Upon review of Code (marked scout car), the vehicle is equipped with video/audio, but the MCI en was not captured because the incident occurred inside the location. The crew also utilized Code (raid van), which is not equipped with video/audio. Patton? knocked on door, All four (4) casings were recovered and placed on evidence: 1- spent 12 gauge shell casing on 1602040258003, 1- Spent 12 gauge shell casing on 1- spent 12 gauge shell casing on and 1- spent 40 cal speer casing on 1602040258006. Also recovered and con?scated from this location was four (4) baggies of suspected crack cocaine on 1602040258001 (0.4 grams crack cocaine with a street value of $160.00), multiple packaging baggies on 1602040258002, and con?scated $341.00 in US Currency on 1602040258007. Crisnet report 15 01160341 was completed by Of?cer- regarding this incident. This incident was not captured on video. as Of?cer was in vehicle code 026606.which is not equipped with audio _or video. Additionally this incident took place inside B371 Faust. This investigation revealed Of?cer was being charged by a pit bull and believing he would be bit discharged a department issued shotgun at the charging pit bull. The shots aimed at the pit bull took effect. i ?nd Mr. statements corroborated that several shots were ?red inside the me, although he did not see what occurred. Once on the scene Of?cerHand Of?cer-observed a large, brown Pit Bull dog on the lawn a ove location. Of?cer while still in the vehicle, observed Ms. of In the doorway. Of?cer inquired if the dog belonged to her. Ms. because she did not want the dog anymore. Of?ce air for a Do Stick. 8-12, manned via Of?cer and Of?cer badge operating co that the had one and could assist upon completion of their Police Run. Of?cer nd Of?cer xited the vehicle and bserved the dog attempting to enter the residence at the front door. Madefused to open the door to allow the dog entry. Of?cer then observed several children approaching on the west side of the street walking northbound from their location. Of?cer observed the dog look in the direction of the kids and began to growl and diSplay its' teeth. Of?ce bserved the dog exit the porch and be an approaching the direction of the children, barking ferociously. Of?cer gave verbal commands for the children to get back. Of?cer observed the dc_>_g_t_o charge at the direction of the children, fearing ort safety of the children, Of?cer Fun-holstered his department issued handgun, observing-that he ad a clear backdrop [free of bystanders] discharged three (3) rounds in a downward?angle; The dog immediately?changed directions and ?ed eastbound from the location, unknown from there. i arrived on the scene and observed 8 -12, manned via Officer badge .and Of?cer badge operating arrive on the scene. I was briefed by Officer and Officer occurrence of events. Of?cerHadvise me that he fired shots from his department issued an gun, not knowing if any of the rounds took effect. Of?ce?infomed me that the dog ?ed east from their location after the ots were Ired. reviewed the video and audio from their scout car, code I observed the video/audio to be operational the video marked at 15:38:22 is observed with the vehicle parked to the curb. The camera did not capture any visual of the shooting or the dog, due to the parking of the vehicle. At 15:40:23 the audio is heard of the of?cers speaking with the owner of the dog, with nothing germane to this incident after this segment. Of?ce directed me to the point of impact of his rounds, observed no blood. I observed two 2 shell casing from a 40 caliber handgun laying in the mu ere Of?cer ?stated he discharged his weapon. i ordered Of?cer?to recover the casing and to place them on evidence. I observed no collateral damage to any structure or vehicle. Page 3 spoke with Ms.- who is the owner of the dog, who stated she allowed the dog to roam freely, because she did not want ownershi of the dog and was hoping that the dog would run away. i advised Ms. of the protocol for ownership of a dog. I then ordered Of?ce to issue Ms. 3 citation for the offense. Noti?cations i noti?ed th following: Noti?cation/Control- Sergeant-and C.I.B Police Of?ceri Canvass/Witness - Chapel-Ms. states she observed the dog running toward the children, who were across the street. She then observed Of?cer ?re approximately two (2) shots at the dog as the dog was leaving the ra rea from in front of her residence. Chapel- Mr. states she heard several shots and observed nothing fu er. Chapel?Ms. 0 served nothing. Chapel?Mr. states she heard several shots but Phone states he 0 the dog chasing people earlier this date, then the police arrived. Mr. estates he observed the dog on the lawn, then the children started running across the street and the of?cer ed several shots at the dog as the dog started to chase the children. The vehicie was parked north of the incident, facing north, displaying no activity with the interaction of the dog. The microphones were activated. I inspected Of?cer handgun on scene: DPD Smith/Wesson caliber, serial number '?cation date August 28, 2014, inspection date February 14, 2015. Of?cer recovered (2) spent casings placing them on evidence tag 539774?1 and 539774-2. We were unable to locate the third casing during our search. Of?cer- completed crisne ort number 1503140226 and issued citation number U225-841-15 to Ms or failing to properly secure her dog.
