with their credit card company asking about some recent charges. Molly said when she screamed that Joshua let go of her arm immediately. Molly ran to the master Ibedroom and locked herself inside. Molly said her wrist began to throb with pain and she could see that it was turning red. said she heard footsteps coming down the hallway and she got scared and called 911. While Mollywas waiting' for to arrive, she could hear Joshua on the phone again with the credit card company. She stuck her head out the Ibe,droom door and asked Joshua if he was' cancelling her credit card and he said "it's my card, I'm the primary on the IRC-C-OllnT". Molly said she went back inside her bedroom and waited for the police to arrive. described in her statement the history of physical violence against her from her husband Joshua. Molly stated that I.JUSTll'" had been physically violent to her on more than 20 different instances over the past several years. She said that a became violent after she became pregnant with their daughter Georgia. Deputies were called to the house last because of an argument between Joshua and Kobe and Kemper. Molly said that last night Joshua made threatening laeSTures towards Kobe and got into his face making her think Joshua was going to hurt him. Molly also said that during a ,,~c~llltrip to Hawaii in April of this year, Joshua got angry in an argument with her and held up his fist like he was going to her and said "I want to knock you out so bad". Molly further described an incident that occurred in April of 2014, that Joshua pushed her into the large mirror in their bedroom and then threw her on the floor and jumped on top of holldirlo' her face down into the carpet. Molly said this incident caused her pain in her arm and elbow for several lmonnl·hs. In February of this year, Molly said that Joshua got into an argument with her son Kobe and kicked in the IOEllnroom door. Molly said the door flew open and hit Kobe in the arm. She also said that Joshua kicked the door so hard it broke off the hinges of the door and cracked a large portion of the door jam. Molly added in her statement that back 2013 she had a protection order placed against Joshua. She said this order was later dropped because of the progress had made in their relationship due to counseling. I said that Joshua had a rough childhood and has been in counseling for his anger problems for years. She said that in of 2013, Joshua went through intensive counseling for a year. Molly further advised that in February, after the incident when Joshua kicked in the bathroom door their counselors advised them to have a therapeutic separation. Molly stated that she asked Joshua to leave several times during their argument today. Joshua responded by saying that she should leave , and while she's gone he would throw all her stuff into the street. Molly stated that none of her children present during the altercation today. I provided Molly with a DVPA form and the case number for this incident. During my interview of Molly, she appeared to be genuinely scared of her husband Joshua. She seemed very embarrassed tell me the details of her husbands history of abusing her. I asked Molly if she wanted medical aid to come to the scene look at her wrist. Kobe J Brown DaB 11/03/98 is Molly's son from a previous marriage. I contacted the caller, Molly T Brown DaB 05/20/80 , at the front door. Her husband , Joshua C Brown DaB 04/29/79, followed her down the stairs to the front door. I asked Molly what was going on tonight and Joshua answered for her. He stated nothing was going on and did not know why we were there. I advised that we were notified of a d isturbance and were checking the area. Molly appeared fearful and did not want to let her husband .know that she had ca lled 91 1. pep. Callahan spoke with Josh ua on the staircase while I spoke with Molly at the front porch . Molly advised that Joshua had become upset with her 16 year old son; Kobe, for coming home late. She advises that her son is from a previous marri age but Joshua has ra ised him most of his life. She states that he yelled and got into Kobe's face and it scared her. She said she thought that it was going to become physical. She mentioned that he has b een physical with her in the past but it has never been reported. She states that she is fearful of Joshua because of his anger and mentioned that he sees a therapist for help. She states that at no point this evening did the argument become physical Joshua advised Dep. Callahan that he became upset over Molly's ex-hu sband. He felt he was interfering with how they parent Kobe and causing issues in their marriage. He states he did not feel that he got out of control this evening and admitted that he may have in the past. He stated several tim es that he was completely surpri sed that police were called to the house. He believes that Molly became scared and called 91 1. I went and spoke with Kobe, who was in his bedroom. Kobe states that th e argument started because he agreed to be home by 9:30pm. He stated he agreed to the time but knew he would not be .able to make it home by then. He said that when he got home, his mom was mad at him. He states th at Joshua joined in with his mom and began to ye ll at him as· well . He states that It was just an argument and Joshua did not assault him in any way. He advised that he was not in fear and had no problems with remain ing in his room for the night. Molly was advised that no crime had occurred and no one would be arrested. She stated she was in fear of J~shua due to his anger. She wa s advised that we could not force him to leave for the night. j asked Joshua if he was willing to leave and he said he did not want to leave his home. I advised Molly that if she did not feel safe, that she did not have to stay at the home that evening . She was advised she could go to a friend or relative's house if she so desired·. When the screener cantacted Mally, she tald the screener that she wants a Na Cantact Order Issued against Jashua, due ta cancerns far her safety. The screener nated that they faund that Jashua had a priar canvictian aut .of Nebraska far Simple Assault in 2001. I faund that Jashua is na langer in custody; he bailed aut .of jail an 05/24/15. I ran a Triple I Repart an Jashua. I faund this arrested as the .only thing listed far him in the State .of Washingtan. I did find the Simple Assault canvictian listed aut .of the State of Nebraska. Molly gave us a very lengthy overview of her dating relationship and marriage Josh. Our conversation with Molly went on for several hours. We all agreed that it would be better to meet again with tomorrow morning to take a recorded statement from her. During our conversation, Molly had referred to Josh Ike"oirlO numerous journals, which she felt would have information in them that would be of importance. We asked Moily the journals and anything else of importance back with her tomorrow. Molly had also talked of having taken lohcltos of herself with a large bruise on her leg from Josh assaulting her, a mirror in her bedroom that was broken during lan'Jth,,, assault to her by Josh, and damage that Josh had done to a bathroom door when he lost his temper with her Kobe. Molly was going to see if she could locate those photos. 9:45 ursday 05128/15 I arrived at the MRJC Prosecutor's Office. DPA Anderson, Advocate Brumley, and I met again with Molly. I had several questions and we talked with her for approximately two hours. Molly had also brought in a box numerous journals that she identified as being Joshua's journals. In looking through the journals, I saw that had handwritten on them the name "Josh Brown ." I asked Molly whose handwriting was in the journals; identified the writing as Josh's. The handwriting in all the journals appeared to have been written by the same hand. told Molly that I would like to take the box pf journals and have time to go through them. Molly was willing to let me take ICU:;(Qc,y of the journals. Icnnt~in told us that she had tried to find the photos we had discussed, but she had several different cells phones over the and she was still needing time to go through all her old phones. Advocate Brumley and I told Molly she could the photos to us whenever she located them. 1203 hrs., we started a recorded state with Molly; this statement concluded at 1415 hrs. we concluded Molly's interview, it was clear that she was very scared and overwhelmed by everything that had Ioc"un'ed over the last couple days. Molly stated she was glad that she was finally able to talk about everything that had Ihapp"nE,d during her dating and married life with Josh, but it scared her to think what Josh would do when he found out had talked about all of it. Molly expressed great concern over Josh taking off with Georgia, as he has done before to Molly, and that Molly would never see Georgia again. Molly was also very concerned over the fact that after all these no one would believe her or take her reports seriously. also feared that once the New York Giants Football Team management found out about Josh's arrest, he would be go from the team, or the exact opposite would happen, and the team would rally around Josh and look to vilify her in media. Molly believed the team would look for ways to sweep this whole thing under the rug and say that she was Im"kirm everything up. Molly had already received pressure from people in Josh's camp, Scott Weitz, Pete Moran, and I lack: from their conversations with Molly, she had ended up feeling that they were trying to get her to make sure charges were filed against Josh. As Molly had already talked about in her recorded statement, she talked more about fact that over the years, Josh and she were friends with many of his teammates and their wives. Several of Josh's Ite"mrnalles were aware of the domestic violence in their relationship, but it is clear that none of them did anything to call attention of the team management or take action to help Molly out. Molly feared that people from the NFL! would look to pressure her into making a ll of this go away, so that Josh and the 'team wou ld not face any negative Molly was very upfront that in her experience, the NFL publically says th at they have a no tolerance policy on estic Violence, but the reality is that they do more crisis management and look to cover things up. Molly was not that she could deal with that pressure, or the media coming after her and her children. Molly expressed concerns what all of this would do to Josh financially, and for her ability to take care of her three children. DPA Anderson asked Molly how she felt about going forward with criminal charges against Josh, Molly stated that felt that she needed to talk to her personal attorney first and discuss what this all meant for her children and her and to discuss with her attorney filing for divorce. was clear to me that Molly was very emotionally overwhelmed and had a great deal of important decisions that she felt needed to make all at once. I told Molly to take a few days to take care of herself and her children, and to talk to her laUornev. then I would call her and check in on her. This document is i ned by both Josh and Molly and starts off listing what Josh's "offenses" are. This was something Josh agreed to do part of counseling he was going through to work on his marriage with Molly. DPA Anderson had asked that I talk to Molly about her letting me interview her son's, Kobe Kemper, regarding what they have witnessed of Josh being abusive toward their mother, and Josh's direct interactions them, such as the incident of Josh kicking in Kobe's bathroom door and almost hitting him with the door. When I to Molly about interviewing her sons, that was a very emotional subject for her. Molly told me that the idea of Irl"mninn her sons into this whole situation was something she absolutely did not want to do. I explained to Molly that her i able to corroborate, and tell in their own voice, about some of the incidents that she had already t.alked to us would be very helpful to this investigation. Molly told me she understood what I was staying, but she felt she needed protect her children in all of this as much as she could, and at the time, only her older son, Kobe, had any rea l idea what going on with Josh getting arrested. I told Molly I completely understood where she was coming from as a mother, but she should charge her mind, to let me know. 06/03/16, I received a very panicked phone call from Molly. Molly told me that she had received a phone call from woman stating that she was representing the NFL and investigating Josh's arrest. Molly stated that she had no idea this woman got her phone number, and she feared it was actually a reporter calling her posing as someone from the Either way, Molly told me that she had a very limited conversation with the woman and told her that she did not want speak to her about any of this. Molly told me that if it truly was someone from the NFL calling her, she would not trust to really be having her or her children's best interest in mind. Molly stated that the NFL would only be looking to bury whole incident and protect Josh. I told Molly that she was under no obligation to talk to this woman, or discuss with l~nvnrlA that might try to contact her, the nature of this investigation. I told Molly if she wanted, I would call this woman and that she not call her anymore; Molly stated that she would appreciate if I would do that. Molly provided me the Iwc)m,m's name, Deborah Katz, and her contact number. subsequently called Deborah Katz and introduced myself to her. I told Deborah of my phone call from Molly and that it Molly's wish that she not call her again. Deborah started pressing me for information on this case. I told Deborah that would not discuss any part of this investigation, as it was an open and active investigation, and to do so could jeopardize investigation, along with the fact, that it would be highly unprofessional. Debora h tried to ingratiate herself to me by I me she was once a Prosecutor for the State of New York. I told Deborah that if that was true, then she should know I would not discuss an open and active investigation with her. Deborah asked me why I was saying there was an open active investigation if the Prosecutor's Office dropped the charges. I explained to Deborah that the Prosecutor's Office had not "dropped" the charges against Josh, they had simply chosen to not "file" charges at this time, pending further investigation into this matter, which is what I was doing. I clearly informed Deborah that depending on the outcome of my investigation, the Prosecutor's Office could still file charges against Josh. Deborah stated that she would call me back time to time to check on the status of my investigation. Over the next several months, I did receive several phone from Deborah that resulting in th e same thing, me telling her I would not discuss my open and active investigation with When that didn't seem to be getting the NFL anywhere, they had a Detective from another local law enforcement lal~!