The bottom line 15 Lead exposure occurs with no obvious 16 symptoms and disproportionately effects low 17 income and minority children. 18 are exposed to lead are at risk of damage to 19 the brain and the nervous system, slowed 20 growth and development which, of course, 21 impacts their academic achievement, learning 22 and behavioral problems and hearing and 23 speech problems. 24 Children who To this end in 2010, my office worked STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 7 1 leadership on the issue of lead poisoning 2 and how we can ensure the safety of our 3 families, it would be yourself Councilwoman 4 Brown because you've led on this issue 5 before it was -- before Flint, before 6 Newark, before a lot of the consciousness 7 around what happens when we neglect 8 infrastructure on such a level really came 9 to the forefront that it did. 10 I do want to point out for my colleagues 11 and for the audience out there that in 12 January, a national publication published a 13 headline asking the question, if Philly is 14 worse than Flint in terms of water testing 15 and safety procedures. 16 Reynolds Brown, myself and Councilwoman 17 Cindy Bass really took this on as a very 18 serious issue. 19 Councilwoman We held a number hearings on it. And 20 last week or yesterday introduced a package 21 of bills that really tackled the issue of 22 testing, expanded testing in ensuring that 23 children, especially in our daycare, in our 24 childcare centers in our schools and in STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 8 1 their homes whether rented or owned will be 2 assured that we do expansive testing and 3 understanding of lead levels in water. 4 in part due to that, that same publication 5 came out yesterday with the headline that 6 said Philly -- this bill -- these set of 7 proposals could put Philadelphia at the 8 forefront in the nation in terms of water 9 testing efforts. 10 And And what we're trying to say is, we're 11 not going to solve a 50 year old problem 12 like lead poisoning overnight. 13 reinvigorating attention to this issue. 14 are dedicating ourselves to try to do better 15 about expansive testing, about understanding 16 what the impact is. 17 action in the best ways that we can. I am Dr. Caroline Johnson. 15 I'm the Acting Deputy Commissioner for the 16 Philadelphia Department of Public Health. 17 And thank you very much for the opportunity 18 to present testimony today on Resolution No. 19 160281, authorizing the Legislative 20 Oversight Committee to conduct public 21 hearings to examine the Executive branches 22 enforcement of Bill No. 10011-A Lead Paint 23 Disclosure Law. 24 Protecting children from exposure to STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 10 1 lead is important to lifelong good health as 2 was just mentioned by the Councilwoman. 3 effects of lead exposure cannot be 4 corrected. 5 and Prevention have determined that while 6 there is no safe level of lead, that 7 children under age six who have blood levels 8 of 5 to 9 micrograms per deciliter should be 9 targeted for primary prevention. The The Centers for Disease Control And 10 children with blood lead levels of above 10 11 should receive education, inspection and 12 home remediation services which is done by 13 the Health Department's Lead and Healthy 14 Homes Program. 15 Fortunately, the percentage of children 16 with elevated blood lead levels in 17 Philadelphia has been declining and 18 continues to decline. 19 tested for lead between the ages of zero and 20 5 years, the proportion with a level of 10 21 or above has declined from 12 percent in 22 2004 to 1.2 percent in 2015. 23 children in Philadelphia continue to be 24 exposed to lead. Although, lead With approximately one quarter of 10 Philadelphia's young children thought to be 11 living in rental properties, the Lead Paint 12 Disclosure Law was intended to prevent lead 13 exposure by requiring landlords to identify 14 and mitigate lead risks such as pealing 15 paint in those properties where children 16 under six years of age live. 17 In brief, the law states that a leaser 18 should not enter into a lease agreement 19 unless he or she provides the tenant and the 20 Health Department with a valid certification 21 stating that the property is lead free or 22 lead safe, and that the lessee acknowledges 23 receipt of the certificate by signing a 24 copy. STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 12 1 However, enforcement of this law is 2 difficult given the fact that the landlords 3 are -- that many landlords are not licensed. 4 And among those licensed, it is not known in 5 which units children reside. 