Deputy Report forlncident 098011974 Page 3 of 4 Narrative Incident Investigation Narrative On 07/02/09 at approximately 11:00 AM, I (Deputy James Tousky) was sent to 270 W. John Powell Blvd. (Pueblo Regional Center) in Pueblo West, CO on a reported sex offense. Upon arrival contact was made with Diane Torres (DOB: 8/15/61) who is a investigator for the Pueblo Regional Center. Diane advised me of the following: stated to Diane that she was touched inappropriately by a staff member, on two different occasions. One being one week ago and the other being two weeks prior. was housed at 183 S. Wiggins Dr. in Pueblo West, CO at that time. Contact was made with at the Pueblo Regional Center located at the center located on John Ph advised me of the following: On two separate occasions between on 06/24/09 and on 07/01/09, _touched her while in the pantry, he touched her breasts, butt, and private area and kissed her on the neck, also a third time while they were in the living room area he did the same thing. _told_to stop and he kept touching her. She tried to get away and he grabbed her arm and pulled her back towards him. _did not tell anyone because she was afraid of him. I asked?where the other staff was. She stated that Joe Chavez (DOB: 10/19/61) who is a staff member, was getting the other Clients their money. I confirmed with Diane that they were the only two staff members there. After questioning? some more, her story continued to change and she became very angry. Fellow Deputy Christie asked the same question of what happened and _changed her story by telling him that the assault took place at the dinner table, not in the pantry and Joe observed ever thing. Deputy Christie asked her why her story changed and at which point dbecame very angry and stated, "just forget it", and she got up and left. Once_ left the room, Diane explained to me that when?is caught in a lie, she becomes very angry and exhibits the same behavior she did with this incident during questioning. Diane felt that due to this behavior, _was making false accusations against the staff member. Diane was there for the entire interview with and stated we could call Joe at home and speak with him. Contact was made with Joe by phone. I asked Joe what happened the day the incident took place. Joe stated at around 3:30 PM he transported several clients, including-to the State Hospital to get the money for the week. When they returned, was in the kitchen preparing dinner for the clients, which was around 4:30 PM. I asked Joe if he saw anything happen between and _at dinner. Joe stated they all sat down for dinner at 5:00 PM, like they do every night and he sat across from and _sta ed in the kitchen. I asked if _had any disagreements with *or any of the other staff in the last two weeks. Joe stated, Joe stated that he did not see anything out of the ordinary between-and - Joe explained to me that if he did see anything, he would have reported it.
