A review of the extensive consumer complaints ?led with the California Public Utilities Commission (CPUC) which lacks jurisdiction to resolve complaints against non-regulated entities reveals many of these companies have engaged in false and misleading acts in the marketing and sale or lease of solar panels, in apparent violation of California?s Unfair Competition Law, Cal. Bus. Prof. Code 17200. Factual Background In response to a public information request submitted by the CPUC released a redacted summary of the 125 consumer complaints it had received from 2012 through the present pertaining to the sale or leasing of solar panels and their installation on the roofs of customers? homes.l Complainants identi?ed more than 30 different solar companies that had provided poor or inadequate service, falsely represented the savings customers would realize from solar power, lured them in with low price quotes that later proved to be false, performed shoddy installation of the solar panels, and in a signi?cant number of cases made harassing phone calls, often to individuals who had placed their numbers on a do not call registry. By far the largest number of complaints were lodged against Solar City and Vivint Solar. It appears from many of the complaints that solar companies routinely promised signi?cant savings in customers? utility bills with the installation of rooftop solar panels, but those savings never materialized. For example, one customer claimed of feeling ?cheated? by the solar company Solplicity, which was unwilling to do anything about the resulting higher bills (No. 394718),2 while another customer of Verengo Solar-Sunrun Solar submitted a similar request to your of?ce, which was denied on the ground your of?ce is not subject to the California Public Records Act. Thus, while we do not know the volume of complaints your of?ce has received, it likely exceeds those received by the CPUC. 3 Copies of the complaint summaries referenced herein are enclosed as Exhibit A. 1201 Connecticut Avenue, N.W. - Suite 300 0 Washington, D.C. 20036 - (202) 780-5750 Attorney General Kamala Harris November 17, 2016 Page 2 complained of bills that nearly doubled after installing solar panels (N 0. 226305). A customer of Solar City complained that the company had admitted it had installed the wrong system but was refusing to install a new one, resulting in higher bills (No. 366343). This same complaint was echoed by another Solar City customer who said of the company: it ?took the money and ran and now do[esn?t] want to deal with the problem.? (N 0. 319923). A third Solar City customer complained of paying hundreds of dollars more in energy costs since the installation of solar panels, writing ?It may be a green option but it is most de?nitely not saving us money.? (No. 402987). These are just a few of the Solar City customers who described energy bills increasing sometimes by twice as much once solar panels were installed, despite the company?s promise they would reduce costs dramatically. A customer of Verengo Solar whose utility costs increased after the addition of solar panels wrote ?this system is not now, ever has worked as advertised and reported to us.? (N 0. 337887). Smart Energy Solar had promised the addition of solar panels would eliminate a complainant?s utility bill; instead utility charges increased. (No. 357831). Customers of Vivint Solar complained of being promised savings of 20-30 percent on their electric bill, but after solar panels were installed their electric bill increased by 80 percent the ?rst month and 100 percent the second month. (No. 364558). This complainant stated, feel so exploited . . . by this company.? The CPUC also received complaints of false representations. For example, a customer of Vivint Solar complained of signing up for solar energy under false pretenses after the company misrepresented it was af?liated with a utility company. (N 0. 324550). The complainant sought unsuccessfully to have the solar panels removed, but the company stopped returning her calls. Similarly, NRG Solar signed up a complainant?s parents for solar panels against their wishes, after falsely claiming the company was affiliated with the utility company. (N 0. 360963). Another complainant reported that Solar City tried to get her mother to sign a 20-year contract before the company would even give her mother an estimate. (N 0. 384784). Yet another complainant wrote to express her concern about Vivint Solar and the company?s insistence that she pay for a solar package that was installed for her now deceased mother. The package was sold when her mother was ?old and sick? and her mother was not given full information. (N 0. 393720) These complaints of false promises, unretumed phone calls, and factual misrepresentations tell a common story: consumers are lured in by promises of signi?cant cost savings, then ?nd themselves facing huge debts not offset by savings in their utility costs. Further, sales personnel use misleading and high?pressure tactics. For example, a representative of Solar City claimed to be taking over the electric service and raised a false threat of upcoming rolling blackouts that solar could cure. (N 0. 