6 approximate 80,000 licensed rental 7 properties in Philadelphia, the Health 8 Department has received 1600 lead free or 9 lead safe certificates to date. Of the We suspect 10 that this number vastly underestimates the 11 number of rental properties in which young 12 children live and tat there is a lot more 13 work we can do. 14 Recent attention to the issue of 15 childhood lead poisoning has prompted the 16 Health Department's new leadership to take a 17 hard long look at what we can do better to 18 protect Philadelphia's children. 19 do we want to better serve children who we 20 find have elevated lead levels, we also want 21 to initiate actions that will prevent 22 exposure in the first place. 23 enforcement of the Lead Paint Disclosure Law 24 will help serve that purpose. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 13 1 Programs have already been in set -- 2 programs have already been set in motion 3 that will coordinate with the Department of 4 L&I to modify the rental application license 5 to better capture information about lead 6 risks and the property. 7 certificates are required but not provided, 8 L&I will not renew the rental license. 9 We've also developed programs to inform If lead 10 landlords of the responsibility to comply 11 with the Lead Paint Disclosure Law by 12 providing information through the mail and 13 in association with the licensing process. 14 We are just about to launch a public 15 information and advertising campaign to 16 advise renters who are parents of young 17 children of their right to a lead safe 18 environment. 19 whom they can call for assistance if they 20 have not been provided with a lead safe 21 certificate by their landlord. 22 should be launching next week in public 23 venues. 24 Families are instructed as to This program We also are planning to identify STREHLOW & ASSOCIATES, INC. Do 11 you believe the Health Commissioner might 12 entertain a letter signed by both he and I 13 to the municipal court system registering 14 exactly what you have recommended here, 15 asking the courts to have a role in this 16 process when it comes to identifying 17 landlords who may not be in compliance? 18 DR. JOHNSON: I think he would be very 19 eager to do that. 20 that we need to enforced this law. 21 He's in full agreement COUNCILWOMAN REYNOLDS BROWN: Okay. And 22 one more. I guess it might be helpful to 23 hear from L&I, for them to speak to what 24 more they can do with regards to identifying STREHLOW & ASSOCIATES, INC. You care to restate for the record what 3 you believe a possible remedy might be 4 towards that end? 5 6 7 8 9 DR. JOHNSON: Me as the Health Department? COUNCILWOMAN REYNOLDS BROWN: Yes. Yes. Yes. DR. JOHNSON: So, we met with L&I. And 10 one of the plans is on the application, the 11 license application, it is going to be edit 12 that it will specifically state that the 13 home was built before or after 1978 because 14 the risk is in homes that were built before 15 '78. 16 COUNCILWOMAN REYNOLDS BROWN: 17 DR. JOHNSON: Absolutely. It will specifically ask 18 whether there is an intent to have children 19 who are less than six years of age reside in 20 the house, and then it will ask specifically 21 whether the lead certification, the lead 22 inspection and certification being lead free 23 has been obtained. 24 current plan is that they will not approve And I believe the STREHLOW & ASSOCIATES, INC. DR. JOHNSON: Well, that is still in the 6 works. 7 to make sure they can actually implement 8 this. 9 I think they are reviewing the form But I don't have a timeline for that. COUNCILWOMAN REYNOLDS BROWN: Okay. 10 That is to suggest then that there is an 11 intentional effort between L&I and the 12 Department of Health to work as partners 13 until that particular item is fully 14 addressed? 15 DR. JOHNSON: 16 COUNCILWOMAN REYNOLDS BROWN: 17 then. That is correct. Okay, Thank you. 18 Thank you, Mr. Chair. 19 COUNCILMAN JOHNSON: Want to also 20 acknowledge the presence of Councilwoman 21 Cherelle Parker. 22 Councilwoman Gym. 23 COUNCILWOMAN GYM: 24 So one of my questions is to have a Hi. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 18 1 little bit of better understanding about the 2 Health Department's role around the approach 3 to enforcement currently. 4 And could you clarify to me again, your 5 role is to be presented with a valid 6 certification; is that right? 7 they are twofold. 8 identified as being lead poisoned, then you 9 as a Health Department will enter into that 10 I believe if a child is child's primary residence? 11 DR. JOHNSON: 12 COUNCILWOMAN GYM: 13 14 And also, Correct. And check for lead paint? DR. JOHNSON: Correct. So, it really is 15 sort of two ways. 16 have an elevated lead level and the actions 17 we take. 18 who are not elevated or have not yet been 19 tested yet. 20 There is the children who And then there are the children And so to talk about the children with 21 an elevated lead level, they are the 22 programmatically what we've been targeting 23 for the last 20 years. 