The grounds in support are as follows. On December 6, 2016, Petitioner filed the Mandamus Petition in this Court seeking an order requiring the District Court “to decide forthwith Respondents’ Motion to Dismiss or for Judgment, which has been fully briefed and pending since November 24, 2015.” Pet. at 1. On December 9, 2016, the District Court scheduled a hearing on the motion to dismiss for December 20, 2016. The District Court’s order appears to render the Mandamus Petition unnecessary if not moot, and Petitioner believes judicial economy warrants dismissal of the Mandamus Petition without prejudice so the parties and the District Court can focus on the forthcoming hearing and so this Court may conserve resources. Wherefore, Petitioner requests that his Mandamus Petition be dismissed, without prejudice to filing another petition in the future in the unlikely event of further delay.