~'~i~'1l~W:~h'~0 apparently also works as a representative of the NFL, call me and try to get information from me on my Iii I told him the same thing that I had discussed with Deborah , that I would not share information with him, or IDISCUS,s my open and active investigation with him. with Molly before the holidays 2015. Molly stated that she had in fact filed for divorce and was trying to work out Ivisitation issues regarding Josh wanting George to spend time with him , and that Josh wanted to have Georgia fly out to York to spend time with him away from Molly. Molly and I talked abo.ut the impact this whole situation has had on her Ichilrl"'n and how she was doing herself. Molly's main focus was dealing with the divorce, figuring out what life was going be like for her after the divorce, and maki ng sure her children were ok. Molly was very fearfu l of what the future would like if Josh was cut from the team, and how that would impact his ability to pay child support. During our conversation, I discussed wanting to have all the issues with Josh behind her, and that Josh needed to be held accountable for all over the years, then Molly would talk about how all of it was just too overwhelming for her to deal with. Molly ued to be afraid of Josh and what he might do once the football season was over and he returned to the Seattle Molly asked for more time to deal with all the other issues in her life before deciding if she could proceed with a ina I case. I told Molly that I would check back with her after the first of next year, but if she needed anything before , she was welcome to call me. contacted Molly in February of 2016 and went to her house to meet with her. Molly and I sat and talked for about 2 hours. indicated that she was stil l working through the process of divorcing Josh, and if they could not reach a settl ement, i I hearing for their divorce would be sometime in July 2016. Molly told me that Josh had recently convinced her to SHERIFF KING COUNTY FOLLOW-UP REPORT 15-143510 8-6 the children to Hawaii to watch the Pro Bowl, and he would cover their travel costs and she and the children would have hotel rooms separate from him. Molly stated that Kobe and Kemper really wanted to she agreed to take the kids over for the game. Molly told me that after having gone, she felt it was a big mistake. was very controlling and was making a lot of cutting comments to Molly. At one point, Georgia had been playing with I"n'''''e cell phone and Josh took the phone from Georgia, so that he could go through Molly's phone and look at her texts Molly demanded her phone back and Josh would not give it back to her; this resulted in an argument that ruined the of the day for Molly and the kids. One night, Josh showed up at Molly's room drunk and was pounding on her door to let in. Molly refused to let Josh in, and eventually had to call NFL and hotel security. Josh was escorted away from '''A'''I·,'0 room and the NFL ended up having to put Molly and the kids up in a different hotel room where Josh would not where they were. Molly told me in retrospect, she wishes they had never gone to Hawaii, but Josh keeps offering to them places, and it is hard for her to tell the kids that they can't go and do all these fun things Josh keeps trying to get do. Molly told me she had been trying to figure out what she would do after the divorce, as far as work for herself a place to live for she and the children. During ou r conversation, Molly was very aQxious and appeared to still be very by everything that has been going on in her life over the last several months. Molly was 'still ambivalent Ipr,oce,edling with criminal charges against Josh, but she talked again with me in detail about the abuse she had endured for years. Whenever Molly would talk about specific incidents, her recounting of those incidents have always stayed the Molly has been very cons istent and believable when she talks about Josh's verbal, emotional and physical abuse to Molly was even willing to show me her bedroom and walked me through the assault when Josh pushed her into the mirror on her bedroom wall, resulting in the mirror getting cracked. Molly had previously indicated that the night this incident happened, she was to be in the house alone with Josh, so she had taken Georgia out of the house and ran to a friend's house, Antonella Molly stated that she had grabbed Georgia and her car keys and left the house. Molly showed up at Antonella's in the middle of the night, Georgia and her in their pajamas, with no phone, wal let, or shoes on. After talking with IAntonelllla about what happened, Molly and Georgia slept on Antonella's couch that night. Molly mentioned that again to me I asked her if she would mind if I talked to Antonella; Molly stated that was fine with her and she gave me Antonella's number. did call Antonella, but when I called, it was not a good time for her to talk with me. Antonella stated that she would call back and I provided her both my desk and work cell phone numbers; I never heard back from Antonella. the end of July 2016, I checked on the status of Molly and Josh's divorce, and found that it was still actively being In""e"orl, but had not been finalized yet.' I then went on vacation in August. When I returned toward the end of August, I that their divorce had still not been finalized. Molly has not reached out to me since we talked in February. At this time, it is unclear if Molly would want to assist in going Ifnrworn with any criminal charges against Jqsh, especially since their divorce is still pending. cannot hold this case open any longer, as I have no idea how much longer the divorce proceedings are going to go on, in a matter of a few weeks, I will be transferring to a new Detective assignment. having a formal recorded interview with Molly and several conversations with her afterwards, Molly has clearly Idetail"c a long history of emotional, verbal, financial· and physical abuse toward her, and to some degree the ch ildren, by detailed several physical assaults to her by Josh, but many of them were in other cities and states, outside the uri,;diic tiilJr of the King County Sheriffs Office. Within our jurisdiction, I find that there is Probable Cause to charge Josh (2) counts of DV-Assault 4 Degree , which occurred at their once shared residence in Unincorporated King County at address of 16214NE 165 St., Woodinville Wash ington. Iy stated that in May of 2014, Josh had come home intoxicated after being at a bachelor party. This upset Molly and confronted Josh about him driving home intoxicated. Molly stated that the following occurredthey were sitting in bed with their backs against the headboard, but looking at each other talking, Josh jumped up on bed in a standing position over her, which scared Molly. Molly quickly scrambled out of bed to get away from Josh. jumped out of the bed and came at Molly. Josh grabbed Molly and slammed her into a large mirror with a very large around it that they have hanging on their bedroom wall. The back of Molly's head and left arm hit the side of the and frame. Molly stated that this caused her a great deal of pain to her arm and head. Molly ended up on the floor of the bedroom next to door to the en suite bathroom where it goes carpet to marble in the bathroom. After Molly hit the mirror, she fell down on the floor and her body hit the marble . Molly tried to kick Josh away from her and somehow ended back on the carpeted area of the bedroom floor. Josh down on the floor on top of Molly. Molly was face down on the floor and Josh held her down by putting his forearm lacr'oss the back of her neck and laying on her with his full body weight. Molly's face was pushed into the carpet and she that she could not move her head or her body, and it made it very hard for her to breathe. Molly stated that as much she tried, she couldn't get her hands free to fight back. I asked Molly how tall she is and how much she weighs pared to Josh. Molly told me that she is 5'3" and was about 100 pounds at the time of that incident, compared to Josh 6'1" and 205 pounds. Molly described this incident as, "Like he was doing like a take-down on me you know." Molly that her two boys were with their father that night and Georgia·had been upstairs asleep in her room. Molly believed her screaming must have woke-up Georgia, as Georgia came downstairs and came into their bedroom. Georgia saw holding Molly down on the floor and this caused Georgia to become very upset and start crying. Georgia said, r" \N'h"t"~wrong with mommy, why was mommy screaming earlier?" Molly stated that during this same time period, several friends of theirs, includ ing other players in the NFL, were aware was domestic abuse going on in Josh and her relationship. Josh even sent a personal email to several of their i with an attached letter in March 2014·where he adm itted to being abusive to Molly. This letter reads in part, 'This email is a different one for me to write. Per the contract I have with my counselor and also Molly, I need to set the record straight. I have been a liar for most of my life ... I made selfish decisions to use and abuse women starting at the age of 7 feel this void. I objectified woman and never really worried about the pain and hurt I caused them ... My ability to connect lenl0tiionailly to other people was zero: my empathy levels were zero. Up until about 10 moths ago, I didn't even know the I rl~f; n;II;"n of the word empathy. Because I never handled these underlying issues, I became an abuser and hurt Molly Iphysi,cailly, emotionally and verbally. I viewed myself as God basically and she was my slave. I carried an overwhelming of entitlement because I put money higher than God and I used it as power tool. .. I know that she feels as if all my If,;pnrl, believe I am this super great guy who does nothing wrong and that everyone will blame her or hate her. I am to for all of this." In Josh's own journals, he has an entry that read, "I have physically, mentally, emotionally and verbally been a repulsive I have not stuck to my beliefs. I have lied more to myself than anyone. Why would Molly want to be with me? I " Then circled below that Josh wrote, "I have abused my wife." was afraid to report this incident to the police, as she feared no one would believe her. Molly was afraid of it Ibecorninlo a spectacle in the media and that Josh could loose his job. Molly also stated that she had already been let down players in the NFL that were aware of what was going on. Molly had confided in some different players wives who listened to her and believed her, but once their football player husbands found out, even after the letter Josh had , the players didn't believe Josh had done any1hing wrong. Molly felt the NFL had clearly given the message that no with in the NFL was going to do any1hing to help her. 05/21/16,.Molly called 911, as a heated argument had occurred between Josh, Molly, and Molly's 16 yo son Kobe. had become extremely angry and got up in Kobe's face while yelling at him. Josh's behavior scared Molly and she Ifealfed that Josh was going to assault Kobe, so she called 911 for help. The Deputies found that no crime had occurred asked that everyone try to stay separated for the rest of the night. following day, on 05/22/15, Molly called 911, as Josh had assaulted her. Molly had tried to stay away from Josh that as she knew that he was still upset over every1hing that had occurred the night before, and angry that the police had to their house. When Deputies Lambert, Kearns and Shears responded, they spoke to Molly, who told them that and she had been discussing their finances , which had turned into an argument. Molly had gone into her office area find that Josh had a bunch of paperwork and bills strung out all over the desk , and it appeared that he had been on IMOl lv"s computer. Molly went to see what Josh had been doing on her computer, and he came at her very quickly, which I sc~t red her. Due to a long history of Josh loosing his temper and becoming physically violent toward her, Molly feared that was going to do something to hurt her. Molly went to reach for the phone to call 911. And I had asked him to leave several times when I saw that his temper was starting to flare and um, and that is what our counselors asked us to do, is for him to respect that when I am starting to feel threatened . (sigh) ... you know, for him to show concern and actually you know, leave, is the situation 'cause [sic] he has-he can't control himself sometimes and Ijust you know, he wouldn't leave and I knew that he was .Iike in that state and so I just didn't want to argue with him . DPA: So it sounds like, it sounds like that whatever argument that sort of happened before he grabbed you, kind of started the day before. Is that right? Page 2 of 58 Case Number: 15- 14351 0 Name: BROWN, MOLLY Vic: Well, basically, what had started the day before was him just kind of being mad at the boys or jealous of my ex-hu sband because we were commun icating nicely. It's like he was mad that we weren' t fi ghting. DPA: You and your ex-husband? Vic: Yeah. And he- he was upset with me that I was handling my son and like talking to him about stuff and then he came down and tried to sort of override me and I turned and I was like "I got it, its okay." And he instantly was super angry because he says that I disrespect him and you know, he- you know, he's the man of the house so he's you know, the one that ultimately needs to be respected kind of thing. And um, you know, but when I stood my ground, he got really upset and then when my son spoke up ... DPA: Which son is this? Vic: KOBE my oldest. .. DPA: KOBE? Vic: ... my 16 year old. When he spoke up, then JOSH kind of lit into him and came towards him like you know, like gritting his teeth and you know, like leaning forward and pointing. I mean it was- it was li ke, like right before when a fight starts. DPA: What did . .. Vic: It was like trying to you know, he was trying to hurt somebody. DPA: What did KOBE say that made JO SH sort of get that way? Vic: I think that he just said that "my mom and I are already talking." You IGloW I think tllat he just was kind of in a way standing up for me like you know, "my mom deserves to be able to talk to me too." And it' s not like I was like praising KOBE, I was like sitting there getting after him fo r being 15 minutes late you IGlow. And not that big of a deal but you IGlow, patt of the thing with me being alone with the boys is I need them to respect me, and-and foll ow what I say you IGlow? DPA: Because JOSH is been around all the time you mean? Vic: Yeah, because he is in New York and I, you IGlow, when he comes in it's almost like he takes that power away from me. Um . .. DPA: So what made you call the p ol ice that night. .. Vic: I thought that he was ... Page 3 of 58 Case Nu mber: 15-1435 10 Name: BROWN, MOLLY DPA: Vic: ... (et, unin) JOSH ... He got so angry that I thought that he was going to do something to KOBE. 'Cause KOBE . is getting bigger now and you know, he's .. . (sigh) ...just seeing the· look on KOBE's face when he-JOSH came towards him. You know, he was like casually leaning against thewe have like kind of a table like, not table, it's like a built-in cabinet by the back door. And he was casually leaning against it when he was talking to me. And then as soon as JOSH got that angry and started yelling and getting in his face, he just like stood up. And his face had like this cross between reall y scared, like little boy scared and "I don 't know what to do" like almost like that. Like it was a different look, like- like I want to protect my mom. And um, you know I- I actually jumped in between- KOBE was not advanc ing him at all, in any way. But he was just like "whatever JOSH," you know. And then he-KOBE never saida word when he got in his face, he just got his look on his face like he was like glaring at JOSH and urn, I walked in front of JOSH, in between the 2 of them . And I was like "you cannot get in his face!" you know. I said "that is not okay," and he just proceeding to keep yelling at me, telling me that he didn't get ih KOBE's face . And that I don't know what I am talking about. And then KOBE said again, he said "yes you did, you just did!" He goes "you' re veins in your neck were sticking out," and JOSH said "no they weren 't. I'm, I'm not even yelling" you know. He always says that, he'll be screaming and te--and he'll be like "I'm not yelling." And he kept go ing and I-there wasn't anything that I could do so I just walked in the other room and I called 9-1-1 and I told the gal what was go ing on and at certain times when I could hear him like coming back or she had me like lay the phone down. And then at one point, he came in the room and I had the phone laid down and he kept saying "who are you calling right now? Who are you calling, what are doing? Where's you r phone, give me your phone, I want to see it. " And I was like "I don't have a phone," and he' d like ... DPA: You mean your cell phone? Vic: Yeah . I don ' t know if thought if! was calling somebody or texting them because in the past, I've done that, instead of ca lling 9-1-1 . And urn, you know, I' ve like called the neighbors and they've come up to the house to try to get him to calm down. Urn ... DPA: So whi ch phone was it that you said that you "laid down" .. . Vic: (Cross-talking) the home ... DPA: .. .the cell phone ... Vic: ... the home phone. DPA: Like a land line phone? Vic: Yeah, it was the land line phone. And ... And . . .