24 all of the lead levels that are obtained on We get reports on STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 19 1 children in Philadelphia. 2 certain level, then we enact our response 3 program. 4 the Lead and Healthy Homes Program goes into 5 the home, conducts an inspection, both 6 visually and actual physical test to 7 determine if there is lead in that 8 household. 9 likely that there is lead in the household. 10 So when we do these inspections, we 11 virtually always find lead in the home. 12 at that point if it's a rental property, we 13 contact -- we work with the person who is 14 renting the property as well as the landlord 15 to say this lead has to be removed from this 16 house. 17 and sometimes they don't. 18 willingly deal with the lead in the house, 19 then we take them to court. 20 If they reach a And our response program is that And it's 99 percent or more And And sometimes they do it willingly If they do not And there is something known as the Lead 21 Court. We have had a least a dozen years in 22 Philadelphia where we pursue these landlords 23 and try to get these homes fixed. 24 the landlord will not fix them, then we fix And if STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 20 1 them ourselves and try to collect the cost 2 from the landlord. 3 4 5 6 7 COUNCILWOMAN GYM: This is on behalf of the Health Department? DR. JOHNSON: This is all the Health Department doing all of this, correct. COUNCILWOMAN GYM: Given that, can you 8 just walk me through a couple of questions 9 that I had. 10 DR. JOHNSON: Yup. 11 COUNCILWOMAN GYM: If a child tests 12 positive for lead in, say, a rental 13 property, do you then check to see whether 14 the landlord has filed a disclosure 15 certification? 16 DR. JOHNSON: That's correct. And we 17 checked -- I looked for at the 2015 data. 18 We had 92 children who were in rental 19 properties who were lead poisoned. 20 2 of the 92 had submitted a lead 21 certificate. 22 99 percent or whatever that 90 of 92, 23 whatever that comes to, is the percent that 24 are not complying with the law. And only So, we had evidence that STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 21 1 2 3 COUNCILWOMAN GYM: the law. Not complying with I think that helps a little bit. How many violations would you say have 4 been issued annually since this procedure 5 went into effect, I assume, in 2012; is that 6 right? 7 8 9 10 DR. JOHNSON: The law was passed in 2012. COUNCILWOMAN GYM: DR. JOHNSON: 2011, December 2011. There was a one year 11 before it was enforced. 12 penalized anyone for not providing us a 13 certificate unless the child has been lead 14 poisoned, in which case they go to court. 15 So, we have not We do not necessarily know in which 16 house a child under six is living. So 17 that's why we focus -- been focusing on 18 children with the elevated lead levels 19 because they are the ones reported to us 20 with their home address. 21 whether they have a lead certificate. 22 if there is no test or no information that a 23 child is living in a residence, we don't 24 know that the lead certificate is missing. And we can look up But STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 22 1 COUNCILWOMAN GYM: So, is it fair to 2 assume that the 1600 properties that you 3 name that as being lead free are 1600/1596 4 properties are ones in which you have 5 certificates in hand? 6 DR. JOHNSON: 7 COUNCILWOMAN GYM: Yes. 8 of the certificates? 9 DR. JOHNSON: Yes. You know this because And those were the 10 landlords who proactively did this. 11 were not ones that we went after as a 12 penalty. 13 were the good landlords who took this 14 seriously and went out and did what they 15 needed to do. 16 They They were -- let's just say those COUNCILWOMAN GYM: But the 99 percent of 17 children who are actually been lead poisoned 18 live with or in rental properties with 19 landlords that have neglected to follow the 20 law? 21 DR. JOHNSON: 22 COUNCILWOMAN GYM: 23 24 That is our suspicion. Based on what we know? DR. JOHNSON: Based on what we know. STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 23 1 COUNCILWOMAN GYM: And would you say the 2 92 children, I mean, are those the ones that 3 you are counting in terms of how many 4 violations have been issued over the last -- 5 DR. JOHNSON: 6 COUNCILWOMAN GYM: 7 DR. JOHNSON: 8 COUNCILWOMAN GYM: 9 10 11 12 13 14 Yes. Yes. Okay. And violations are based on after a child has been poisoned actually? DR. JOHNSON: At this point, that is correct. COUNCILWOMAN GYM: Not proactively before? 15 DR. JOHNSON: 16 COUNCILWOMAN GYM: 17 -- several years? That is correct. So, there could be more? 18 DR. JOHNSON: Oh, yes. 19 COUNCILWOMAN GYM: And have you 20 collected any fines or what kind of fines 21 have you been able to collect? 22 23 24 DR. And she knows a fair 6 amount about the Lead Court and the 7 enforcement of actions for children that 8 have been lead poisoned. 