McNamara reporting: On 3/18/15 I responded to Mt. Snow in Dover VT for a report of open burning of building materials at a site owned by Brady Sullivan. I located a job site on the mountain which I soon learned is owned by Brady Sullivan Properties, LLC. I met with sub contractor Universal Décor and spoke with Tim Theos. As I approached him I observed him place a piece of particle board in a small pit which was actively on fire. On interview Theos admitted that they had burned some debris in the pit over the past several days. He stated the site is owned by Brady Sullivan and that the job foreman for Brady Sullivan is Kevin Morse. Morse came out of the job trailer. He confirmed he is employed by Brady Sullivan. I spoke with him briefly outside. He also admitted they had been burning some debris. Theos told me that Morse had told him to not burn garbage, but to burn wood. He said he Morse did not specify to separate out any treated wood. Morse concurred. Regardless, not only was there treated wood in the burn pile (I observed partially burned green "ZipSeal" OSB and PT lumber), I also observed melted plastic bottles, scorched aluminum beverage cans, melted plastic lumber banding, partially burned cardboard, paper cups and candy wrappers. The amount of material in the pile as I observed it at that moment was less than one cu yd. After I photographed the pile Theos immediately extinguished it with snow at my request. Theos denied burning glue containers as was alleged in the initial complaint. I explained the rules on open burning to Theos and Morse, including that even clean, untreated waste lumber would require a permit from the Agency - and that is generally the only thing the Agency would issue a permit to burn. I told them the only thing they would not need a state permit to burn was natural wood waste, such as branches, which still required a local burn permit. Morse said they will not be burning anything anymore. On further interview with Morse he stated that over the last several days they burned about one or two cu yds of waste - including wood that might have been permissible if they had applied for a permit from the Agency.