322011). Other customers waited months for promised installations and for service activation, all once the solar companies had their money in hand. The CPUC also received complaints of shoddy installation that caused roof leaks g. Nos. 384033, 361952). Attorney General Kamala Harris November 17, 2016 Page 3 Solar companies also seem to have preyed on the most vulnerable: the aged, the sick, and those with more limited resources. One complaint described being lured in by Verengo Solar and its promise the bills would not exceed $101, the maximum the complainant told the company it could afford. In fact, however, the complainant?s bills soared after solar panels were installed. ?We are older and they are taking advantage of us and keep stringing us along. That?s how they make money and steal from us.? (No. 399443). A signi?cant number of complaints concerned harassing and improper telephone calls. Many explained that although they were registered with the Federal Trade Commission?s (FTC) Do Not Call registry, they nevertheless received numerous harassing phone calls from a variety of solar companies.3 The CPUC received complaints of solar companies using robocalls (Nos. 330247, 340553), calling individuals multiple times per day (Nos. 334134, 398668, 400621), sometimes at all hours of the day and night (No. 340533), and ignoring requests to cease calling. Potential Violations of Law Califomia?s Unfair Competition Law, Cal. Bus. Prof. Code 17200, et seq. (UCL), provides broad protection against, inter alia, ?unlawful,? ?unfair,? and ?fraudulent? business acts or practices. California courts have con?rmed its broad reach, acknowledging the legislature?s ?apparent[] intent[] to permit courts to enjoin ongoing wrongful business conduct in whatever context such activity might occur.? Comm. on Children ?s Television, Inc. v. Gen. Foods Corp, 35 Cal. 3d 197, 210 (1983).4 The statute provides for injunctive relief, restitution, and in government enforcement actions civil penalties. Cal. Bus. Prof. Code 17203, 17206. The practices of numerous solar companies outlined in the complaints received by the CPUC appear to violate the UCL. By falsely representing the savings customers would receive from solar energy roof panels and the overall impact of solar energy as a more cost-effective energy alternative, companies like Solar City and Vivint Solar appear to have violated 17200 of the UCL. Further, by falsely representing themselves to be associated with local utilities, salesmen for Vivint Solar and NRG appear to have violated 17200 of the UCL. The complaints re?ect the harsh reality that solar companies operating in California often take advantage of a particularly vulnerable population. As a result, the impacts of these apparently fraudulent practices are all the more devastating, leaving low-income customers or those living on ?xed incomes with even higher utility costs and loans that often exceed what they can afford to pay, and plunging them into a cycle of debt. Many solar companies also appear to have made unlawful telephone solicitations to those who have registered with the Federal Trade Commission?s Do Not Call Registry. From the limited information provided, cannot ascertain all the companies that have engaged in this illegal practice. Further investigation by your of?ce can con?rm how widespread these illegal telephone solicitations may be. If, however, solar companies have engaged in telephone solicitations of California residents who have registered their telephone numbers with the Do Not Call Registry, your of?ce has jurisdiction to bring civil actions pursuant to Cal. Bus. Prof. Code ?17593. Conclusion Solar companies operating in California are employing a variety of strategies and practices that may enhance their bottom line, but are leaving customers frustrated, unhappy, and facing even bigger utility bills. Laws like California?s UCL protect against the kinds of fraudulent practices that seem so prevalent in the solar energy industry, but their utility depends on more aggressive enforcement. therefore requests that your of?ce launch a statewide investigation into the consumer practices of solar energy companies, drawing on the many examples found in the complaints lodged with the CPUC. Utility Name: Solplicity 226305 COMPLAINT 06-04-201 2 Complaint I Concern: I am writing to you after being placed on hold (by SunRun) for 17 minutes while being tortured with obnoxious jazz music.and then disconnected Prior to signing up wi Sunrun (Thru Verango), my Southern California Edison bill for 1 year was $4.840.28 After a year with Sun Run, where I have paid a total of $2,832.40. I got the annual Southern California Edison bill for my ?rst year on solar. That bill was for $5,715.22. That means that since switching to SunRun. have paid a total of $8,549.40. That is $3,709.12 more per year then I was paying when I was just using Southern California Edison. Why am I paying more now? Utility Comment: They never answered the phone and have not called me back. Request of CPUC: Put these con artist out of business. Utility Name: SunRun 226305 COMPLAINT 06-04-2012 (dad) No jurisdiction over SunRun. SunRun provides solar power panels and systems installation and maintenance services. Complaint I Concern: I purchased solar in 2013. I am paying more for the panels every month that I paid for PGE and I then have a tru up of 700-800 at the end of the year. I ?nally spoke with a representa ive from Solar City. My system is too small to take care of all my energy needs he says Solar City refuses to put more panels on. Further. I am paying 23 cents per kilowatt and hey are charging only 15- 18 cents a kilowattl asked if I could repurchase the new system. The answer was no.The gentleman, Joe Benvenuto even told me he would never have put such a system on someones home. Was told I would reduce my electrical costs. n he sales meeting showed he reduction of savings. As of today one year later I am 1300 in the hole to SCE and 800 in hole over last year. I have reached out to