On 06/24/2016 at 2208 we, Squad 632 (B. Ficoadenti/K9 Falco), went to 1891 7th Street to assist East squads with a fight. The caller stated that there was a large group fighting in the area with weapons and one of the males had a handgun and that he had the handgun in his hand. The caller described the male with the gun as a black male with dreadlocks wearing a white t-?shirt. I arrived in the area and drove eastbound on 7th passin31871 7th Street. As I drove by the address observed a large group scatter and run towards the front of the 1871 building. 1 observed some run inside the front door and others run around the side of the building on the west side towards the rear. 1 then continued eastbound on 7th to Hazel. lthen turned northbound Hazel and then westbound into the alley behind the 1800 block apartments. While doing this I did not observe anyone in the group matching the description given by the calier as the suspect with the gun. I continued westbound through the ailey driving my fully marked St. Paul Police canine unit squad car. As I approached the rear lot of 1871 7th I observed a row of cars parked on the west side of the lot. i shined my spot light on the row of cars and observed a male sitting in the driver's seat of a 2004 Jeep Liberty, tan in color, with MN plates 867 LAV. This vehicle was parked closest to the apartment building on the south side of the lot making it the furthest car away from me. The male was later verbally identified as FRANK ARNAL BAKER (DOB: 10/31/1963, 1871 7th Street #201 St. Paul, MN 55119). BAKER was a black male with dreadlocks and appeared to be talking on a cell phone. When my spot light hit BAKER he leaned forward and was then able to see that BAKER was wearing a white t-shirt. At this time believed BAKER to be the male the caller was referring to as the male with the gun in his hand as he fit the description in every way that was described. BAKER stepped out of the car very slowly and put one hand up. BAKER then looked directly at me and Falco. Falco was cleariy barking loudly and focused on BAKER. I observed BAKER shift his head towards me, then towards the dog, then back towards me several times. BAKER then stood outside the driver's side of his vehicle doing nothing as if he was thinking. BAKER was now standing between his vehicle and another vehicle next to his. Due to the way i was positioned and the way BAKER was standing at this time i was only able to see BAKER from the middle of his chest area and up. I yelled at BAKER to put his hands up. BAKER would put one hand up then put one down. While doing this he was shifting back and forth towards his vehicle and the vehicle to his left that he was standing next to. Because of this I was unable to determine if he had anything in his hands or if he was reaching for anything. i yelled at BAKER several times to put his hands up and he still did not comply. i then ordered BAKER to walk out towards me several times so i would then be able to see if he had anything in his hands. BAKER continued to hesitate and refused to walk out towards me. i then considered the following facts known to me at this time: 1. BAKER was a suspect who matched the description of a male who was supposed to have a gun. 2. BAKER was refusing to comply with my directives to show me his hands. 3. it was unknown why BAKER was not responding or willing to walk out from behind the vehicle. 4. BAKER was an immediate threat due to his actions and needed to be controlled as quickly as possibie. 5. Based on my previous experience people who do not comply even when a police dog is actively barking and targeting them are considering either fleeing or contemplating some type of assault. 6. it was necessary for the safety of myself and anyone else around that Falco be the first to make contact with BAKER in order to eliminate any chance of him using a weapon on a police officer. 7. The initial confrontation with BAKER was approximateiy 10 seconds long. The decision to use Falco so quickly was necessary in an attempt to control BAKER in order to eliminate a possible lethal force encounter which this situation was quickly turning in to if BAKER was given any more time to ignore any further directions. 8. it was my belief at that moment that BAKER was about to pull a firearm on me. i also considered these additional factors: 1. lwas not in a position to use a baton or ASR (mace) on BAKER. 