(sigh) .. .I remember he like went up to the .bed, when he finally did see it, he's like "well, what's this?" He picks it up and he's like "who 's on the phone?" And he's just like looks at me and hit the "end" button. OPA: And so, who was on the phone? 9-1-1 ? Vic: Yeah. OPA: Okay Vic: And then they ca ll ed back. So when he did that, I went upstairs to find KOBE instantly. And um, our daughter was asleep. By the grace of God, she was like completely asleep, didn ' t even wake up during any of this. OPA: She's pretty young though right, 5? Vic: Yeah and she had 1ike a half mil- or half a ;nilligram of Melatonin, so I think that probably like, she j ust go tten into like REM sleep at that time, 'cause I don't know, it was like 10 o'clock at night and um- so when I went upstairs, I was trying to ta lk to KOBE and I kept telling him it's not, this is not okay. This is not your fau lt because JOSH, when I walked away, he goes "do you see what you made us do?" He kept saying that to KOBE, "do you see what you made us do? You got-you made your mom and I fight. " And then he's like "thanks a lot KOBE! " you know. He'd say things like that. And when I went upstairs and I just kept telling KOBE um , "this is not your fault. It' s not okay. Like, I'm not going to let him do this to you. Like he-he's" you know. And then all of sudden in the doorway, with that same phone in his hand, and it rang and he was like, he answered it was like "oh my gosh, who called 9-1-1 ?" And he's like "here" and handed me the phone. And then he wouldn' t leave the dOOlway and the operator kept telling me "just don 't ta lk to him, don't talk to him" and you know, he 's kept you IGlow, ask- I th ink asking "who called 9-1-1 ?" And when the po lice came he asked them who called 9-1- 1 and then, 1 was the next day I was really scared that he was going to find out that it was me that called. And um . .. DetO: What were you afraid of? Vic: I don't-just him getting mad. The potential fo r anything happening at all or escalating 01'-1 mean he's done all sorts of things where he tries in whatever way that he can to like hurt me, whe-whether it's like reall y bad insults or like taking my credit cards out of rriy wall et and hiding them from me or um, you know, demeaning me to other people or you know. Just like, just bullying me or pushing me around or you know, that kind of stuff. And I didn't want hi m to take it out on the kids more because . .. (sigh) ... he- he was already blaming KOBE for it and he tells me a lot that I choose the kids over him. That he comes second to the kids and that' s not right. And I had just, I- I told him even recently, I said to him "that is all I do care about right now," you know? I mean, 'cause he's you know, he's treated us really badly and ah ... (sigh). So the day that I, why J locked the door and stayed in the room all day is I- I was too worn out to argue. I was already so depressed, that I didn 't even hardly even want to get out of bed. The only time that I um, got up to do anything for myself was like, I don' t Imow, maybe like around 10:30, 1 had a massage gift card given to me for Mother's Day. So 1 went down to InSpa and got a massage and went to Taco Time and then 1 came back to the house. A nd he was sitting on the weight bench working out. And 1 had still had li ke, I was crying up the hill, on the way driving, he looked at me and said "why are you crying?" almost in this like, mocking kind of way, like nothing had happened the night before. And I was like "I don't even want to talk to you, 1 just don't feel good, you just need to leave me alone." And he started saying "well we need to-we need to talk, 1 want to have people over. I want to have a barbeque, you need to go to the store," and 1 was just like "please leave me alone," and I went straight to the bedroom and locked the door. And I just laid in there and tried to watch movies and read and stay in there. And he would come to the door, he' d knock all the door "I need to get in there" and I would be like "you' re not com ing in. I don 't- I don' t want you in here, like you, please leave me alone." And he' d say "well, I want to have my men 's bible study group over for barbeque." And I was li ke "no" like "leave the door!" 1 didn't even want to engage him in conversation as I didn ' t want him to like pick the door lock or you lmow, push it open, 'cause it's already been jarred enough before by him to where it really technically doesn't fully lock. DP A: This is just a regular bedroom door lock, I mean, if he wanted ... Vic: (Cross-talking) It' s a double door ... DPA: ... I mean, if he wanted in, he could- he could get in right? Vic: Yeah DPA: I mean, it's not like; .. Vic: (Cross-talking) The police officer saw ... OPA: ... not like a dead bolt or anyth ing. Vic: ... the door hand le. No, the pol ice officer saw the door hand le when we got there and it already had like from where the, like (unin) li ke where the round thing is on the door from him like yanking on it. There are black marks up and down and that's from you know, from last year. DPA: Okay Page 6 of 58 Case Number: 15-14351 0 . Name: BROWN, MOLLY Vic: So urn, he came back a few times you know, one time saying that he wanted to do that. And then the next time, he was angry, saying that he wanted to have a discuss ion about having JUSTIN and my boys all over, so he could lay down ground rules. And it was . .. DPA: JUSTIN is your ex-husband ... Vic: Yes DPA: ... right? Vic: Yes. It was like he was trying to do like any kind of power-play to get me to come out of the room. And urn, then I think the 3cd time that he came back, he said "we are about to have a conference call with our financial advisors, you need to come out and have it." And I emailed our financial advisors and I said to them "I do not want to have a conference call ri ght now with JOSH in person," like this-this subject like money in general, esca lates him. And I basically said "I am willing to do it" you lmow, "after the holiday weekend, on a conference call when he's back in New York, but I don't fee l physical ly safe doing it right now." DPA: Is this urn, conference call that was already scheduled? Vic: No. I don't even know if it waneally even happening because I talked to one of-Barb, the ga l, th is morning. And I told her kind of like you know, I- I just didn' t reaunderstand why you guys would do a conference call at you lmow, 3 o'clock on a Friday, going into a holiday weekend , planning out a budget for the next 6 months." I mean that's- that's definitely something you'd plan in advance so. Part of me .. . DetO: What was her response to that? Vic: ... part of me believed it. She was like "yeah, no, I mean, it's some-it' s something that we want to address but" you lmow. She's like "we weren't doing it on Friday," you know. She's like JOSH was asking for it but urn. And then ... DPA: So that was something that was on the list of things that your fami ly was going to do ... Vic: No DPA: ... but it wasn't something that wasn't scheduled for Friday? Vic: It was something that we were- it's kind of ta lked about ... DPA: Talked about? Vic: ... because we had a bunch of unexpected expenses pop up, like we had a mouse infestation and we had to get all new insulation and it was li ke $6000 and ... Page 7 of 58 Case Number: 15-143510 Name: BROWN, MOLLY OPA: Yeah Vic: ... and you know, I'd gotten new f'urniture for the living room and you know, there was a lot of money going out in one month. And we were trying to you know, plan for the next year. But we do it every month, but we- I usually talk to them on the phone or you know, ifI find a mistake like in the bookkeeping like ... (sigh) ... any of that. But that is always the first thing that he when he comes back, 'cause he likes to go through the niai I and go through that stuff and- I mean that's fine but it's like it turns into a fight or. .. OPA: Who typ ically pays the bi lls? Like writes the checks and does ... Vic: . Om financial institution does. OPA: So like even your um, like your cable bill ... Vic: Yeah OPA: ... or your electric bill ... Vic: Yes OPA: ... or whatever? They take care of that typically? Vic: Hmm mm . OPA: Okay Vic: Because with his job, athlete's addresses tend to change a lot. Like things get missed in the mail, like speeding tickets or whatever. And you know, it's like important stuff that could cause a big problem or ruin your credit or-so they take care of everything. They send us copies of everything, we get itemized reports at the end of every month. OPA: So you guys basically hire somebody to sort of smooth out the rough edges ... Vic: Yes OPA: . . .from traveling and all that stuff. Vic: Yeah. And what they do is that they do investment. They do um, li ke accounting. They do you know, all of it ... it' s all inclusive ... OPA: They're full service deal? Vic: .... and instead of doing like comm iss ion fees, they do a flat yearly rate. Page 8 of 58 Case Number: 15-1 435 10 Name : BROWN, MOLLY OPA : Okay, alright. Okay so um, you are in the bedroom, JOSH is trying to come get you to come out. .. Vic: Yeah OPA: ... um . .. Vic: .. .I told him to have them call me and not- I wasn 't coming out of the room. And then .. . OPA : Oid you come out at some po int? Vic: Yes . I did come ... OPA : And what prompted you to come out? Vic: (sigh) .. .The fact that [ had been laying down so long and my neck was starting to really hurt. Urn .. . OPA: Was it something that JOSH did that made you come out? Or you just went out because you want out? Vic: No, [ went out 'cause I wanted to make brownies for GEORGIA when she got off the schoo l bus. OPA : 'kay Vic: And I had been sitting in there for a really long time and it had been really quiet after that. He-he left, I mean ow' bedroom, I mean it's all the way at the other end of the house, and I didn ' t know if he was even still there. OPA : H mm mm Vic: And you know, because the last time that I had actually physically seen him other than him pounding on the door which I didn ' t see bim , you know, I couldn't see him , but the last time that I'd seen hi m, he was in the garage working out. So I didn 't know what he was doing, maybe working in the yard or gone or what. And it was quiet so [ just went out and to make brownies and um, I could hear him in the other room on the phone. And I' m like "who are you talking to?" And then I was just like "never mind" you Imow, and went back into the kitchen and then Ijust started li ke making the eggs substitute for the brownies and he came in there, and kind of started in on me, li ke with the financial stuff and telling me that he's going to put me on an allowance and ... (sigh) ... you know, this and that and the other. And then I told him like that I didn 't believe him, that there was, that they were really going to have the conference call, like this late on a Friday, 'cause I'm like I bet that they are all out of the offi ce already. And urn, then he's like "we ll , I- have you called your attorney today because I've called 2 divorce attorneys." A nd I was like Page 9 of 58 Case Number: 15-1435 10 Name: BROWN, MOLLY "what?" And I think that he like drew me in more, like right at that moment when he said that 'cause I was like "who did you call?" you lGlow, it was I ike- I just thrown off by it. And then I felt myself getting sucked into the argument and so I just left the stuff in the kitchen and I walked down the hall into the laundry room, which is- that is where all my files are and my computer and the laundry, and it's like one big room and um . . .I went in there and there' s just stuff spread out everywhere. Like all these screens are open on the computer and ... DPA: What kinds of stuff are spread out? Vic: Li ke financial documents. DPA: Okay Vic: Like it almost looked like he was urn, trying to like go through and rebudget or highlight things. [ think that when he was on the phone initially, remembering about that, he was trying to call the credit card company and dispute. He was trying to dispute charges. And I had said to him "that is" you know, "such and such, and such and such. You should ask me, I can tell you what that is before you call and dispute it and they open up," like you know, "an investi gation on something that doesn't need to be investigated. And that is why I get a printout at the end of the month. [highlight stuff that I don 't know what it is" and then, so um. That's probably made him mad. DPA: So were these papers or financial documents that you had gotten out 01' ... Vic: No. He had gotten out. .. DPA: Okay Vic: ... and he- he opened up all the mail like, I usually-I usually like really go through the mail like 2 - 3 times a week. I can 't-I don' t have time to do it every single day you know. It sits and um, in a bin and it had been a really hard week because [ had flown from Seattle to um, New York. And then we went to a wedding in Connecticut of his teammates and then we down to- to Jacksonville Florida for Coach COUGHLIN's like go lf tournament. And then fl ying back from Jacksonville I got a message saying that my aunt had only like hours to live and [got off the plane and I went to the hospital and um ... (9 second pause, crying in background) .. ,! basically sat there with her until she died. And .. . (crying) ... it was just hard 'cause my grandma'S 90 years old and she had to watch her daughter die and [just- it was a hard week. It was hard, really emotional week and I'm just ... (crying) .. .! couldn 't get anything done and ... (crying) ... my bilthday was the next day and urn ... DPA: What did you guys do on your birthday? Page 10 of 58 Case Number: 15- 14351 0 Name: BROWN, MOLLY Vic: My mom and dad and grandma took me to lunch and JOSH flew back, I guess a day ea rly from um .. .