Dear Frank,

AECOM anticipates the Desiyi-Build Amendment and its 680 1 documents be executed by the
parties in the near future. We continue to massively wane commtments to placing orders With our
material and subcontractor suppliers in order to maintain the prqect schedule Those commitments are
backed by the assurance of a fuly funded Escrow account for the Project. As of today our status and
forecast of the Escrow requirements are as follows.

0 Required September Escrow payment not pend: 52038893400, (this payment is late)
0 October projection. $2 5,285,640,
0 Noveinber propctton: $11,750,259. (With November's deposit we wil reach the SIOOM

maximum obligation).

ASCOM magenent views these deposits as a critical metric to project finanoal security and
maintaining con?dence and credibility with our project subcontractors and suppliers. Our only
permitted recourse under the Contract the event the Escrow is not fully funded is to suspend our
performance of the Work, after a 10 day notice period. until such time as the funding Issue is resolved.
In order to avoid any such suspension and resultim delay to the Protect. AECOM asks that Faraday
Future bra the Escrow current by fully funding the past due September payment In addition.
in order to avoid any simiar problems in the future, AECOM asks that Faraday Future make the
necessary arrangements for the tlnely funding of the anoer and November deposits, order to tum
satisfy its Escrow contract obligations.
