This proceeding was instituted under the Animal Welfare Act, as amended (7 U.S.C. § 2131 et seq.) (AWA or Act), by a complaint filed by the Administrator, Animal and Plant Health Inspection Service, United States Department of Agriculture (APHIS), alleging that respondent violated the Regulations and Standards issued pursuant to the Act (9 C.F.R. § 1.1 et seq.) (Regulations and Standards). This decision is entered pursuant to the consent decision provisions of the Rules of Practice applicable to this proceeding (7 C.F.R. § 1.138). Respondent admits the jurisdictional allegations in the complaint and specifically admits that the Secretary has jurisdiction in this matter, admits the remaining allegations as set forth herein as findings of fact and conclusions of law, waives oral hearing and further procedure, and consents and agrees to the entry of this decision for the purpose of settling this proceeding and resolving all other AWA issues arising from noncompliances or deficiencies documented by APHIS though December 2, 2016. Complainant agrees to the entry of this decision. FINDINGS OF FACT 1. SNBL USA, LTD., is a Washington corporation whose registered agent for service of process is Mark Honda, 6605 Merrill Creek Pkwy, Everett, Washington 98203. 2. At all times mentioned in the complaint, respondent was a dealer, as that term is defined in the Act and Regulations, and held AWA license number 91-B-0078. D 3. At all times mentioned in the complaint, respondent was a research facility, as that term is defined in the Act and the Regulations, and held AWA registration number 91-R-0053. CONCLUSIONS OF LAW Respondent having admitted the findings of fact set forth above, and the parties having agreed to the entry of this decision, such decision will be entered. ORDER 1. Respondent, its agents and employees, successor and assigns, directly or through any corporate or other device, shall cease and desist from violating the Act and the Regulations and Standards. 2. Respondent is assessed a civil penalty of $185,000 to be paid no later than December 5, 2016, by wire transfer or by check made payable to the Treasurer of the United States. 3. AWA license number 91-B-0078 is suspended for 30 calendar days, beginning December 22, 2016, and continuing thereafter until respondent has successfully passed APHIS inspections at respondent's licensed sites, demonstrating to APHIS that it is in compliance with the Act and the Regulations and Standards. APHIS shall, at a time that is mutually agreeable to both parties, schedule compliance inspections to occur upon the conclusion of the 30 day suspension period. Once respondent establishes that it is in compliance with the Act and the Regulations and Standards, APHIS will file a motion for a supplemental order lifting the license suspension.