2. do not carry a laser and even if i had one available to me i was out of the effective range. Based on the above listed factors I released Falco and ordered him to apprehend BAKER. Falco ran up and apprehended BAKER in the lower right leg as BAKER fell to the ground. Once on the ground continually ordered BAKER to put his hands behind his back and he still did not comply. BAKER was still reaching around and turning from his back to his side several times. With the assistance of other squads BAKER was finally taken into custody and placed in handcuffs. Once he was handcuffed removed Falco from the bite. BAKER and his vehicle were then searchedand no handgun was located. BAKER was then run enchannel five and came back with a gross misdemeanor warrant for crime against the administration of justice out of SP727450267A38 .. Once in custody BAKER began to state that he was having trouble breathing. He was taken to a squad car and monitored until St. Paul Medic #9 (Run #20652) arrived on scene. While waiting for medics BAKER asked for some water and stated that he had some in his vehicle. I then went to his vehicle and grabbed a fast food cup and straw that was in the cup holder near the center console. gave the water to BAKER and waited with him until medics arrived. BAKER was then transported to Regions for further evaluation and treatment. Before i left the scene I collected shoes off the ground and brought them with me to Regions to give to him. Once at Regions Squad 369 (Spencer/Dick) arrived and took photographs of his injuries. Sgt. Murphy (Squad 308) also arrived to interview BAKER. Regions staff advised me that BAKER would be admitted due to his injuries. We were responding from the East District Offices at 722 Payne Ave. As we were driving EIB on 7th St. I heard K-9 Officer B. Ficoadenti #632 respond to Dispatch that he was en route as a back-up of?cer. i also heard #379. Ofc. B. Palkowitsch and Ofc. B. Nowicki respond that they were also en route to the call as a back-up squad. At 2211 hrs. monitored radio traffic from SPPD Dispatch advising there was now a group of 13 people outside the address, a black male with dreads. last seen wearing a white t?shirt had a gun in his hand. This area is familiar to East Side Officers. We have dealt with numerous calls for police service in the 1800 block of East 7th St. These calls include but are not limited to aggravated assaults. shootings, aggravated robberies, gang related incidents. weapons offenses, narcotics offenses, and drive-by shootings. have made narcotics related arrests in the parking lots of the buildings in this block and know much of the drug activity takes place in the parking lots behind the buildings. As we approached the area we noted there were numerous people outside of each building in the 1800 block of 7th St. We did not observe anyone that appeared to match the physical description of the suspect that had been aired by Dispatch. As we turned left onto NIB Hazel St. we did not observe anyone in front of 1891 E. 7th St. or in the parking lot to the north of the building. Ofc. J. Dick advised Dispatch and assisting squads we were not seeing anything at or around 1891 E. 7th St. We made another left and drove WIB through the alley behind the apartment buildings in the 1800 block of E. 7th St. As we drove through the alley Ofc. J. Dick told me that he could see someone in a Jeep that was parked on the south end of the parking lot behind 1871 E. 7th St. We continued through the alley and circled back to the alley via EIB 7th St. and NIB Hazel St. As we pulled back into the alley to drive we monitored radio traffic from #632 - Ofc. B. Ficcadenti, that he had one in a vehicle in the parking lot. I looked down the alley to the west and observed Ofc. B. Ficcadenti's squad car positioned behind 1871 E. 7th St. i could hear Ofc. B. Ficcadenti loudly giving verbal orders and could hear another person that sounded like a male yelling back at him. As we approached the parking lot to assist Ofc. B. Ficcadenti 1 observed his K-9 partner engaging an adult black male with dreads, wearing a white t-shirt and blue jeans. The male was between two parked vehicles on the south end of the parking lot behind 1871 E. 7th St. One of the vehicles the male was standing near was the Jeep we had observed someone in just moments prior. The vehicle, MN license 667LAV, was a 2004 Jeep Liberty, tan, four door SUV. 1 exited my squad and ran to the area the K-9 was engaging the suspect. Ofc. B. Ficcadenti was there and giving, loud, clear verbal commands to the suspect. My attention was then drawn to the 1871 E. 7th St. apartment building. There were numerous people yelling loudly at police from windows and attempting to come out the back door to the parking lot area. I could still