(sigh) .. .New York, from work. And urn, just came home and that was it. Urn ... DPA: Did you and JOSH do anything for your birthday? Vic: No. I-Ie got me a card and a book in the airport. And ... DPA: (Cross-talking) I'm sorry, go ahead. Vic: ... so you know, there might have been like, there might have been a like week's worth of mail there and so, he was probably mad. I mean that it was piled up thinking that I don't do anything and-'cause a lot of times he says like "what do you even have to do?" Like "what do you do all day?" and things like that. DPA: D id he say something or is that something that what you think that. .. Vic: It's what's happened before, like multiple times. DPA: But with this particu lar incident, did he say something about the mail? Vic: No but I knew that the fact that he had it all opened and was go ing through it, he was upset. DPA: Okay Vic: I mean, 1-1-1 know like when to avoid him. DPA: And did he say anything about the cred it cards or the finan cial records that he was go ing through, did he say anything about that, those things that he was upset about with you? Vic: He--:he was talking about the budget and he was trying to dispute charges that were on my American Express that were like for- like one was for a plane to ticket to fly back. And you know, like one was for some random PayPal thing which was like urn, you Imow, I can't even remember, I think it was fO!' an ottoman or something I had bought. And I paid the- the gal through PayPai. .. (sniffing) . ..and then you Imow, that kind of thing. And then he was just like "too much money is being spent" and da-da-da-da and that sort of stuff. And urn . .. DPA: Is that something that you guys fight about often? Vic: It is when he gets stressed out like um- I think, it's like I think when he's um feels like he doesn 't have any contro l or anything li ke that. Like he 's always has this like sense of panic that everybody is after his money and I'm-he tells me that you know, me and the kids urn, basically like, we're just here, caring about ourselves and he's the one working and all- all we use him for is take. care of our lifestyle . Which is cruel and it's not fair and you Page I I of 58 Case Number: 15-14351 0 Name: BROWN, MOLLY know, like I-he's always told me like things that made me feel like I um, was like a leach and that I didn't contribute and that I was a "go ld-digger" and that um ... (crying) . . .and his family was rea lly mean to me about it. But um, I stmted a business because of it, like I was so insecure about it and I wanted to prove him wrong and I started a really good business and it was-like we won awards. Like 2 years in a row, I got like nominated for like one ofSt. Louis's most influential women (crying) ... and then he wanted me to move! DPA: Because offootball? Vic: Yeah. Like he was cut but he-he wanted me to move and I bas ically had to walk away and try to run it from across the country and meantime, he's all the way like, in New York and I'm in Seattle and ... DPA: What kind of business was it? Vic: It was- it was like a high-end women's boutique. But I mean I.. . DPA: Did you have a storefront? Vic: Yeah. And I, I had ecommerce and ... (crying) .. .it was, it was very well liked but it, between all of the chaos of him always changing his mind on everything and always saying like "I want to move here this time," or "you guys need to be here that time," or "1 want to sell this," and it was always him doing something to keep it chaotic and then he was you know, like you need to try to close your store. Because he was .. . DPA: (Cross-talking) To close it or. .. Vic: ... because he knew how overwhelmed I was . And I-I did . DPA: Did you close it or did you sell it? Vic: I sold off like parts of it. Like you know, om client database and like, our racking and all of that. And then I had people buyout inventory and I- I so ld pieces of it, because the landl ord was trying to gouge everybody that was trying to ... (sniffing) .. .move in. Because my, you know, the lease was up and it's just, it didn't need to be closed but it was one of those things where it was like I tried to prove myself to him, to make him stop, you know, making me fee l that way and it didn 't work. DPA: Was it profitable? Vic: It would've been if! had been able to be there. It was profitable when I was there, you know. I mean ... (sniffi ng) ... it was very well liked you know, we had like BOB COSTA's w ife use to shop in the store and like ... DPA: Oh reall y? Page 12 of 58 Case Number: 15-143510 Name: BROWN, MOLLY Vic: Yeah, like people from like, the like from Anhauser Busch fam ily in, you know. J mean it was (crying) . .. DPA: Did JOSH put up the money to get you started or where did that come from? Vic: It, the money came from li ke a line of credit that we had taken out, to finish our basement in St. Louis and he ... DPA: Like an equity line kind of thing? Vic: Yeah, or no, J don 't Imow if it was like a revolving line of credit. DPA: Oh okay Vic: Yeah because it was better than pulling money out of stuff that could be growing ... DPA: Sure Vic: ... the interest rates were really low and ... DetO: Did JOSH monitor your spend ing or ask you to be accountable you know, all the stuff that are on the bills, tell him what everything is? Vic: Well. .. back then, I basically only got a celtain amount every month . Like if we have a new financial advisor now, because back then, we would only- we had one joint account and all the other accounts were in JOSH' s name. And um, I would only get so much a month on that card. Or you know, a debit card or whatever. DPA: For what purposes? Vic: For paying the house bills, for grocery shopping, for shopping, anything. DetO: And did you ... DPA: Okay. And did that, that wasn' t just your personal money ... Vic: But it was like ... DPA: ... that was for household expenses, youlmow kids ... Vic: Yeah DPA: .. .ah, school project, money, whatever .. . Page 13 of 58 Case Number: 15- 1435 10 Name: BROWN, M OLLY Vic: Yea h DPA: ... school supplies, stuff like that? Vic: Yeah DPA: Anything that you needed for the house? (no response heard) DPA: Okay. Vic: Yeah, pretty much. I mean ... DPA: Sorry I interrupted you DetO: Ah, he .... Vic: (Cross-talking) He did, we ll I did have a later like, I did have an American Express but um, I didn't really use it that often you k.now. Um, we used- we would use it for li k.e bigger things like tri ps or you know, anything big-a big purchase because for the benefits. But I would always get like you know, him stress ing like "oh my gosh, the American Express bills is thi s much this month," and you know like he'd just signed a 14 million dollar contract and like I'm li ke "you ' re freaking out over this?" you know. It ... (sigh) ... it- I just think that he just wanted to feel like he was calling the shots. And um, and I always wanted to prove that I wasn't some "gold-digger," so. DetO : Ifthe money that you had on that card for whatever reason you had some larger expenses or something, and you ran out of the amount that was on that card for that month .. . DPA: Your allotment DetO: ... what would you have to do to get more money? Would you have to ask JOSH to put more money on the card or? Vic: Yeah . Because like his financia l advisor, wasn 't really somebody that I could just call and be like "hey, I need you put more money into ... " I would have to ask him for them to like wire mo·re money into it or deposit more money into it or, you know. Or J wou ld just use the American Express and be like J, you know, the account' s low. But.. . DetO: Would he ever say "no" or. .. Vic: He actually, he would ... DetO : .. .decl ine that? Page 14 of 58 Case Number: 15-1 435 10 Name: BROWN, MOLLY Vic: ... he wouldn 't, he wouldn' t really monitor the account on the- the smaller account. He would only get mad about the American Express account because he could see that bill, I think, at the end of the month. Or if we did run out of money, because he was linked to that same account, it was one lump sum between both of us. And like, he would like, overdraft like 14 times and I would be like, like checking the bank and be like "you just pa id" you know, "a ton of money on overdraft fees, like you are even watching it." But yeah, he would get mad at me fo r ... it j ust depended on his mood. Honestly, if- if he . .. if he was in a good mood and things were happy and going hi s way, he would be like "oh yeah, call the bank, have them transfer money." If he was being a jerk or having a bad day, he would be like "that is more than enough money for you to live off of," you Imow, like "what is it that you even need money for," and like really li ke make me feel super guilty, um and ungrateful. I got called "ungrateful " a lot. DPA: What kinds of things would make him have a bad day? Vic: I don't know. Maybe like a coach at work or another teammate, he would have like arguments. Or would he would do bad, like when he would perform bad, he was reolly grumpy. And every year like going into training camp, was always so stressful. Um .. . DPA: Because ofthe uncertainty of making the team or something else? Vic: Yeah, but every year he would. It was almost like he wanted to complain and stress about it so I would sit there and tell him like I' d be his cheerleader. I'd be like "you know you're not go ing to lose your j ob" like that. Like yo u know, he wanted his ego stroked basically. And I knew that sometimes like if he was in a bad mood, I could like-like ifI talked to him and made him fee l good about himself, he would you Imow, like be in a better mood or I could change his, his mood. DPA: Was there a period of time during your marriage where this kind of stuff didn '/ happen? Vic: No DPA: Was there a time when things were great? Vic: Hmm DPA: Great all the time and ... Vic: Money was always an issue with him. Always. Um, like I can remember one of our first really bad fi ghts um-so we got married in July and I got. .. DPA: Of what year? And I got pregnant like November of2008 and it was just li ke a few months later, I think I was just li ke showing and he some, some- something, we were arguing over fin ancial mail thing. I honestly, I can' t remember what it was about but I know that he was standing next to the desk and he um, he said "you know what, if you don't like it, you and your kids can get the ' f' out of my house." And I said "this is my house too." And he was like "no! " He was like " it's not your house; I'm the one that makes the money. You don't do anything," yo u lenow, stuff like that and he . .. (sigh) .. .1 said "what are you going to do, like, I' m like-I- I can' t. I'm like part of thi s house is mine, like where am I go ing to go? On the streets?" And he's like "you figure it out." And here I had moved my children across the country and you know like .. . DetO: Where were you li vi ng in ... Vic: .. .it's like I helieved what he said, it's li ke it' s so stupid! DetO : Where were you liv ing in Illinois? Vic: In St. Louis DPA: Is that where you met JO SH? Vic: No, I-we dated for 3 years, in Seattle. And then got married. DPA: When he was with the Sea hawks? Vic: Hmmmm DPA: Is that what you mean? Vic: Yeah DPA: Okay. And your kids and yo ur ex are from here too? Vic: Hmmmm DPA: Alright. So you moved to St. Lou is to be with JOSH? Vic: Yeah so, well we dated you Imow, for 3 years and then his contract was up with the Seahawks and he signed with the Rams. And I had actually begged him, like begged and p leaded with him, because I knew that he had bought a ring because my brother told me that he had asked my dad for permission or whatever and um .. .1 just kept begging him like not to sign in St. Louis because of the boys um. He's like "no one is going to tell me what to do, this is my career," and so he signed in St. Louis. And um .. .you know ... DetO : So you moved fairly qu ickly? Page 16 of 58 Case N umber: 15-143510 Name : BROWN, MOLLY Vic: (Cross-talking) Then he started acting strange and like distant and we were suppose to go to Hawaii on a trip and urn, hc- I knew that he was going to propose to me there, like I knew it. And . .. (sigh) ... the night before we were suppose to leave, he called me and um, he was acting weird and telling me that he you know, that he just wanted to be honest with me and that he had met somebody else and that she gave him butterfl ies, um, and that he didn't feel that it was right to urn, you know propose to me, and get if.-ifhe could have those feelings towards somebody else. And he told me that "but you can go to Hawaii." And I didn 't go obv iously. Like my heart was broken, and I to ld him you know "never talk to me again." And ... (9 second pause, crying) DPA: What turned that around? Vic: I mean we had been through a lot that year and so (crying) ... DPA: Because of football? Or something ... Vic: No ! No because I had accidently had gotten pregnant and um ... DetO: So you were pregnant when he told you that there was somebody else? Vic: No . DetO : No. Vic: It was during the middle of the season and I mean, it was not intentional by any means. I was like I went to the doctor for something else and they came back in and were like urn (crying) ... DPA: (unintelligible) Vic: .. .and he, I remember telling him and he you know, accused me of doing it on purpose and told me that I was a "gold-digger" and then his sister was calling me and threaten ing me and saying like "oh, I bet if he was a salesman at a Ford dealership, you wouldn't be pregnant right now." DetO : And this was before you got married? Vic: And ... (crying) ... and then you know, he went from like being supportive about it to not. And then telling me like "well, I need to like confess some things to you," and you lmow, he gave me a half story of what I eventually found out that he cheated on me with somebody else during that timeframe. And I was really stressed, I was like not sleeping and you know, I think like 10 or 12 weeks into the- the pregnancy, I went in for an ultrasound ... and I lost the baby so it was just a hard year and um ... (crying) ... so stupid, I so und like such a maltyr right now, so .... Page 17 of 58 Case Number: 15-143510 Name: BROWN, MOLLY DPA: It' s okay, just take your time. Vic: So you know, when he said that to me, like I knew when he was proposing months later and you know, it- it just, and to have that drop [sic] out was really hard and eventually he claimed that he just had cold feet and he was really sorry and I wouldn't talk to him. I didn't talk to him for a month and he, like he fl- flew off to Seattle and showed up and proposed, you know like .. .