9 COUNCILWOMAN GYM: And I think it s a 10 procedure to say that we still have to ask 11 you to introduce yourself, state your name 12 and your title for the record. 13 14 15 COUNCILMAN JOHNSON: For the record, yes. MS. SMITH: My name is Paulette Smith. 16 I'm the Program Administrator, Lead and 17 Healthy Homes Program. 18 19 COUNCILWOMAN GYM: many violations have been issued? 20 MS. SMITH: 21 COUNCILWOMAN GYM: 22 23 24 The question was, how Any time -Since the law went into effect. MS. SMITH: Any time a case goes in front of a judge for a child who has an STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 25 1 elevation and we know that the property does 2 not have the lead safe or lead free 3 certificate, it is brought to the attention 4 of the judge. 5 consideration for each individual case. 6 And the judge takes this into COUNCILWOMAN GYM: Okay. And I have a 7 few more questions, but I would like to come 8 back after my colleagues go. 9 to take up all the time. 10 I don't want I think one of my central issues when I 11 come back to ask you about is, you know, I 12 think our goal and the actual challenge is 13 going to be how we can somehow get to 14 children before they are actually poisoned 15 here. 16 given the neglect on behalf of so many 17 landlords in which they are inept. And that's a major issue especially 18 I will come back. 19 COUNCILMAN JOHNSON: 20 21 Councilman Derek Green. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 26 1 process in reference to the lead paint issue 2 as impacted people in the City of 3 Philadelphia. 4 Councilwoman Tasco was a co-chair, excuse 5 me, cosponsor of the initial legislation. 6 And was also long time chair of Public 7 Health and Human Services and spent a 8 significant amount of time on addressing the 9 issue of lead paint and the impact of 10 children in the City of Philadelphia. As many people know, 11 In looking -- Dr. Johnson, in looking at 12 your testimony, you talk about approximately 13 80,000 license rental properties in the City 14 of Philadelphia. 15 Department's received about 1600 lead free 16 or lead safe certifications to date. 17 However in your testimony, you state how 18 this vastly underestimates the number of 19 rental properties in which young children 20 live. 21 you talked about a marketing campaign in 22 reference to trying to inform parents, 23 caregivers and providers regarding the 24 impact of lead paint. And the Health And toward the end of your testimony And I think from my STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 27 1 perspective, my concern is that historically 2 issues like lead paint, we have short bursts 3 of information and communication, but we 4 don't have a sustained type of marketing 5 program or information program to let 6 parents know about the impacts of lead 7 paint, especially considering that the City 8 of Philadelphia has a very old housing 9 stock. 10 So, what steps have you taken -- I 11 believe your marketing campaign goes through 12 August. 13 work with some of the organizations that 14 been involved in this issue over the years 15 like a HAPCO or TURN to continue that 16 process of community engagement, and not 17 just for that short marketing period? 18 But what steps have you taken to DR. I think informing parents, 20 especially new parents about lead and lead 21 risks is an ongoing responsibility. 22 you know, our current plan that we are 23 considering is that we will work with every 24 family for whom we have a birth certificate. I mean, I've been -- you 18 somewhat read my mind because I am currently 19 working with the Philadelphia Autism Project 20 in reference to early intervention. 21 of our outreach, we are looking at 22 peer-to-peer type of initiative with 23 physicians, especially primary care 24 physicians for those first wellness visits As part STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 30 1 to let parents know about the issue of 2 autism and the early warning signs. 3 think because of the issue with Flint, 4 Michigan and the hearings that have been 5 held in Council and the heightened awareness 6 that people have in reference to lead, 7 letting people know, yes, lead is still an 8 issue. 9 it's not just lead paint but also the fact 10 that, you know, because we do have such an 11 old infrastructure, we have people that have 12 the lead types that come into their homes. 13 And that the water may be okay, but it's the 14 means the water is coming into your home 15 through a piping system that may have lead 16 in it that causes some additional problems. And I And maybe even in your information, 17 So, I think maybe considering that in 18 your marketing campaign in reference to lead 19 not just lead paint, but also in reference 20 to -- 21 DR. JOHNSON: The lead pipe. 22 COUNCILMAN GREEN: -- the laterals that 23 you have coming to your home may also be an 24 issue that can contribute to the lead issue STREHLOW & ASSOCIATES, INC. JOHNSON: I agree completely. Thank you. COUNCILMAN JOHNSON: COUNCILWOMAN GYM: Councilwoman Gym. Two very quick questions. One, if -- if you are a low income 13 resident who wants lead testing for the 14 home, either renter or homeowner occupied, 15 are there opportunities to do free or 16 reduced price lead testing? 