When we looked at the qualifications for the Section Supervisor announcement, we approved it with the qualifications of 2 years or more as a Parking Supervisor l. of course, that means that no one from Towing qualified because previously there were no Parking Supervisor I?s in Towing. I attached the draft announcement that I approved in error for you to see. Our intent was to make the qualifications for the position anyone with 2 or more years? experience as a parking 0R towing supervisor. I attached Col. Jernigan?s memo saying that two (2) full years of experience as a Parking or Towing Supervisor would qualify you for Section Supervisor. But because the Parking Section Supervisor is the new class title for the old Parking Supervisor II, we slipped up and used the old qualifications instead of the new qualifications which should have said 2 years supervisory experience in Parking or Towing. Civil Service is aware of the error and is going to amend the announcement so that the towing supervisors wili qualify for the Section Supervisor positions. As you know, you were selected for a position as a Section Supervisor in Towing. However, because of the error in the wording on the announcement, Civil Service sent you the letter saying you did not qualify. This happened with all the supervisors in Towing that should have qualified, but didn?t. Civil Service is working right now to amend the announcement and will send you a letter saying you are qualified. There have been a series of events that have taken place over the past few months beginning with the earliest as of 4/22/15. On 4/22/15, I received an email from Linda Cepeland, Administrator of Department of Public Works asking Shelly (title) asking her if a job study was going to take place to promote me to the Parking Control Manager position (see attachment A). On 7/28/15 I have received an email from Ms. Copeland where said states that have been promoted to the position [see attachment B). The paperwork for the position was submitted by Ms. Copeland in 6/2015 but civil service rescinded the paperwork 7/2015 due to a sexual harassment complaint that was filed against me. Civil service then offered me a provisional appointment to the Parking Control Manager position. On 8/17/15, the Department of Public Works sent Delisa over to manage me as a form of retaliation because i had inquired about the permanent placement of the Parking Control Manager position that I had been told I was promoted to. At the time of sending her over to manage me, my position title out ranked Ms. position title. On 9/2/15, Lt. Col. Jernigan received a letter from the Office of Inspector General stating they had received a complaint early 7/2015 that I have been sexually harassing female employees of the Towing Division, City of New Orleans (see attachment C). On 9/22/15 I submitted my rebuttal to the letter Lt. Col. Jernigan received from the OIG (see attachment D). I also had a conversation from the n5pector Michael Centola regarding the letter and he said he was not involved in the investigation. On 12/22/15 received a letter stating I did not meet the minimum qualifications for the Parking Enforcement section Supervisor but this was due to an error made by Ms. Copeland (see attachment E). The way the job announcement was written it did not include a group of employees to qualify for the job position. The administration made an error again when writing up the job announcement after promising me in several emails that i would qualify for the position and wasn?t (see attachment F). On 1/4/16 asked Ms. Copeland when will I receive pay as the Parking Section Supervisor. Since the wording in the job announcement was incorrect for the Parking Section Supervisor for one position then all position was placed on hold as far as pay. 1/19/16 received a receipt of a verbal warning alleging my unprofessional attitude. Once I had received this letter it had become clear to me that I was being discriminated against based on gender because I am the only male in the Department of Public Works that have been competing for the Parking Control Manager position and it is apparent that the Department wants to hire female workers only. have been discriminated against based on rEprisal because anytime I have asked questions about the Program Control Manager position, Lt. Col Jernigan and Ms. Copeland?s actions have been a form of reprisal. I have worked in a hostile work environment because the situations about the job positions, reprisal have been so pervasive and interferes with the ability to perform myjob. I have been a city employee for over 18 years and have never had my character diluted with untruths as have since Lt. Col Jernigan and Ms. Copeland has been in the positions they have been in. This suspension is being given due to your unprofessional conduct in providing an answer key for employees to use while taking the mandatory ethics training. Specifically on: June 9, 2015, PCO LaToya Harrison was using Ms. Sherida do her Ethics training. Upon Ms, Harrison's departure, Ms. Emery discovered an answer key to the test next to her computer. Again, on June 16'" after returning from annual leave, Ms. Emery found the same answer key nexi to her computer on her desk. In regards to allegations made by Shanta Scott, I have never had any such conversations or made any such comments to hen Our relationship and conversations were only of a work related nature. There was a phone call from her to me at about one night, in which she asked ?what time do you want me to punch in?? I asked her what she was talking about and she said something about working a task force. I explained to her it was not functioning yet. She said she thought it was. I again explained it to her and the conversation ended. My knowledge of her work history, through other direct supervisors and my own knowledge was that she was a hostile and unc00perative probationary employee who was recommended for extended probation. Upon Ms. Scott being summoned for her probationary drug test she refused to take the test and resigned. In regards to India Toney, I have never had any sexual conversations with her, never threatened her or ever intimidated her for any reasons. Ashley Terry, the sister of Ms. Scott, is a subordinate under my indirect supervision. As such I do not have much contact With her but any such contact has always been for business related reasons and professional. I have never had inappropriate conservations with her or made any sexual comments to her or any other city employee.