(crying) ... and then he didn't want to wait like a year, he wanted to get married like ri ght then because he wanted me and the kids in St. Louis . And then ... (crying) ... but apparently the whole time that he was in St. Louis that I wasn't there, from you know, like February to May he was sleeping with one of his sister' s fr iends you know. And-and I just found about that like a year and a half ago because I- I made him take a polygraph test. And yeah, I just-if! had known that, I probably wou ldn 't be married today. It's just a lot of pain but. . .I love my daughter, so .. . DPA: Weum ... Vic: ... um ... (crying) ... DPA: ... so you guys had been SOlt of up and down, back and fOlth .. . Vic: Yeah, oh yeah DPA: ... even before you were married? Is that a ... Vic: It was ... DPA: ... fair characterization or. .. . Vic: It would be like ... DPA: ... is not fa ir? Vic: ... it would be like ... (sigh) .. .yeah, I would kind of push him away a little because I didn't want to-I didn't want to date a professional athlete. I didn't want you know, like- I was a mom with 2 kids and I just- I-it was too much fo r me. And you know, 1. .. he would always like heavily pursue me back. Or like he would you know, like-we would get back together and then someth ing wou1d happen and he would be like "well we weren't dating." You know, tr'ying to make me think that like something wasn't there that was or you know. And Ijust... DPA: Let me---Iet me ask you this MOLLY, um . .. a couple of nights ago when things got physical um, and based on the fact that you know, that you've had tbis relationship that has gone up aild down, um for almost 10 years now? Vic: Yeah DPA: How many times do you think? Vic: Well that was what.. . the first time was, and I'm so sorry, I got so off track there ... DPA: It' s okay, it's okay Vic: . .. but the first time that I can really remember him being physical, that stands out li ke in a big way, because Tthink that a lot oftimes I- I downplay stuff, was um when I was just starting to show, when I was pregnant with GEORGIA and . .. DPA: When was this? Vic: .. . he told me "get out of the house" you know, "with the kids." He said "get out of my house." And then I think I just kind of got sucked into the argument and I' m like "we ll , you're going to ki ck your pregnant wife and children out on the street?" And he' s like "yeah." And I was like "what abolit your daughter," you know that I was carrying at the time when he said to me "well my sister and I already discussed this. And she said that she'd raise the baby. And you're crazy and I'm going to take her away from you." Like she's still inside of me. And I got so mad .. . (crying) . .. and there was a box of mail that we had initially were arguing over, I took it, I like threw it off the desk and the papers went everywhere and he--I remember grabbing my shoulders and like just pushing me into the door. And the boys were just down the hall and they freaked out and ran upstairs and they V' called their dad, and told their dad what happened. And urn ... DPA: So, tell me what JOSH did exactly? Vic: Like he grabbed my shoulders, like, you know like- and like he was telling like, he was mad at me because I pushed- I lost my temper and I pushed the stack of papers on the desk. He liked grabbed my shoulders and like you know, we had double doors coming into the offi ce. And like I was closer to the wall that was perpendicular and it was like he li ke, took me and like and pushed me into the door, like holding my shoulders. And you know, it -it was louder, it seemed worse than it was because the doors were double doors. DPA: So it made a big noise. Vic: Yeah DetO: How are far away from the door were you when he initially grabbed you? Vic: I don't know, like- like 3, 2, 3 feet? Page 19 of 58 Case Numbel': 15- 1435 10 Name: BROWN, MOLLY DetO: So basically you were stand ing pretty close to the opening ofthe doolway? Vic: Kind of. I mean I was kind of like- there was a wall with a file cabinet in front of it and it was low where the mail was and by the desk. And then, yeah, I mean it was- it never felt I.ike he was like pushing me and letting go. He hel-held onto me you know. DetO: And that caused the door to slam shut when he did that or. .. Vic: It didn 't slam shut, it was one of the doors was closed ... DetO: Hmmmm Vic: ' ... and the other one was open and I think it was the sound of it. .. DPA: Rattling? Vic: Yeah. And, and then I was like upset. And you know, he instantly was sorry and then he stalted in kind of on me saying you know "you and you did that, you just lost your temper and you threw the mail at me." And I was like "I didn't throw the mail at you," you know, and then it became an argument over me throwing the mail and that's usually what tends to happen is that he'll focus in on something that I did and then I argue and try to defend myself, and I stop thinking about what. .. DetO: How far along were you in your pregnancy when that happened? Vic: I don 't, honestly, [don't know. I mean I was showing but maybe li ke ... (pause) ... maybe like 4 to 6 months? DetO: Did that hurt you when that happened? DPA: Were there any injuries or anything? Vic: I think, r don 't Imow. DetO : Did he like specifically (unintelligible) ... Vic: (Cross-talking) I think it more scared me DetO: ... with your back hitting the door or ... Vic: r mean yeah, it didn't feel good but um, r don't Imow, r feel like r have a high pain threshold so r guess asking me that is ... DP A: What did um ... Page 20 of 58 Case N umber: 15-1435 10 Name: BROWN, MOLLY Vic: (Cross-ta lking) fi ne. I'm fine yeah. It just- it just scared me and .. .(sigh) .. . it scared the boys. DPA: You said that the boys called their dad. Did thei r dad ever talk to you about what happened? Vic: / Yeah. And it's in the paperwork, in our custody thing. DPA: Okay. The "custody thing" between you and JUSTIN, your ex-husband? Vic: Right DPA: Okay. Vic: Well because when we moved back to Seattle, then JOSH wanted to move back to St. Louis ... DPA: He didn't want- he didn't want JOSH to take the boys away again? Is that what you are getting at? Vic: Yeah. DPA: Okay Vic: And you know, and he wanted to be in their life because they always, you know, they'd been with us for the last few years a nd ... DPA: When JOSH pushed you into the urn , the door in the office, was that in St. Louis 0 1' was that somewhere else? Vic: It was in DPA: It was in St. Louis. Did you call the police for that? Vic: No DPA: Alright. Vic: I didn' t tell anybody about that. DPA: Have there been ... Vic: ' Cause I was like newly married and newl y pregnant and I was like, I felt- I always fe lt like whenever anything happened to us, I always felt like, I was letting people down, if they knew that something was wrong. st. Louis. I have like .. " Page 21 of 58 Case Number: 15- 1435 10 Name : BROWN, M OLLY DPA: Okay. And I'm not- I'm not j udging M OLLY, I' mjust asking questions so I understand, okay? Vm, how many other times have things gotten physical between you and JOSH since this incident ah, in st. Louis w hen you were newly pregnant or newl y married and newly pregnant? Can you estimate it fo r me? Vic: (sigh) ... more than 10 DPA : 'Kay. Have there been any of those 10 times where there were physical injuries? Vic: Well yeah, I mean it was probably way more than 10 and I don't- there's things that happen that Ijust downplay or like, you know ifhe like grabbed my arm or something like that or he did- at first he did like a lot of blocking. Like I' d be in the closet or in the hallway and you know, he would be like " no" you know, "we're going to talk and" um .. . DetO: You mean like to refuse to let you to walk by him ... V ic: Yeah DetO: ... to get away from him ? Vic: ... and he'd like, you know, one time, I remember him like grabbing me in the kitchen, and it was at night, all the kids were as leep, it was dark. And he grabbed me by the ann in the kitchen ' cause he w as mad at me. I have no idea what we were arguing about and I pulled m y arm away and I said "you can't touch me!" I was like-because he--he knew that I, he knew that I would divorce somebody that was physical with me. Like and he knew like how sensitive I was w ith that and I remember pulling my arm away and I was like "you can't touch me! " And um, then I stood on the other side of the island and he reached across the island and then he grabbed like, my arm above my elbow and he pu lled like, really hard into the island. And my hip hit the island and um, like it-that hurt so bad and I had a bru ise there, 'cause it was granite. And I had reached out, even after that to like, to one of our mutual friends and a pastor at church, 'cause I was worried about hi s temper and that he had done that and .. .and they you know, I got responses back li ke " it takes 2 to tango" you know, " you need to like respect your husband," and "the bible says this," that kind of thing. And um, I would try to explain like you know, he's different behind c losed doors than he is um, in public and he just much more convincing I guess. And, you know, yeah, it definitel y grew progressively worse. Pretty much any time that I wou ld-I would avoid undermining him at all. I- I usually would give any answer that I thought that he wanted to hear and . .. DPA: To avoid an argument you mean? Vic: Yeah. And to avoid a fight and I know that was my fault in the beginning 'cause I d idn't want to fi ght. And so you know, um ... (sigh) .. . basically when at a certain point, we got a phone call from his family. Hi s sister was saying that she was go ing to commit suicide and you know, she had been drinking and taking a bunch of pills. And his other siblings, his Page 22 of 58 Case Number: 15-1435 10 Name: BROWN, MOLLY other brother and sister were there. And this is his adopted sister. And they were like talking and she said something to JOSH, she said "at least" you know, "at least" urn, "you don't lmow about what happened to me." Or "what dad did to me." And um, r had heard him like on the phone, I could hear it or say it and r just kept asking and kept asking like, "what was she talking about, did you ever find out what she was talking about?" And r kept pressing because like I had that deep sick feeling and urn. Finally, like 4 days later, he's like "I wasn't going to tell you but I'm gonna [sic]- I'll tell you," urn and he basically said that his sister said that for like years, his dad like molested her. And um, you know the-the family, like when I tried to confront them about it, they like denied it, they denied it, they said you know "oh well, she's always been a 'drama queen'" you lmow. And it made sense because his sister had been in and out of rehab so many times and tried to comm it suicide and I-I emai led the-his parents and his mom talked to me about it, even on emails. And he was so mad at me because he just- he's like "that was 30 years ago MOLLY, and you just keep trying to drudge this up" and you know, "you just need to let this go !" And I'm like "r don't want him around my chi ldren. He's never been rehabi li tated; your mom told me that. A preacher came to the house one time and he's ' saying that he 's washed in the ' blood of Jesus'. Like, I don't want him near my kids" and that's when I think- I can' t even remember what happened in that first argument when I really stood my ground. 'Cause I was like "I'm not going to expose my kids to that" you lmow. And his mom always wanted to babysit. And she's always working with children in . the church and like, she's you know, they wou ld come into town so JOSH and I could leave town and-and they'd be with the kids. And I had this little baby gi rl and I'm li ke "no" and you lmow, we started going to counseling about it and " .(sigh)". 'cause his temper was getting really, really, really bad about it um, just anytime that it would come up and he wou ld agree to things in counseli ng li ke boundary setting and things like that with his family and-and his dad ... (sigh). And then he wou ld completely go against it. And it was like at that point I felt like completely powerless .. . (sigh) .. . DetO: Were there any incidences where you talked about him being physical with you that resulted in the point that you felt like you needed to go get medical treatment? Vic: (sigh) ... um, over that? DetO: Were there any ... DPA: (ct, unint) Vic: (Cross-talking) I mean ... DetO: . . .were there any incidences .. . Vic: ... there was, yeah, I mean, I felt like .. .(sigh) ... you know, I-everything was a battle. Anytime that I had an opinion, anytime that r had a thought, anyti me that I had a feeling, anytime that I was hlilt because like, he- he didn't think of me or somebody made me sad or whatever. And you know, here I was goi ng to counseling and stuff and he . .. DetO: (ct, unint) counseling . .. Vic: ... but. . . DetO : .. .was he physically violent with you where you went to see a doctor? Because you physically hutt? Vic: Oh, I never ever would ever go . I wouldn't tell anybody. DPA: You never went to the emergency room or anything like that? Vic: No. I went to the emergency room one time and it was when he got t ut from the Rams and he had that morning, I came out of the bedroom and he was going to let me sleep in that day and help get the kids off to school and . .. 1 could hear him you know, tearing into KEMPER like "come on, oh my gosh! " like you know, "you're so lazy" like, "you should be mot e schedul ed and regimented" and like you know, on and on and on kind of thing. I came out and I'm like "can we do all of thi s without yelling?" Like- like, "I don' t understand why we are yelling" and he j ust turned and picked up like a j acket that was on the back of a chair. And it was li ke a zip-up hoodie kind of thing and he j ust- he had like that look on his face and li ke flexed his arms and he just came at me with the jacket and just started like hitting me, li ke over and over with the zipper end of it. I went from li ke the hallway all the way through the kitchen to the living room unti l he stopped. And I remember KEMPER screaming .. .(crying) .. .and he took off and ran down the street and JOSH's mom, she was there. DPA: KEMPER took off or JOSH took off? Vic: KEMPER. And JOSH 's mom was there. And she stood around behi nd the corner the entire time and .then came around the corner after and was like " is everything okay?" like-and . .. DetO: So he kind of continued to fo llow you clown the hall and around . .. Vic: We have like a big open kitchen and I was kind in this foyer desk, sort of butler/pantry area . And it was like from there all the way through like the main kitchen island area. All the way to the other side where there was li ke a wet-bar in the family room. It was just like he kept doing it over and over again and urn . .. DetO: But ifI understood right, you were trying to get away from him? Vic: (Cross-talking) We actually, I had to get into a car to find KEMPER. I had to go get ready, I had to go to work. Like I had- 1 had to go and like you know, look nice fo r work and- Page 24 of 58 Case Number: 15- 1435 10 Name: BROWN, MOLLY and you know, like one of my managers got food poisoning at a wedding so I had to go there, I couldn ' t stay home that d~y and . ..so Ijilst had to like put on that fake happy face and go . And . ..(sigh) ... like half way through the day I got a phone call from him, saying that the Rams drafted another kicker and he had been released. And so I told the girls at the store, "I need to leave, that they were running the show," and I came home and I knew like that morning was so awful. And I knew that like he was go ing to be really in a bad mood. And h is family is there, they don ' t ever do anything abont it. They always p retend thatthey don't hear or that they don' t see anything, that 's their M-O . And ah, so I just came right ... DPA: Vic: So hi s mom was there? .. .1 just tried to cheer him up you know, and boost him up. And he would just turn and scream at me, "you don't evenlmow what you're f-ing talking about!" Like "you don't even know nothing about this." He 's wrong, he's wrong. You know like, I was the one looking out for hi s best interest the whole entire time you know. And you know, he j ustwe had, we were go ing to like get a house ' cause at that time he was actually demand ing to move back to Washington, to make that home base. And we had signed the li ke 2 days before on this house, in Washington. And he urn, he 's like-it was suppose to fund that next Monday and we were basically we go ing to lose funding because it would say that he is unemployed. And so, I- we had like all of that going on and he's like, I was like " it' ll be fine though, you know, like they' ll- you ' ll get picked back up or we can you know, rearrange, restructure it so we can still get it." And he's like "no!" you know. "We aren 't gelting that house!" And so here I am like "oh my gosh, our house is for sale right now, we just signed on another house, like I've been pack- I' ve been packing tei move, I'm trying to run a store, my husband just lost his j ob." You lmow, he' s freaking out on me in front of the kids and he- the next morn ing I was like in my paj amas or bathrobe, making everyone breakfast and he came in and he was just in a bad mood. And we-we started argu ing and I looked at him and I was like "can we please take this into the bedroom?" And I said that maybe 4 or 5 times. And he just kept go ing, and the kids were just s itting there, looking and I had a cup of coffee in my hands and Ijust got so mad. And I was like-li ke you lmow, shook the cup of coffee and I was like "oh my gosh" like "why can't you just. .." you lmow? Instead of me walking away, I sat there like trying to co nvince him to go into the room and I remember being so frustrated and shaking that cup of coffee and he's like "oh my gosh, you're psycho! You' re psycho! You just tlu·ew hot coffee on your face !" And he called 9-1-1 on me, saying that his wife was going crazy and that um, I had thrown hot coffee on my face when I had had the cup of coffee for like 10 minutes from the Keurig machine, li ke I had, like it wasn't even hot! And it j ust spilled on the front of my shirt and I didn't know that he had called 9-1 -1. The kids were there, they saw what happened and they saw him like over-embellish everything and I went and got into the shower and I-when I came out, there were EMT's there and po li ce officers there, and they were going tlu·ough my .. ..drawers. Like looking to see if I was taking medicine. I said "I take medicine fo r ADD" and you lmow, they were like taking it in like Ziploc bags and they like, they made me go to the hospital, you know? 