This matter is pending for consideration of Defendant Deric Lostutter’s motion for rearraignment. [Record No. 66] The defendant’s request to be re-arraigned for purposes of
entering a guilty plea to Counts 1 and 4 of the Indictment effectively moots his previouslyfiled motion to suppress [Record No. 38] and his objections [Record No. 65] to the United
States Magistrate Judge’s Recommended Disposition [Record No. 60] regarding his motion
to suppress. Therefore, being sufficiently advised, it is hereby
ORDERED as follows:
1.

Defendant Lostutter’s motion for re-arraignment [Record No. 66] is

GRANTED.
2.

Re-arraignment of the defendant shall be held on Wednesday, November 23,

2016, beginning at the hour of 10:30 a.m., at the United States Courthouse in Lexington,
Kentucky.
3.

Defendant Lostutter’s motion to suppress [Record No. 38] is DENIED.

The United States Magistrate Judge’s Recommended Disposition [Record No.

60] is ADOPTED.

The jury trial previously scheduled for December 5, 2016, is CONTINUED

GENERALLY.