hear an active on-going situation behind me and could tell of?cers did not yet have the suspect in custody and it was not yet a controlled situation. i gave numerous verbal commands to occupants of the apartment building to stay in the building and not to come out. observed numerous people with cell phones raised and directed at of?cers. 1 could hear Ofc. Nowicki and Ofc. Raether dealing with someone who apparently had attempted to approach the arrest location from the west side of the building and was attempting to hide behind a bush. was concerned with the people in the building that appeared to be very hostile towards police and the nature of the call we were investigating. On north side of 7th St from St to Hazel St are apartment buildings that look similar in appearance (brick buildings). As we are were multiple people standing in front of some of the apartment he windows down on our squad car, and none of were holding bats, golf clubs, or We app Van were getting closer to 1891 7th St E, th buildings. We lit up the people with our spot lights. We hadt the people appeared to be alarmed, arguing, or ?ghting. None of the people guns. When we got to 1891 71h St E, there was no one standing at the front, sides, or rear of the building. We turned north on Hazel St from 7th St and turned west into the alley behind 1891 7th St E. There was no one standing in the rear parking iot of 1891 7th St E. We continued to drive west bound in the alley and checked the itting in a Jeep in the south west corner of the parking lots of the apartment buildings. saw a biack male 3 e, and it appeared he was sitting in the driver's seat parking lot of 1871 7th St E. i could only see the male?s fee of the Jeep. i told Officer Spencer I saw the male in the vehicle, and we continued to drive west bound in the alley. Several other squads, 379 (Officers B. Palkowitsch and B. Nowioki), 386 (Officer J. Raether), and Squad 632 (K9 Officer B. Ficcadenti) arrived on scene and were checking the area. It should be noted while we were on scene, we never located the original caller/complainant. I then heard Officer had a male sitting a vehicle behind 1871 7th St E. We drove into the west adenti and his K9 partner out of the squad car. As we pulied up and stopped, I saw the K9 running towards a black male standing between several vehicles in the south west corner of the parking lot behind 1871 7th St E. This male was later positive-1y identified via website photograph as BAKER, FRANK, ARNAL, DOB 10/31/1963, 1891 7th St #201. The vehicle was a tan 2004 Jeep Liberty with MN plate sermv. We drove back to 7th St E, Ficcadenti say on the radio bound, and i saw Officer Ficc ad what appeared to be dreadlock style hair. i saw the K9 bite did hear Officer Ficcadenti giving BAKER commands to get on the vehicle. Officer Ficcadenti continued to give BAKER his hands out. BAKER was on his stomach with his hands BAKER would not stop moving around on the ground and the male, and he handcuffed the mate. BAKER was wearing a white T?shirt and BAKER, as I got out of our squad car. I co ground. The K9 had pulled BAKER away from the commands, telling him to lay on the ground and put out to his sides, then he turned and began to sit up. he was yelling. I went to the Jeep Liberty with Of?cer Spencer. I went to the front passenger door of the Jeep and looked passenger seat i saw a black backpack. a sail phone, and inside, as the window was rolled down. On the front what appeared to be a partiatty smoked marijuana blunt. I then searched the front passenger area of the Jeep. I did not locate anything else of importance. Officer Spencer photographed the Jeep, and the front interior area. I rolled up the windows of the vehicle, took the key out of the ignition and left it inside. I looked the vehicle's doors, and closed the doors. I rode in the ambulance with BAKER and SPFD Medics #24 to Regions Hospital, per request of SPFD Medics. During the ride to Regions Heepital, BAKER was complaining he could not breathe, said his ribs hurt, and said his right leg was painful. We arrived at Regions Hospital and once inside a room, a nurse requested that handcuff BAKER to the hospital bed. i removed the handcuff from his right wrist, and attached it to the metal bar of the bed, while his left wrist remained handcuffed. The call comments stated that approximately 13 people were fighting in the front of the address with bats, gotf clubs, and one had a gun. As we were still enroute to the call. comments updated saying the male that had the gun was a black male with dreads wearing a white shirt and the gun was