'Cause they told them that I was trying to kill myself. And I was going crazy and such b-s. And he's ad- he's Page 25 of 58 Case Number: 15-143510 Name: BROWN, MOLLY admitted, he has admitted to everyone, he admitted in his deposition that he- he did that to hurt me. And that.. . . DetO: Did they hold you for 72 hours? Vic: No DetO: Or did they release you right away? Vic: They released me after like 2 hours. DetO: Had you talked to the social worker ... Vic: Yeah ... DetO: ... when you were there? Vic: ... and a doctor and they were like "yeah, no, you're fine. You are under stress. Like you have a·lot of stress going on right now." And they were like you know "like maybe seeing a counselor right now would be a good idea, if you were into that kind of thing." And they let me go. I mean they asked me questions when I was in there like "have you ever" you know, like "hurt yourself or anything like that?" And I mean I was like very honest with them. I'm like "yeah, when we-there have been times when we were fighting where I would get so mad that I would like--like grab my hair or like you know, shake the cup of coffee or like, I- I threw the mail," you lmow? And like I. .. DetO: Butthose were ... Vic: .. .I threw a shoe at the wall or something like that. And then ... DetO: But it wasn't something that you were doing to harm yourself. You weren't looking to commit suicide ... Vic: No! DetO: ... or. .. Vic: No! I was not looking to commit suicide. I was like, when you are.like trying to "Scream at somebody like out of utter frustration and they are being so awful to you and you are just trying to like make them see. Like you are trying to like, I'm trying to make him see like this is ciear, like you know, like-and he, he just didn't understand it and I lmow now that I can't reason with somebody like, unreasonable. Like I lmow these things now but back then I didn't. I... DetO: So did JOSH tell the- the um, medical- were the police, did the police show up? Page 26 of 58 Case Number: 15- 14351 0 Name: BROWN, MOLLY Vic: Yeah DetO: Did he outwardly tell them that you were trying to kill yourself or hurt yourself that day? Vic: Yeah. Some-something along that lines, that I- I think that we have like the report and . all of that stuff on that. DetO : Did they suggest to you that you should go to the hospital or did they tell you that you had no choice and they were .. . Vic: V They were kind told me like that] had no choice, that they needed to take me. DetO : They were involuntarily send ing you? Vic: Yeah but I- I. . .I kind of wenI. ] don't remember, like it was a blur.] remember ] was humiliated. ] remember my kids were crying. ] remember his parents standing there, looking at me like J was a weirdo. J remember my neighbor standing out and watchi ng me have to get back into an aid car. Um ... DetO: And you said that he later adm itted to doing all of it. .. Vic: Yeah DetO : ... just to ... Vic: Yeah,] mean he- he full on said that "] did that to hurt her." He's like] thought it was crazy that you spilled coffee or whatever but- in the police report, he sa id that I "poured a pot of hot coffee on myself. " We don 't own a coffee pot. We own the little Keurig thing, you know, like that' s how much he, like he embellishes evelY thing that he says, you know. And ... DetO: And that is when you lived where? Vic: That was when] lived um , in St. Louis. And we were getting ready to move so- but he called off the sale of our house, gave me no input on it, other than purchasing our home in Washington. And ] had agreed like in my prior parenting plan, ] did like through mediation with my ex-husband that ... (s igh) . ..that we would agree that when the kids were 13 1, that you know, that if they really needed time with their dad that they co uld have that. And then it was rapidly approaching and I didn ' t want to split the boys up. JOSH's job could potentially start moving us around so we wanted to make a home base. And then he started telling me-so what happened when I was at the hosp ital, he called my exhusband and started telling him all this stuff. He bought plane tickets for my boys, to send them away to my ex-husband here, in Seattle. Page 27 of 58 Case Nlllnber: 15- 143510 Name: BROWN, MOLLY DetO: JOSH bought the t ickets? Vic: Hmm mm . And he stmied saying to my ex-husband how crazy I am and what I did andand saying, you lmow like, you lmow "I saw her like, get so mad that she like um, pulled her hair once and" you know. Like whatever he was saying and JUSTIN was like almost like chiming in like "oh, well yo·u should go online," he said, thi s is what he said, even JOSH told me that, "you shou ld go online, you should research the symptoms ofbi-polar disorder. And stali pointing them out to MOLLY." And um, it was like, they were like both patiicipating in this crazy making. And ... he- I. .. KOBE was dead, my oldest son was dead-seton going back to Washington so I let him get on the plane the next day. I felt so betrayed that JOSH did that without me, like those are my chi ldren and he was tell ing me that I couldn 't go and he' s send ing them away. And um then ... (sigh) .. .J stopped KEMPER from going. And um ... you lmow he, he wouldn 't-I was scared of him. I thought that he was going to you know, say that I was crazy again and have me like 0/ committed somewhere or something. And so I went and stayed in a hotel. Actually, I went to work and worked half of the day and then I-and then I went to a hotel that night because he refused to leave the house. And you know, then when I was at the hotel, he came and sweet-talked me and ended up spending the night there with me. And you know, like tried to soothe me and comfort me and make me feel like, "I lmow that it's been rough on you" like, it just, it was .. .you lmow, it was like he was you Imow, "I' m go ing to make everything okay" and ... yeah. DPA: MOLLY, were there any other times where he did something physically to you that had you get me~ical attention ? Vic: (sigh) .. .! had, I had never gotten medical attention but there' s been all sorts of things that happen and like um, you know, he kicked me um, with an office chair. Like actually was kind of running away from him because he was getting mad and coming towards me. And I went into the office in our house, where I was working that day and he ... DPA: MOLLY, hold on, hold on one second. Um, before you describe that incident to me, can you tell me where the office cha ir incident happened? Vic: That was in St. Loui s DPA: St. Louis, okay. And .. . Vic: So he ... DPA: Hold on one second, I' Hlet you get there. Um, ah what- can you give me sOli oflike a list of the types of things that he has done? Vic: .... he chased me iIi there and like I was standing up kind of near the computer and the chair was between us. And he took the- he kicked the chair like really hard . And the handle of the chair hit me in my thigh and I went in, it pushed me into the like the, shutters. We had like wood, plantation shutters in there and broke part of the shutters. And then he--the paper shredder was nearby and he pushed me over the back of the paper shredder. And it was like something that just clicked in his eyes and he like snapped out of it, like "oh my gosh, I'm so sorry. I'm so sorry. " And he was like scooping down like he was going to pick me up and Ijust remem ber like screaming and trying to kick and go backwards. And I ran into the bedroom and I curled up in a ball and urn. And I'm like "leave me alone, leave me alone! Like that is abusive, I'm going to call the police!" And urn, and he was like "no you 're not! No you're not!" and he ran and he got GEORGIA, and he got into the car and he left for like an hour. And I thought that he just took off with her. He came back and I wouldn't let him into the bathroom, I mean this has been a consistent theme. y DPA: Okay Vic: I wouldn't let him in the bath, he told me that he was calli ng everybody and telling them who I really was, that kind of stuff. And I have a picture of the bruise, if you want to see that. DPA: Urn, from where he kicked the chair and . .. Vic: Yeah DPA: ... it hit you in the leg or the hip or whatever? Vic: Yeah DPA: Ah, yeah we'd like to see that MOLLY, but I have to ask you this too. Why did you take a picture? Then that's- that's really what statted prompting the counseling was that. T hat they never really, they never really did a lot about it and I don't know if that was like the Midwest thing or . . .1 don 't know. It was taken in the mirror so ... OPA: Oh maybe that' s . .. V ic: . . .and then I don 't know, on camera phones, do they switch? OPA: Um? Vic: I don't remember if I was facing the desk or facing the- like we had a desk here and a desk here. I was here and there was an office chair here, paper shredder there, blinds here. And the chair came thi s way and his foot was attached to it the entire·time. It wasn' t like he just pushed it and it rolled into me, he like, used it to hurt me. And .. .(sigh) ... . Vic: Yeah, I-it was because I, we had a conversation that when the kids get home from school that they needed a little bit of downtime to decompress after school. And we, they you know they weren't going to have to do chores or anything like that, they could have their downtime and then they would get to homework and whatever, sports. And he just like went against 9n what we talked about and agreed upon, and he was on the front porch just harping on KEMPER, telling him how to sweep and that every day, he needed to come home and these were the chores that he was going to have to do. And I walked outside and I said "excuse me, can I talk to you for a second?" And he' s like "no you may not!" And I was like you know, "no, we need to talk." And ... he you know, he got mad 'cause I was like disrespecting him in front of the kids. DPA: So MOLLY, urn, in addition to him kicking the chair at you and then pushing you over the paper shredder, have there been any other physical incidents that resulted in any sort of injury? Vic: Urn, yeah. DPA: What kinds of things? Vic: Like urn, one time he-I was trying to help GEORGIA, um, when he was clipping her nails, he cut a little bit of her finger off and it started bleeding. And urn, you, know, he was like freaking out, couldn't handle it and so I like took her out of his arms. And I mean, she's my third child, like I know how to handle these things without freaking out. DPA: Yeah Vic: And you Imow, I was like trying to calm her down and take care of it and he, I had tumed my back to him and I was at the sink in the bathroom and he all of a sudden, just kicked .; me in my low back, as I'm like holding her and taking care of it. And my hips went fOlward and hit the ... counter. And my nanny and my best friend were in like 2 rooms down and I didn't even say anything to them. DPA: And urn, was this in St. Louis or somewhere else? Vic: This was in Orondo. It' s near Lake Chelan, Washington, we had a vacation home there. DPA: I'm sorry, you said your nanny and who else was there? Vic: Urn, my best friend SHAMRA [sic]. Yeah at the time, she now despises JOSH and doesn't understand why I am still with him. Because SH- I had opened up to her about a lot of the ..,/' abuse you lmow, and- and then she didn't understand why I was still with him. And then she's like "is it even real?" And I think that's kind of been the problem is that. .. DPA: Um, any other times where it's gotten physica l? Vic: 1 mean yeah. 1.. .you know like 1 mean, there's been times where like, we've been arguing and like a door you know, he' ll lock me out of the room and he' ll pull the door shut and my hand, like my fingers would get caught in the door. And urn ... DPA: 1 mean like stuff where you know ... Vic: . (Cross-talking) Well and like, yeah ... DPA: Like has he ever hi-has he ever punched you? Vic: Urn, no he doesn't ever do that. He says that he's going to, he grits his teeth, he gets like maybe like his nose press ing against mine and grits his teeth and holds his hands up. And tell s me things like he' s going to "lmock me out," that he's "going to fuck in' kill me," that he wants to-that 1 am an ungrateful "snatch." DPA: How many times has he threatened to hit you or punch you? Vic: (pause) ...1 don' t know. A lot. I mean probably consistently for . .. (sigh) .. .4 years, 3 years? DPA: How many times has threatened to kill you? Vic: 1 don't think that he me- means it, when he says it. 1 think he's just really mad. But 1 mean he's probably said that 4 or 5 times at least. Urn, like he does that a lot. He, he does that like "I'm going to fucking kill you" and he'll like or "I'm going to knock you out" or you know. And he' II like jump over the bed and come after me but then he just stands there you know like and he' s like, you Imow, you know "bitches like you are the reason why guys end up injail." And "bitches like you are the reason why women end up dead or knocked out or . .. " He wou- he urn ... DPA: And are you saying that you never took 'any ofthat seriously or .. . Vic: 1 finally did, in Hoboken. You know, actually 1 did it in Cliffton he said it to me because I didn't take it seriously until he had statted going through that program and ... He um, you know, to address the abusive behavior. It wasn't until he actually started admitting it and addressing the behavior that it like actually reinforced to me that it was wrong. And you know, 'cause he, I- like he didn't hit me but he's done so many things like um ... like last year and in our house that we live in, it was like last May, he you know came home drunk from a bachelor party and he- I- I was mad ' cause he um, he had drinks, like I could smell it on his breath and I didn't know why he drove home. Like I was kind of like "you could have called Uber" which you know, the guys get like discounts on asit is and I said "you could 've called a cab yoti Imow." It wasn't that big of deal like I didn't like make it a huge argument because I knew that he had been drinking and I wasn't going to like push it. And . ..then we started talking about something else that was- I told him about how my feelings were hurt. And he just, it was like, he jumped up on the bed, l ik~ we were both sitting in the bed, like with our backs against the headboard like looking at eachother and he like jumped up on the bed. And I just like kind of fl-1 flew out of the bed to get away from him . And he came towards me and 1 don't remember if, what palt of my body he grabbed, 1 don't remember anything. 