17 DR. JOHNSON: Are you talking about lead 18 testing in the home or lead testing of the 19 child? 20 21 22 23 24 COUNCILWOMAN GYM: Lead testing in the home. DR. JOHNSON: Lead testing in the home. So -COUNCILWOMAN GYM: I am trying to get to STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 32 1 2 children before they are poisoned. DR. JOHNSON: So, the department has 3 capacity to actually do the lead testing 4 that use this XRF gun I believe that it's 5 called. 6 something and determine whether there's lead 7 there. 8 that it's certainly within our capacity to 9 do it. And we go in and they zap it or And they do wipe tests. So, I think And I don't see any reason that we 10 couldn't accommodate specific requests if 11 people need us to go into the home and test 12 for lead. 13 COUNCILWOMAN GYM: So one of the other 14 questions I have is if a child is tested for 15 being lead poisoned or having elevated lead 16 levels which I just call lead poisoning in a 17 rental property, would you consider 18 appropriate to send a note to all tenants of 19 that property that this property has been 20 identified in at least one location to have 21 had, you know, been in violation of the Lead 22 Paint Disclosure Law, we recommend that you 23 test? 24 And you know, how -- is that -- has that STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 33 1 been explored at all? 2 the landlord in particular is one of the 3 those 99 percent that is in clear violation 4 of lead certification and has not remediated 5 that property, has not provided disclosure, 6 is it possible that at least for those 7 families and those households, that that is 8 something that we can at least proactively 9 due? 10 DR. JOHNSON: I mean, especially if I can say right now if 11 there are other residents within the same 12 unit, then the Lead Program will make sure 13 that they are tested and the prevention and 14 education is given to the whole family. 15 anyone within the household is dealt with. 16 Your question I think is more about if 17 18 So there are two apartments -COUNCILWOMAN GYM: The building. The 19 landlord is in violation of the entire 20 certificate of the building, right, so the 21 building -- I assume that the lead 22 certification and program requires that the 23 building be done? 24 DR. That 12 would be helpful statistic to know. The charter schools 8 were another 60,000. So the total number of 9 students, and I'm no expert on this. I am 10 taking it off the School District's website, 11 192,000 students would appear to be in the 12 City of Philadelphia. 13 from age 5 to 18, again using numbers -- I'm 14 not a statistician, that's the number -- is 15 13 years. 16 of the students in Philadelphia schools, you 17 divide 192,000 students by 13 classes of 18 students age 5 to 18, it would seem 19 mathematically that there are 14,000 and 20 some students of each age; 14,000 five year 21 olds; 14,000 six year olds. 22 And if school ranges If you take the 13 different ages So now we are looking to know how many 23 children in this City are aged six and 24 under. If you take that number of 14,779 STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 41 1 and you multiply by six, so we will see that 2 there are potentially 80,000 students -- not 3 students -- 80,000 children in the City of 4 Philadelphia who are age six and under. 5 And 40 percent of them live in rental 6 units; 60 percent perhaps live in 7 owner-occupied properties. 8 indicate that the 40 percent of the 80,000 9 children who are subject to the law is So, this would 10 35,000 children. I'm not in any way saying 6 Now, HAPCO upon receipt of this 7 resolution that was introduced, we have 8 already commenced the recharge notification 9 program to our property owners in our 10 newsletter, on our website, our educational 11 programs, our communications with property 12 owners. 13 here listening to Dr. Johnson's testimony 14 and reading Mr. Lord's testimony, 15 Mr. Gould's testimony, I'm contemplating -- 16 not contemplating now. And I will tell you that sitting I'm going to do it. 17 I sat here and I read the re-read the 18 penalty provisions of this law, which I have 19 a hand in writing. 20 are powerful and shocking. 21 let our property owners know that there are 22 such severe penalties already within the law 23 for owners who don't comply that we -- we're 24 the landlords. SPEAR: We didn't bring it up at 14 this point. 