iast seen in his hand. As we arrived on scene. we observed a group of 6-7 people run into 1871 7th St using the front door of the apartment complex. Due to the nature of the call and seeing people run into a building upon our arrival, I drew my department issued firearm and kept it at a low ready position. Two people remained outside in front of 1871 7th St and we asked them who was fighting and they claimed they knew nothing about a tight. We then observed 3 people sitting out front of the building directly to the east of of their building but refused to speak to us further about 1871 7th St. They stated no one was fighting in front the incident. We continued to move east on 7th St towards 1891 7th St in an attempt to locate people involved in the incident. it should be noted that since 4/1/16, SPPD has been called 42 times to the apartments between 18714891 7th St E. Those calls include a shooting on 6/13/16, where a male was shot in the chin, several casings were recovered, as well as 3 firearms from an apartment in 1871 7th St. Throughout my career with the SPPD, this area has historically been known for criminal gang activity, egg assault and weapons calls, and narcotics activity. I personally have responded to severai shooting scenes in that immediate area. SP72745C267A33 Saint Paul Police Department 4 SUPPLEMENTAL OFFENSE I inst-EM Complaint Number Reference Date and Time of Report 16126703 06/24/2016 23: 10:00 Pn'mary offense: OBSTRUCTING-OBSTRUCTING LEGAL PROCESS We were near 1891 7th St, when we heard squad 632 (K9 Officer Ficcadenti) check out over the air with a male in the rear of 1871 7th St. Of?cer Ficcadenti advised dispatch he located a male matching the description of the male that was supposed to have a gun. Since we were outside on foot. we could immediately hear Officer Ficcadenti yelling to the west of our location. We began running westbound in the alley to assist him. As we were running. I could hear Officer Ficcadenti yelling and his K9 partner barking. We located Officer Ficcadenti in the rear of 1871 7th St. Officer Ficcadenti?s K9 was attempting to apprehend a male in the parking lot. Officer Ficcadenti was loudly and clearly giving commands to the male. That male was later identified as FRANK ARNALL BAKER (DOB: 10/31/1963). As BAKER was on the ground, Officer Ficcadenti continuously ordered BAKER to stay face down on the ground and put his hands out to his side in a proned. but BAKER continued to roll around while moving his hands all around. Due to the recent calls to the area, the information given in the call comments for this incident, and the male not complying with Of?cer Ficcadenti even after his K9 partner apprehended him, 1 fully believed this male was armed with a firearm. advised Of?cer Ficcadenti i would handcuff BAKER when he advised me to do so. i bolstered my firearm and removed my handcuffs from my duty belt so that we could detain BAKER. Every time Officer Ficcadenti in handcuffs, BAKER would move his hands attempted to retrieve his K9 partner so that I could secure BAKER closer towards his body and out of the position he was ordered to leave them in. BAKER was also rolling around and turning his body over so he was on his back instead of face down as he was ordered. it should also be noted that people from the apartment building were attempting to come out the back door into the parking lot area. This was the address, observed the grow run into upon our arrival and we had not recovered any weapons at this point so i began to fear that we were in a unsafe situation if people from that apartment building came into the parking lot with weapons. Again 1 fully believed that BAKER was armed with a firearm and i wanted this now progressively evolving use of force encounter on a gun call to and as fast as possible for the safety at the scene. BAKER continued moving around and stopped complying with Of?cer iccadenti?s commands so I delivered two kicks with my right foot to the side of BAKER's midsection area. it should be noted that i was not able to target below BAKER's waist because I did not want to risk striking the K9 or risk being bit by the K9. i did not want to target BAKER's upper body because he continued to move around and i did not want to accidentally strike him in the head or face area. After the second kick. loudly ordered BAKER to stay down on the ground and put his hands out. I then reassessed the situation, hoping that my strikes were effective enough to get BAKER to comply with my commands and remain in a proned position so that i could handcuff him and end this encounter.
