Dave, Civil No. 1:14-cv-02034 BUZZFEED, INC et al., v. DOD 001768 9/4/2015 Page 2 of 5 I had not seen the photos when I provided my initial recommend to forego the autopsy and absent this accompanying explanation would have not made that recommendation. That said, with the details below, it still appears to have been the right move. With the circulation of these photos, will be important that are all provided the notes below iot provide context. They may have it already if not believe it is key they do. CJCS is doing some Sunday Talk shows tomorrow although not likely for this to arise believe he needs this info prior. Pic of Deceased Detainee CLASSIFICATION: CAVEATS: NONE TERMS: NONE Sir, after 3 eing the photos last night I askedE to get with the operators and the docs to provide me some feedback prior to the final investigationrecognizing that we are still in the middle of CID and 15?6 review. I thinkemail below may answer some of your questions and provide a bit better context as to why we concluded early on that the result of death was not detainee abuse and therefore getting the mans body back to his tribe was of greater importance than the autopsy and trip back to CONUS. Civil No. 1:14-Cv-02034 BUZZFEED, INC et al., v. DOD 001769 9/4/2015 Page 3 of 5 We will continue to ensure all of this information is part of the CID report and subsequent 15?6. He also asked the doctors as to why some of the injuries presented would appear as they did in the photos. I have cut and pasted his email below - As discussed, the following is provided to better establish the context for the 24 photos of Detainee #5037767. (Photo numb rs orrespond to the order in which they were received in the NIPR?distribut Adob attachment. Photographs were taken in excess of 16 hours after time of death.) The detainee was taken off?target because it was believed he offered the best lead to the location of the DUSTWUN soldier. He had given his phone to his wife to hide; blasting caps and a sign ficant quantity of money were discovered in his residence. He was extremely aggressive and non?compliant on target; he continued this posture once detained and ugh his arrival at the THA. He was initially being escorted to the helicopter by an APU soldier. He broke out of his flex cuffs twice and was placed under care of a PJ. He maintained his non?compliant attitude, intentionall and repeatedly falling to the ground. The assault force, in an effort to make safe and rapid daylight movement to the HLZ, placed him in a Skedco for transport to the helicopter. Once aboard, he was taken out of the stretcher. He walked off of the helicopter into the THA under his own power. Once in the THA, he increased his combative attitude until overcome by cardiac arrest, at which time medical treatment was administered. An aggressive resuscitative effort was undertaken before he was pronounced dead. - He received multiple doses of adrenaline both Epinephrine and Atropine. Manual CPR was administered. He was given a cricothyroidotomy, bi?lateral chest tubes, 2 central IVs (l in his left chest and in his right groin), and a pericardiocentesis (a large needle inserted in the chest to draw fluid away from the heart). Ribs were fractured during CPR and post?mortem blood pooling will occur as a result of gravity and human physiology. All marks on the body are consistent with medical treatment administered. The dried blood is consistent with having been in a body bag for several hours. (photo Marks consistent with a cricothyroidotomy (photos #8 12). No signs of petechial hemorrhaging, but this condition is very hard to determine without magnification. (photo Incision from the left chest tube and bruising con istent with CPR. (photos #10 11) Incision from chest tube. (photo #13) Dried blood consistent with the large gauge IV catheter that was placed under his clavicle; bandage used to keep his mouth closed post?mortem as requested by the interpreter. (photos #14, 15, 22) Hands had been tied by the medical team post?mortem; bruising consistent with gravity and breaking of flex cuffs. (photos #16, 17, 18, 19) Knee tches consistent with repeatedly falling down. (photos #20 21) Dried blood consistent with large gauge IV chest catheter; no evidence of head trauma.
