INFORMATION
In the name of and by the authority of the State of Kansas comes now Barry K Disney, #13284 the duly
appointed, qualified and acting Senior Deputy Riley County Attorney of said county in the State of Kansas
who prosecutes for and on behalf of the said State in the District Court of said county and is duly empowered
to inform of offenses committed within the above-named County and gives this Court to understand and to
be informed:
COUNT 1: That on the 6th day of October, 2015, in Riley County, Kansas, Jared Ralph Gihring, did
unlawfully, feloniously and knowingly have sexual intercourse with C.M.S., who was incapable of giving
consent because of the effect of any alcoholic liquor, narcotic, drug or other substance, which condition was
known by, or was reasonably apparent to the defendant. In violation of K.S.A. 21-5503(a)(2), Rape, a
severity level 1 person felony. (Penalty: K.S.A. 21-6804, 21-6807 & 21-6611)
COUNT 2: That on the 6th day of October, 2015, in Riley County, Kansas, Jared Ralph Gihring, did
unlawfully and feloniously engage in sodomy with C.M.S., who was incapable of giving consent because of
the effect of any alcoholic liquor, narcotic, drug or other substance, and her condition was known by, or was
reasonably apparent to, the defendant. In violation of K.S.A. 21-5504(b)(3)(C) Aggravated Criminal
Sodomy, a severity level 1 person felony. (Penalty: K.S.A. 21-6804, 21-6807 & 21-6611)
COUNT 3: That on the 26th day of April, 2014, in Riley County, Kansas, Jared Ralph Gihring, then and
there being present did unlawfully, feloniously and knowingly have sexual intercourse with S.J. W., which
was done without the consent of S.J. W. while she was unconscious or physically powerless. In violation of
K.S.A. 2013 Supp. 21-5503(a)(1)(B), Rape, a severity level 1 person felony. (Penalty: K.S.A. 2013 Supp.
21-6804, 21-6807 & 21-6611)
OR IN THE ALTERNATIVE:
That on the 26th day of April, 2014, in Riley County, Kansas, Jared Ralph Gihring, did unlawfully,
feloniously and knowingly have sexual intercourse with S.J. W., who was incapable of giving consent
because of the effect of any alcoholic liquor, narcotic, drug or other substance, which condition was known
by, or was reasonably apparent to the defendant. In violation of K.S.A. 21-5503(a)(2), Rape, a severity
level 1 person felony. (Penalty: K.S.A. 21-6804, 21-6807 & 21-6611)