SC 21 time in emails (sending info spreadsheets. bills, ext.) Called everyday for over 90 days. And still 5 of today no responsejus a run around. Utility Comment: Were working on it . Everyday for 90 days. Then sent a check of 200 for my time being there taking so long. Request of CPUC: To help in getting SC to rectify the situation or take the panel off my roof. Sold a fraudulent system. Took the money and ran and now do not want to deal with the problem. More to help other who live int here home 2417 that this is not really the way to go. SC never said ifl am retired I can not save money on power if I am using power. We appreciate you taking the time to bring his matter to our attention. Please note the CPUC regulates privately owned electric, natural gas, telecommunications, water, railroad, rail transit. and passenger transportation companies. The CPUC does not extend to all business opera ions. We do not have jurisdiction over companies such Sola City. You may wish to contact the Better Business Bureau at 661-322-2074 322011 COMPLAINT 06-07-2014 Complaint] Concern: On Saturday June 7 2014 a representative from Solar City came to our door and said that they were taking over our electrical service. He then asked for the location of our electrical panel. My wife told him the location and informed me of the visit. When I arrived at the panel the representative had the panel open and was noting our loads in the panel. A neighbor was told by this or another representative from Solar City that he was there to read the meter. Our service provider is So Cal Edison and we did not ask for a visit or inspection from Solar City.These kinds of sales tactics are unprofessional and amount to slamming and should be stopped. The: statement that Solar City is taking over our service when underhanded and the representative stated that there were going to be blackouts this summer. This pressure through fear tactics should be stopped. Request of CPUC: I would like Solar City to STOP using high pressure sales tactics and misleading information to gain information abou a residence for their sales purpose. Referred customer to Better Business Bureau. 402987 COMPLAINT 09-13-2016 Complaint! Concem: We signed a lease with hem in 2013 to save money and go green. One year later, when we received our "trup-up statement from our regular utility company. we found that our total annual cost for electricity had INCREASED after having solar panels installed. For the next two years, we worked with customer service people at Solar City while they "investigated", but the ?nal outcome was that they said we would need to buy several thousand dollars worth of addi ional solar panels to begin saving money. The quote was, "The system seems to be working as Solar City sent "engineers" to assess our electricity needs before installing the system. and they are supposed to be the "experts" in this ?eld. so shouldnt they have been able to design a system that works correctly? We should not have to pay MORE for power now than we did BEFORE installing solar panels. Each year, we are paying between 5900-51800 MORE han we paid before solar. What can we do at this point? Utility Comment: After two years of investigating-which included online reps and supervisors? they said that the "system was working appropriately" even though our costs con inue to be signi?cantly more than before we had solar panels. They offered a new ?tier" systen of charges that was not explained, but seemed to cost even more than we are spending now. No one at Solar City will address the fact that his system is the one THEIR experts and engineers recommended. It seems only reasonable to me that they bear responsibility fo a system they designed--and promoted as a money-saving, green option to power needs. It may be a green option, but it is most de?nitely not saving us any money. Request of CPUC: I can document the claims I am making, but am not sure if that is necessarylappropriate yet. I do not know what ac ions the CPUC has available. but basically. I would like Solar City to the system to one that produces enough power to result in savings (which is what they originally promised) or. remove the system entirely and we will move forward wi someone more reputable Utility Name: Solar City 402987 COMPLAINT 09-13-2016 called consumer - his beef wlSolar City - said we could close 335919 PHONE CONTACT 10-23-2014 A1 solar harassing consumer 337887 COMPLAINT 11-12-2014 Complaint I Concern: The system that was installed on our house is not working as we were told it would resulting in an $1100 bill from SCE. We were told this system would reduce our electricity bill but has in effect caused our bill to increase because our solar system is not producing enough electricity. Utility Comment: We have contacted Verango Solar on numerous occasions and been basically stonewalled. We have asked them to check out or repair our system as per our contract but so far have refused to do so. Request of CPUC: We would like our system ?xed to the point that it creates enough electricity to offset SCE. We also feel that they should be responsible for our huge SCE bill since their system is not now. ever has, worked as advertised and reported to us. We have at this time turned the solar system off because we cannot afford to pay two bills. Utility Name: Verango Solar! Tredegar Solar 357831 COMPLAINT 06-10-2015 Complaint I Concern: i have had a lot of problems with smart energy solar and their customer service. workmanship and product they promised vs what they delivered. They said I would eliminate my Edison bill and that is not