15 And I guess, get our coalition which 16 consists of all the apartment owners to see 17 if they want to bring it up in Harrisburg. 18 We are bringing it up here. I'm 19 the Executive Director of the Tenant Union 20 Representative Network. 21 George Gould from Community Legal Services 22 who is going to help answer questions. he's 23 been working on this for a long time. 24 all know him very well. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 61 1 Charlene Nuding and Kim Nuding who are 2 tenants who have been part of this problem. 3 They did not get lead safe certificate when 4 they moved in. 5 Schavers who are also here to answer 6 questions. 7 it wasn't filed with the Health Department. 8 You have a sense of the complexity of the 9 situation here. 10 And Kim Chester and Desi They did get a certificate, but I'm really pleased to be here with HAPCO 11 with Darrell, Harvey Spear supporting this 12 bill because I think that's very, very 13 important. 14 the problem is money. 15 to get a fund together that would enable 16 landlords to be able -- if there's a way to 17 provide a fund to landlords to be able to 18 remediate properties, that would be crucial 19 to this process. 20 for people to do voluntarily. 21 And I agree with them fully that And if there's a way It is just too expensive And right now, to be honest with you, we 22 have a voluntary program. ZASLOW: 13 No one officially No. 10 12 Well -- No. -- before you get this license? MR. ZASLOW: No. The landlord has to state that he or she did or did not comply. COUNCILMAN JOHNSON: Most landlords are 16 not going to volunteer that information if 17 they didn't do it. 18 MR. ZASLOW: Well, they are not going to 19 get their license then because now you can't 20 get the license without checking either yes 21 or no. 22 COUNCILMAN JOHNSON: What I'm saying is 23 if no one -- I don't really believe in 24 somebody is going to voluntarily tell the STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 65 1 truth, just being up front with you, 2 especially in that type of business. 3 Because your goal is to try and make a 4 profit. 5 actually do and actually check and do a real 6 inspection, right, then you will probably 7 check yes on the block. 8 on the box and just move forward. 9 And if nobody is coming out to MR. ZASLOW: 9 To go on the -- It's perjury, Councilman. 10 COUNCILMAN JOHNSON: 11 MR. ZASLOW: 12 13 I just want -- Buy a license and lie about it -COUNCILMAN JOHNSON: I wanted to be 14 clear on that part. 15 there is no type of enforcement at all. 16 MR. LORD: You just mentioned There is no enforcement. And 17 incongruity there because the license is one 18 thing. 19 only been a few months, it's not like we're 20 talk about history here. First of all, this requirement has 21 COUNCILMAN JOHNSON: 22 MR. LORD: Okay. Okay. And the license can be once a 23 year. LORD: Wow. Actually in 3 1972, I sued HUD and PHA so that they 4 wouldn't sell properties and PHA wouldn't 5 rent properties unless they were in 6 compliance with the City Health Code. 7 One of the things I want to mention, and 8 first is I want to thank the committee for 9 doing this. It's extremely important. This 10 bill is very important to the safety of 11 children in the City of Philadelphia. 12 especially, I want to thank you for being 13 the leader in getting this bill introduced. 14 COUNCILWOMAN REYNOLDS BROWN: 15 MR. GOULD: And Yes. Unfortunately, the bill has 16 not done what it's supposed to do for a 17 variety of reasons. 18 bill is so important is that in 19 Philadelphia, the way we determine whether 20 or not there is lead in the property doesn't 21 necessarily happen until a child gets 22 poisoned. One of the reasons this 23 COUNCILWOMAN REYNOLDS BROWN: 24 MR. GOULD: Right. They then go to a doctor. STREHLOW & ASSOCIATES, INC. (215) 504-4622 The legislative Oversight Committee June 10, 2016 Page 71 1 The doctor then sends to the Health 2 Department the fact that a kid is poisoned. 3 And the Health Department goes out and 4 inspects the property. 5 this law is it is now preventative. 6 does is supposedly prevent a child from 7 going into the property unless the property 8 is lead safe. The importance of What it 9 I think enforcement is critical. 10 are substantial fines as Darrell Zaslow 11 mentioned that can be imposed upon landlords 12 who do not comply. 13 Health Department and L&I went after some 14 landlords and posed substantial fines, I 15 think there could be a real turnaround in 16 the City. 17 There And I think if the The fine is $2,000 a day for every day 18 that the violation has been in existence. 19 So, it's really important that this 20 ordinance work. 21 Zaslow mentioned were somewhat interesting, 22 but I think there still are a substantial 23 number of children who are moving into 24 properties, and they are -- the parents are The numbers that Darrell STREHLOW & ASSOCIATES, INC.