1just remember like hitting the mirror that was behind me which was-it's a- it' s this huge mirror. And like it actually opens and you can keep like jewelry in it and it's like, it's huge. And um, and then 1 remember you know like being on the ground like towards the bathroom door and then somehow on- 1 think that I was trying to kick him away or someth ing and then he like laid on top of me on the carpet and like ... (sigh) ... like holding me down with his whole entire body weight. And I was face down and he-I was try ing to get him to let go of me and tell him that I could barely breath, and he was scream ing at me, holding my head like fac ing the carpet, saying that "I'm not even fucking on you! I'm not holding you down, you're fucking crazy!" you know, you know you have- and then he's li ke trying to tell me that like I was going nuts on him and, and that's why he had to like you know. Like he was doing like a take-down on me you know. Like . .. DetO: When you said he was holding your head down, how did he have his hands? Were like both hands around the back of your neck, pushing your face down or. .. Vic: It was like a forearm ... DetO : Across the back of your neck? Vic: Yeah, but my face was like that, so I couldn ' t move it that way. I couldn't move it that way and 1 couldn't, I cou ldn't move my body and couldn't get hands free, like nothing. DetO: How tall are you MOLLY? Vic: Urn I'm like 5 foot 3, almost 5 foot 4. DetO: And no woman likes this question .. . Vic: No, I was a lot skinnier 'cause I was really stressed. So J was probably like 98 to 100 pounds at the time . DetO: Okay. How tall is JOSH? Vic: He's 6-2 or 6-3, like 6-2 y,. DetO: How much does ... Vic: (Cross-talking) His stats say different things on it, so I'm never really measured him myself. DetO: The case report says 6-1 , 2.05 pounds. Vic: Yeah, it just depends you know. It-because some of his stats say 6-3, some of them you know ... (sniffing) .. .! don't know. I think he's, I don't know about how much he weighs right now. Like there's been times where he was 225 and then he'd cut weight and he'd get down to li ke 185 so, I don't even remember at that time how much he weighed. But he, you know, but that I- I didn 't call the police. What happened is that GEORGIA woke up and the boys weren't there, they were at their dads and GEORGIA woke and she came downstairs and she was standing in the doorway of the 'room. And that's when he got off of me, 'cause she started screaming and crying and saying "what's wrong with mommy, why was she screaming earlier" you know like. And I- he let go of me and [just like grabbed her and I ran upstairs and [ held her and tried to comfOlt her in bed. And .. . DetO: So let's, let's break this down again. Both of you were sitting in bed, with your backs against the headboard, kind of having this discussion of you being unhappy about him drinking and driving home ... Vic: Yeah. And then the transition into a different conversation ... DetO: Okay. And then somewhere in there you said that he jumped up on the bed, are we talking about him standing straight up on the bed, so he's standing on the bed? DetO: So, if I understood you right, everything kind of happens so fast that you don't qui te know how it happened .. . Vic: I was backing away. I was trying- backing away as I was being- l don't .. . DetO: But he jumped off the bed and came ... Vic: (Cross-talking) .. . know if.. .. DetO: . .. toware! you? Vic: Yeah, he jumped off the bed came toward me. I don't know ifhe threw me into it, I don't know if he held onto me and shoved me into it, like, at that point, I was so scared and I- I can remember screaming. I can remember like the- the next point like being, like right next to the min'or is like the doorway to our bathroom and- and there's, it goes tocarpet to marble. And I remember like hitting the marble on the floor and I can remember like trying to pick up like a hairbrush, like anything that I could grab you know. And, and trying to kick my feet to get him away and then I think somehow J got back onto the carpet and- because he put there and that' s like how ... DetO : So when you hit the mirror was it the back of your body, your head hitting the mirror, your back hitting the mirror, the front of your face ... Vic: Ith ink ... DetO: ' ... do ·you remember? Vic: .. . my elbow hit the mirror? And like the back of my head hit the mirror and like, 1 don't know if it was because I was like backing away and I, like it was-I had like a bad bruise -- and it hurt for. .. it hurt like for like 3 months, inside my elbow. DetO: Whi ch elbow? Vic: I think that it was my left elbow? I mean, and then ... I think th at like .. .l feel like even as I was go ing towards the mirror you know, like it j ust happened, like everything happened so fast but then.! mean, I can remember being on the, after, being on the marble fl oor. And I was only part way an it because it was ri ght near that door area so there was like a mirror and then it's on, it's hanging on the wall and that wall , there's a door right next to it that goes into the bathroom. And I- I can remember being like scared and screaming and trying to grab a brush. And I can remember what brush I tried to grab because I tried to like swing it to get him away from me. And urn . .. DetO: And you said that it broke the minor . .. Vic: (Cross-talking) ... and you know ... DetO : ... how did it break the mirror? Vic: It cracked DetO: I mean what was the actual. .. Vic: (Cross-talking) ... it cracked the mirror. Like I have a picture of it, because you know, I' ve tried to reach out to like to some other athl etes and stuff before and to try to get them to talk to him because I- I'm afraid of like the media screwing me. I' m afraid of my husband losing his job like l.. .(sigh) ... you know. And, and I was really let down in the past because they would listen to me and believe me but then their husband 's would tell them like "no" urn ... DetO : Okay Vic: ... "I believe JOSH. JOSH was our friend first" and you know, "I th ink that MOLLY is antagonizing him" 'or something along those lines. Like I tried to reach out for help and Page 36 of 58 ../ Case Number: 15-14351 0 Name: BROWN, MOLLY you know, that happened and so, .. then he, after he had written like that letter to everyone admitting like how he had been abusive and how he'd lied about me and-, and to ld them otherwise to make them not believe",(sniffing) .. , my story originally, when I was trying to you know, get help um , You know, they all came to me and they were like very apologetic / you know, My friend SARAH HASSELBECK, she was just like crying and holding me and .. ,(crying) .. ,and she's like one of the people that I trusted the most and-and MATI just didn't believe me, DPA: Are you talking about MATT' s wife? Vic: Yeah, I mean like we even went to like our neighbors, 'cause we all lived on the river together in Washington, and I even went to the neighbor's house with some of my friends who li ke tried to get me" ,is-I reached out to SARAH once, I reached out to her agai n but she was living in Nashville at the time and she said "you need to walk over to CHRIS and KATHERINE SPENCER's house" because CHRIS is like a gigantic like you know, like center and she's li ke "you just need to talk to them" you know, "They will help you, they will protect you" and" ,(sigh), ,.I had, I- I talked to them and they were like "we've noticed , We noticed how like you know, when we are here all on vacation time, how you' ll spend like an entire day in the room and you won't like come to dinner," you know, I- I suffer from chronic um, like neck pain and headaches and hand issues, And like, no one has ever been able to like, like really give me a diagnosis of it other than like tension or like you know, that kind of stuff, And so you know, I would like stay in bed with these headaches and not go outside, And cmus is like "I know what, I know what somebody who is being treated li ke that is li ke because I witnessed it as a kid growi ng up, " And they helped me write like this letter to him you lmow, stating what my boundaries were going to be and that's when I asked hi m to leave the house, and they totally backed me up unti l JOSH met with them, and told them like his story you know, his line of b-s, And then they like completely were like "how are you? I think you need to get help" that kind of thing, And they were like BFF's with JOSH, And", DPA: What' s this letter that you mentioned that JOSH wrote? Vic: (Cross-talking) But then after all of this, he has left-he, he wrote a letter and I, I have it in my email. I didn't, I didn't print it out um, But it was basically a letter to his friends like and my friends and anybody who he had lied to about me, saying that he lied, saying that he had abused me, saying that he suffered from you know, all sorts of things like you , "' , know, like sex addiction and um, and um, he was you know abused you know, between ,v the ages of 6 and 8 years old, DPA: When did he write this letter? He's admitted to people about the, the night with the mirror because he took my phone away from me and the home phone and, and locked himself in the bedroom and I was up with GEORGIA. I was not going to leave her. DetO: Why do you think that he took the phones? Vic: He did it because 1 said I was calling the police. Every time that I've ever said that "I'm going to ca ll the police" he takes the phone or I never did, back then. You know and on ly in the like the last year and a half have I gotten actually brave enough to pick up the phone. DPA : So how many times prior to a couple of days ago, have you called the police? Once because I had found that gun that was in our house, the 518 house ... DPA: Yeah Vic: .. .that we were um ... (sigh) ... that we were um selling and he was staying there atthe time because I wouldn't let him come back ... DPA: Where? Vic: ... to the apartment and urn, he left, he was like over at the river at the vacation house. The real estate agent called me and said that the house was a mess, that it looked like somebody had a patty there and so I went to go through it to make sure they didn't. And he just, he's so irresponsible, he left like the door unlocked and he had a gun on- in the case you know, but it was a little slide case on a shelf in there and it was loaded. And the door was unlocked so like somebody could've come in and stolen it. So I took the gun, brought it back to our house, I called the um- 'cause I-I talked to one of my friends who is a firefighter and they're like "call the Bellevue Police Department, they will come and put a lock on it for you." DPA: Okay so you called them to come put ah, basically to make the gun safe? Vic: Yes . DPA: Alright. Vic: Well, because I mean, he, he would be in that house with my daughter you know. And, and, and ... DPA: Oh I'm not. .. Vic: (Cross-talking) ... he has afreakin' loaded gun on the shelf in the closet! Like it, it, it just a nightmare waiting to happen. And I told him that he was talking like a crazy person and that I was not going to give him a gun. And he needed to bring GEORGIA back because that was the arrangement that we had and it was just you know, like a-we had agreed that's what we were going to do, it wasn ' t actually like in writing. And he took off with her, he drove off. And my mom was there too. Urn and ... (sniffing) ... he refused to bring her back, he kept saying that he, he needed his gun and stuff and back, that I stole it, whatever, that I took it from him . And all that I was trying to do was be responsible, like and not have it. .. DPA: When else, when else have you called the police? Vic: Urn ... DPA: ... let' s talk about the police ... Vic: ... and then, um I um, in New Jersey .. . DPA: Where in New Jersey? Vic: ... and it's called um, the er, the city is Cliffton ... DPA: Hmmmm Vic: ... and the apartment building is like a .. . executive you know, apartments, it's called "The Ave." DPA: Okay, what year was that? Vic: I thin1( it's 743 Pasaic [sic] Avenue, in remember correctly. That was ah, not last season but the season before so that's ... DPA: The 2013-2014 season? Vic: Yeah. So 2013. DPA: 'Kay. And- 'cause JOSH had um, he had gotten so mad that he head-butted and punched the wall when he was yelling at me. And he had like blood was dripping down his face. But I called, I didn'!-I think, the first time I called the police was because he came after me and he's like "I'm gonna [sic] fuckin' knock you V out." And r had to like rlln away from him. DPA: Okay Vic: We actually had urn- because of that we had urn the people that who we were renting the apartment from, email us and trying to like blackmail us ... OPA: Yeah? Vic: ... about it, to get like tickets and field passes and so we had to give it- they said that they were go ing to go to the media and so we had to hand it over to the Giants attorneys. OPA: Right Vic: So they were fully aware about it and they you know, basically did what they needed to do to make the guy go away. OPA: Did you ever call the police in St. Louis? Vic: No OPA: Any other places in Washington besides um, Kirldand or Bellevue, a few days ago? Vic: Well no, I can 't remember. The problem is every time that I've gone to call the police or if I have, he's taken my phone and hung it up or taken it away from me. And like he's even picked my phone up and hucked it, like across the street like 2 houses. OetO : And during those kind of incidences, had-had you vocali zed him "that's it, I'm calling the cops," so he ... Vic: (Cross-talking) Yeah or he would . .. He's always tried to isolate me from my phone like even in Hoboken and like he, he, he' d hang up on the 9-1 -1 operators. He' d be like "you are so crazy, da-da-da," or he' d take the phone from me and when I was trying to call and he would like open up the door of the apartment and throw it down the hall then push me out and then lock the door. V m.. . DPA: So there have been other times that you wanted to call the po lice or tried to call the police and weren't able to because the phone was not available to you? Is that fa ir? Vic: Yes DPA: Okay. Vi c: Yeah because there's, I mean there's mul- there's so many times that he' s told me you know, "I'm not go ing to jail for you or for anyone." Vm ... DPA: Besides um, anything that he may have said to someone in counseling or um, this letter, this email that was sent to a bunch of your friends in common ... Vic: Hmmmm DPA: ... um, has he ever put on paper or email or in a text message or anything like that um, what he's done or that he's sorry or anything like that? Vi c: I mean, I think so, yeah. DPA: Do you have any of that stuff still ? Vic: That' s kind of what I was trying to ... DPA: (Cross-talking) That you brought with you? Vic: ... go through today. DPA: Okay Vic: Well 1. ..