true, so now Im paying more than I was with out solar. They dont return phone calls. when they say they will call back. I contacted the state contractors license board and smart energy told them they were going to resolve my problems by offering me three months of free service. then they never did. Utility Comment: They dont return phone calls. So when I call and complain they say sorry we are growing to quickly. Request of CPUC: I would like 12 months of of free service because I have been having problems with them for almost a year now. Utility Name: smart energy solar 357944 COMPLAINT 06-11-2015 Complaint! Concern: A solar system was placed on my roof was told that I would be paying the lower tier "no matter what". I am currently paying more than beforell was misinformed. I asked the company to remove the panels but of course they refused. Utility Comment: They refused to take the panels off my roof. Request of CPUC: Power purchase agreements should be regulated in a way that doesnt allow companies to defraud consumers. I would also like help in getting the panels removed from my home. Simply nullify contracts that defraud the citizens of Califomia. Utility Name: Clean Power Finance 364558 COMPLAINT 08-18-2015 Complaint I Concern: We were sold on Vivint Solar with the knowledge we would save 20-30% on our electric bill. We were with This sounded good to me and also the fact we were going green. I decided to move forward with the program. I have now received 2 bill: and my electric bill from Vivint has increased 80% the first month and 100% the second month. Sadly. I looked at my account with PC 8] E. From the previous year and used less energy for both months in 2014. Also, prior to installing solar we had additional insulation put in our attic. and all windows calked. doors weather stripped. Utility Comment: They indicated that we would start to see savings in the winter. stated. ?Well of course our heating unit is on Gas." Vivint also mentioned that it appeared the system was not on the first month, so perhaps we would see savings the second month Not true. as mentioned the rate doubled. Request of CPUC: HELP. I am unsure what P.U.C. Can do but, if there is anything you can please help. I feel so exploited. and dubbed by this company. Utility Name: Vivint Sloar 365282 COMPLAINT 08-25-2015 after I called them the total balance on the next bill was $2000 less. I never know if I pay more than the amount due if they are going to Balance $115.78 Interest charge is 57.72 payment applied is 58.05 ending interest balance is 181.56 Why is it 65.78 more than it starter Request of CPUC: See if you can get them to hire some one that knows how to do proper billing. I still think this whole thing is a scam. Complaint I Concern: They are a month behind in their billing. It is like a shell game. i paid $2000 they never showed it on the bill but apply it to the interest or to the balance. I have had to call them every time i get a bill. This month Utility Comment: For the 08/11/15 bill they said they made a mistake and would correct it. The bill for 0611 ms beginning interest at. it should be .33 cents less than when it started. Utility Name: Solar City 322905 COMPLAINT 06-18-2014 Complaint I Concern: have been harassed by phone calls from NRG Energy for several months. NRG. as far as I know, has nothing to do wi any of my power, water, gas, or phone utilities. NRG claims to be af?liated with the PUC, which exempts them from national do-not?call list restric ions and allows them to ignore requests to be put on their own do-not-call list. They wont tell me what they want from me except they are desperate to talk to me in person about energy costs or solar energy. When I ask them to clarify the nature of their business or not to call me again. they usually hang up on me. Their calls originate from different regions and phone numbers and have missing or misleading caller IDs. The callers make false asser ions about rate increase notices lm supposed to have received or rate changes due to the decommissioning of the San Onofre Nuclear Generating Station (which was have operated by one of my utilities). Utility Comment: have never initiated contact with them. When they contact me by phone. they are evasive about the nature of their business. They usually hang up on me if try to ask questions that deviate from their script. which is consistent each time they call: "We want to talk to you about the notice you received concerning a 15% increase in your power Have you thought about using solar We want to set up an in-person meeting to talk to Request of CPUC: (1) Please con?rm whether the PUC has any relationship with NRG Energy and. if so. whether you endorse their telemarketing practices. (2) Can you confirm whether the PUC and organiza ions af?liated with the PUC are exempt from the na ional do not-call list restrictions and are also allowed to ignore requests to be put on their own do-not-call lists? (3) Is there anything you can do tc stop this harassment from Utility Name: NRG Energy 324550 PHONE CONTACT 07-08-2014 Consumer says that she and her husband signed up for Vivant Solar because a salesman came to their home and told them that they were af?liated with SCE. She said it took months for them to install and get service up and running. Now hat it is installed they have been billed addi ional charges that they were never advised of. They also continue to be billed by SCE. She contacted SCE and found out that they in fact are not contracted with SCE. Consumer wants \?vant to remove all of their equipment since they lied to her. She says that she can?t get in contact wi anyone atVivant and they don't return calls. Complaint I Concern: I want to switch my electric utility from DWP to Solar City. My solar power hardware was installed at the beginning 358929 COMPLAINT 06-22-2015 of March 2015. i am still waiting for DWP to approve my switch to Solar City. Utility Name: DWP Complaint I Concern: An employee from NRG visited my parents home on May 26. My father is 85 and mother is 77. The were led to believe that NRG was an af?liate of I discovered several weeks later that the employee obtained my parents email account without their knowledge or consent (My parents did were not aware they had an email account. the employee found the email from an iPad they use for entertainment. The employee signed my parents electronically into a 20 year $20.000 contract for them and sent the contract back to hem via email. No hard copies were left for my parents to review. My parents had never sent or received any emails from this account before this event and do not know how to retrieve email. After this discovery. I contacted NRG to cancel the contract. sent them a letter via US mail. by fax and email and have not received con?rmation from anyone. Someone needs to be aware of this type of fraud and targeting of elderly households Utility Comment: They would look in to the issue. Never have I received a response Request of CPUC: Con?rmation of cancellation and prevent these types of practices to continue Utility Name: NRG solar 360963 COMPLAINT 07-13-2015 384295 COMPLAINT 03-04-201 6 Complaint I Concern: Our company received a notice stating we had a change in parcel and the county of Sacramento was increasing our sewer fees based on this information provided to hem. Target informed them that we didnt have a change in parcel. hat we did pull a permit recen Iy to install Solar however, but no change in parcel occurred as this system is mounted to the roof. WE tried reaching out to a supervisor there and left a message. That supervisor followed up, leaving a message stating she was increasing our bill even more and was adjusting he bill by increasing it actual. After that. Target received another letter stating that the county of Sacramento was increasing our sewer to a much higher rate, doubled from the initial notice. See attachments please. Target believes this was due to us and our utility payment provider reaching out to their Supervisor to question the up charges in sewer based off of Target pulling a permit for Solar. Utility Comment: The representative couldnt give details as to how the rate increase was calculated. have a saved voicemail from the Supervisor who left a confusing message stating at first hat she was planning to adjust the bill. but then stated that she was increasing our bill even more, after I contacted her to discuss the bill increase. This was clearly an insult to us for reaching up to a Supervisor for more details about the bill increase. when the initial call representative couldnt explain the bill increase details and stated that there was nothing that she nor a supervisor could do. The rep tried transferring the call to that supervisor but then said she was unavailable and asked to leave a message. Then I received a message after hours. conveniently with that message that was insulting to say the least. Nobody has reached out from the utility since that initial contact and we now have received another letter stating the further increase. nearly double from original. Insult to injury. Request ol CPUC: We would like for this to be investigated and to enforce the County of Sacramento to limit their ability to increase our sewer charges based off of our city permitting for our planned solar projects (500 stores through 2020) or based off temporary increase due to leaks or project construction, which is unjus ifiable. Please implement a rate structure and provide more information to customers? in terms of how these rate increases are calculated. instead of these mysterious, unjus i?able increases blurted out over voicemail by a County Supervisor who is unhappy that a company is questioning their justi?cation for increasing a bill. Utility Name: County of Sacramento 384784 PHONE CONTACT 03-10-2016 Solar City. Solar City tried to get her mother to sign a contract for 20 years just to get an estimate. I referred her to the Contractor State License Board and gave their contact number. 393720 PHONE CONTACT 06-02-2016 Consumer Ms.- is needing some help with a solar company named \flvint Solar that sold a package to her mother. Her mother died recently and they are asking her to still pay. when she feels they did not give her mother all the information. and she was old and sick. Advise to contact Contractor state licensing board 394123 COMPLAINT 06-06-201 6 Complaint I Concern: i am concerned about the unfair. deceptive billing practices of Solar City. I purchased solar panels in August 2106 I expected that the billing would be similar to all other consumer loans have had- larger proportion interest/smaller principal payment in the early years with an option to make principal payments and a payment information box with a minimum payment warning. i turned the bill over to my adult daughter who lives with me. Sunrun also received rebates and government funding/rebates for this installation and they are not offering to reduce the amount they are looking for. They wont tell me what they want from me except they are desperate to talk to me in person about energy costs or solar energy. Their calls originate from different regions and phone numbers and have missing or misleading caller IDs.