(sigh) . . .r was trying to go back through emails and text messages and the problem is that I' ve had like 4 phones in this time span. And ... Vic: ... there's a lot of weird stuff in there. DPA: I-las JOSH tried to contact you since he was atTested? Vic: Um . .. DPA: And I mean JOSH personally? Vic: No DPA: Okay. He called that night, I got voicemai1s on my phone. DPA: Okay Vic: Um, you know and then he's like "I'll keep you posted" you know, "on what's going on.". I mean I was worried and I, I wanted to make sure that like, you know, he wasn't getting into like jail fights. I mean ... DPA: Did you want JOSH to be arrested by the way? Vic: No. I did- I didn't because Ijust wanted him to leave the house because he was scaring me and I knew that his temper was- I knew that his temper was not dying down and it was just a bad decision to let him come back, because I had him out of the house for since the beginning of February because he had just flown off the handle at KOBE for slamming a door in KOBE's bathroom. And he kicked the door in and like it, KOBE got out of the . way thank God, or else he would have gone through like the plate glass, the shower, that was behind him. But it hit you know, KOBE's arm as it was coming open. Like he didn't even try to open the door at all, he just kicked it through and ... DPA: Who was,. sorry ... Vic: .. .my parents were there but my dad was in the shower in the other room. We have a big house and he was in the shower in the other room. And my mom um, had just woken up and she wears hearing aids, she can't hear and so she couldn't hear it. She couldn 't hear an e lephant if it was in the next room. DPA: So who besides PETE MERAND has called you since JOSH has been arrested? Vic: Um, SCOTT WHI'fEB DPA: And who is SCOTT WHITES? Vic: I guess that he is an attorney and I think that he is the one that does the deals for like PETE, he does a lot of that business side of it. But I actually believe that SCOTT is licensed as like an agent as well, but he's not JOSH's agent. And I was li!ce "well I've been better," and I j ust let him talk. 'Cause I didn ' t know what to say to him. I had never had a phone conversation with him in my life. You know, I've met hi m one time in passing and um, you know, he- he's like "well the good thing is that the repOlt is pretty flimsy so," you know, "I, I bet on the prosecuting side, they' ll drop it and it' ll get thrown out." And he's like "but you know, have you thought about what you are doing?" And I was like "what, what do you mean 'what I am doing'?" And he's like "well " you know, he--I think he basically was like "you- you're going to pursue this or you lmow, "press charges," and I was like "I don 't even know how to answer that question," like I was still trying to digest everything that went down in the last couple of days. And I said "SCOTT, are you representing JOSH?" And he sa id "yes, I am." And then I said "then I think that you need ca ll my attorney." And I text messaged him my attorney's info. And then he contacted me again the next day, leaving a message talking about JOSH' s wedding ri ng because J had asked PETE and CHRlS BLACK, if he wanted . his wedding ring back? You know, like in those 2 days, I was extremely emotional. I was like all I want is my husband next to me. I' m blubbering and crying in bed and you know ... and I was like "does he want hi s ring back ?" and um nobody responded to me. And then finally that SCOTT guy did and then I told him that I texted him, saying that I you know, d o Search and Rescue on Tuesday nights and that i, I could like bring it to him, or meet him in Kirkland, where we leave from and um. And then he asked me to come by Hectors and I didn't have enough time. So I told him that I didn' t have enough time and then I got a text message that same night, like an hour and half later from DANIELLA BLACK, which is CHRIS BLACK's wife, saying that- I have, I have them all right here. I don' t Imow why I am trying just to do it off my memory, so ... DetO: Who is the one that said that the police rep Olt was pretty fl imsy? Who told you that one? Vic: SCOTT WHITES DetO: Did ... Vic: PETE said that to me at one point too and then PETE's like "man, we just got get him out of jail," like "we got get him out of jail" and urn. He's like you know "so are you go ing to come to COUlt?" Like Friday night, you Imow, yeah. He's like "so are you go ing to come to COUlt tomorrow 'cause his hearing is at noon." And I was like "I don' t think that I' m even allowed to. And I'm not going to go. And I was like "I didn ' t want him arrested but he's, he's like continued to do thi s stuff and I didn 't know what he was going to do." You know I didn't .,-/ think that him grabbing my wrist and was even something that was urn, somebody could get into trouble for. Um [just thought that is very nOlmal occurrence between us. Like fo r him to like grab me or but the way that he came at me, the fact that what had happened the night before, the fact that he, you know, that he came at me in a very phys ical way and it took li ke me screaming to get him to let go, I was scared. And you know, I'm sick of being scared. And ... DetO : Did they give you any indication how that they knew what the police rep0l1 said? Vic : 1...(sigh) ... I don' t know. Maybe they were saying because they were there? No, I mean that is me assuming so I guess I can't you know, answer that but he um . .. PETE was there. PETE said that hewas there you know, he's like "oh" you know, "he came out and he had handcuffs on and he's like," you know "this" you know "whatever jumpsuit and shacldes on his ankles and." He's like " it was horrible" and-he's like "it was horrible man. He's been like through hell and back in there MOLLY, you just got get him out of there." You know, he' s like ... DPA : Why didn 't he get him out of there? Vic: ... well that was afterwards, after the fact. PETE did get him out, PETE posted his ba il and um ... DetO: Did you feel like that they were pressuring you to .. . Vic: Oh yeah ! I mean ... DPA: To what? Vic: To, to, like ... DPA : Post his bailor to ... Vic: No DPA: ... drop the charges? Vic: .. _to yeah, to make sure I let everybody know that it wasn't a big deal and that I yo u know, I overreacted. You know, I- I definitely think they're trying to make me fee l that way and I you know, I think they're like .. .PETE said to me, he's like "man we've j ust got get him out of there," you know, "ROB ROSCH is calling me" and ROB is his agent that is in New Jersey. And I remember getting rea lly offended. I was like " really, that is his top priority?" Like I was- that actually angered me and I was like of course it is, it's his job, it's all that he cares about, you know, I mean that triggered me like, andand then PETE kept like backing down, like "butter" me up kind of you know? PETE is kind of like a peacemaker in way, li ke youlmow but, he' s ... you know ... OPA: How many t imes did he call you? Vic: PETE called me, I don't Imow, I'd have to look tlu'ough my call log. I mean more than 3 times and I call, I ca lled PETE several times because he would be li ke "okay I' ll call you right back in 5 minutes." Or "I' ll call you back in an hour and I' ll let you know what's going on." And um, it wasn't iike he was ever trying to say that JOSH told me to tell you this or I was trying to tell him to tell JOSH anythi ng at all. I actually know better than that and um, and he um, you know, he would just not call me back and I would text him and be like, you Imow li ke "I'm sick to my stomach right now, like what's going on? Is JO SH okay," and then he' d be li ke "there was a fight in the jail or something and it went on lockdown and he couldn't like get out." It was 6 at night, it was like 3 in the morning when they released him or something. I don't know, I. .. and then urn, YOll know, like CHRIS BLACK came by the hOllse. He came by the house at one point and li ke, to pick up like JOSH's bag, his suitcase and his backpack .. . OPA: For hi s trip to New York? Vic: Yeah. Because he you know, that's- he needed to get it to leave I guess. He just wanted his stuff when he got out of jail. OPA: He has a place in New York I'm guessing, where like an apartment or a house or something for. .. Vic: Like an apartment right now. It's the Giants that put them up like ... OPA: Oh, they put the players up? Vic: ... until training camp. OPA: I see Vic: Like for OTA's and workouts if you have a roommate, it's free and . .. Vic: Like "I know that JOSH is trying over and over again and you guys have been trying but you guys fight like cats and dogs." And um, and you know, you know "enough is enough. " But these are the same guys that I' ve reached out to when JOSH has freaked out when he kicked in KOBE's door, when he has done. things. And they know. But some reason they / " you Imow, they're always pushing blame back on me. Or, I'm not- I don ' t know, I'm assuming that but. .. DPA: Alright Vic: ... and you-you know, now that I'm thinking back, DANIELLA was like "I want to be there for you" you' know, it was on Saturday night. She's like "I really want to be there for you, you know, I just, I want to take care of you ." She kept like insisting that she come over. And I'm like "it's like 9 o'clock at night now. Ijust want to go to bed. " DPA: How did she know? Vic: DANIELLA? DPA: Yeah Vic: Well um, CI-IRIS, her husband. DPA: How did they know that, that the police came and JOSH got arrested? Vic: Because PETE had called CHRIS um, when he was like trying to like get JOSH out of jail because PETE lives in West Seattle and he didn't want to um, he didn ' t want to ... (sigh) ... um, have to drive all the way to Wood inville to pick up the bag. So he's like "I've called CHRIS BLACK"- I might have that on vo icemail, I don't know. And then um you lmow, I think initially I reached out to like right after it happened, JOSH' S- this guy that like JOSH prays with, it's like an accountahility partner in all of that and I was just like, his name is ERNEST and I- I Facebooked messaged him because I doli't even have his number and I was like "look you Imow, this is what just happened. " Like you know "please pray for JOSH." And he 's like "well hopefully like, JOSH is finally hit his rock bottom here and you lmow, this- this will bring him you lmow, to where he needs to be," urn ... Either on Friday or Saturday or Sunday, it' s all a blm. Honestly, it was the worse emotional roller coaster in my life. My friend JESSICA and her husband JUSTIN, they came over that night and brought me dinner and brought like the kids dirmer and they sat with me, they didn't want me to be alone. And then they actually brought GEORGIA back with them to her house, to have a sleep-over with ZEKE, 'cause that is her friend, it was totally distracting her and just was excited. She didn't even know that dad was gone ... DPA: Right Vic: ... so I thought that was a good idea ... (sigh) DPA: KEMPER and KOBE know, right? Vic: Yes. KOBE knows um, KEMPER does know but they, they knew that something was wrong because there were so many police cars out in front of our house and urn, kids were driving by and texting them, asking them what was going on. DPA: Right Vic: And I had reached out to KOBE that day um, for KOBE to maybe go hang out with a friend instead of coming home £i·om school. .. DPA:Right Vic: ... ' cause JOSH was in a bad mood. DPA: The police report or the no contact order? Vic: I had or the no contact order or I had no idea, and I was like "okay" and he's like "yeah, I'll just, I'll keep you in the loop. " And um, then he you lmow, I was "so what does the no contact order mean? Like I can't, I can't call JOSH, he can't call me, he can't come here? Like does that mean GEORGIA too?" You lmow, I was asking him that and he was like "well it' s a no contact order for JOSH, so you can-you can contact JOSH." You lmow and I said "well what ifIjust want to like to send like a, a video message of GEORGIA to JOSH, just saying 'hi dad, love you,' whatever?" And, and he's like "oh yeah, yeah, that's totally fine ." But then after I got off the phone, 1 talked to my attorney right away and he's like "no!" He's li ke "you are being baited" and I'm like "1 don't know" you know. And so instead of like send ing JOSH um a picture message of GEORGIA, 1 sent one to CHRIS BLACK and I wrote "hopefully this will make his day better." It's a person who perceivers toward a long-term goal without anything deterring it from failure. A person with vision and knows how to go about doing the job at hand. A father should have grit, but he should also und erstand the definition. I did this all without love and that makes it scary and hard to understand. I feel like I put to much pressure on yo u to make big decision that you should have never been apart of. The day I asked you if you wanted to go live with your dad and you said yes. I blamed your mom for her behavior when I really should have b.een looking in the mirror at how I was treating her and hurting her. That alone caused her to· wig out and loose her head that day. Per the contract I have with my counselor and also Molly, I need to set the record straight. I have been a liar for most of my life. It was how I dealt with deeper struggles in my soul. I hid behind the veil of my parents religion and from the outside, everything looked perfect. I, like my family was a secret keeper who had been taught to never talk about or deal with emotional pains. Nothing was a big deal and when your feelings are hurt; well , you should just get over it. This way of coping with negative feelings tends to pile up and makes you impossible to deal with and very selfish, I was a professional conman. I was molested as a young boy (around 6) and it went on for several months. It was a by a neighborhood teenager. I never knew it was wrong because sex was never talked about in my parents home, it was a sin, one of the things you just don't do. So , obviously I never talked about it; Molly was the first to know .. 1never let my heart open to really loving people, or letting them truly love me. I grew to have an addiction to porn and to sex. After Molly and I were first married , we learned that was a child was a victim of (I do not know the molester and actually number of children , has only confessed to 1) This caused major problems in mymarriage and I did nothing to offer protection to them from my family at that point. It deeply damaged the relationships I had with my family when I finally stood up to them last February. I no longer speak to anyone in my family and they are not allowed to contact me. This decision was not hard after stepping back and seeing the chaos that has ensued over 30 years from just not telling the truth. I made selfish decisions to use and abuse women starting at the age' of 7 to feel this void. I objectified woman and never really worried about the pain and hurt I caused them. I never knew the real pain I was causing myself. I thought sex was how you expressed love and also how you received it. My ability to connect emotionally to other people was zero; my empathy levels were zero. Up until about 10 months ago, I didn't even know the definition of the word empathy. Because I never handled these underlying issues, I became an abuser and hurt Molly physically, . emotionally and verbally. I viewed myself as God basically arid she was my slave. I carried an overwhelming sense of entitlement because I put money higher than God and I used it as power tool. Thank God for Molly who filed for divorce in January and gave me the ultimatum of getting help or losing my dream of a happy marriage and family. Had she not had the courage to kick me out and put her foot down I don't know where I would be. I have worked intently on facing my demons and coming clean about who I am, and all the chaos I have caused. We are working to rebuild our marriage and all the trust that has been lost. Through this process I had to write a full disclosure letter, stating all the people I had sex with while dating Molly. It was hard to even remember the names and when these interactions took place. In the end, I totaled 12 different women during our dating period that I lied about and kept from her. Needless to say this devastated Molly and we are working through it. I know this email contains a lot and may even shake you up a bit about me and if'you can even stay friends with me.
