As a follow up to our conversation approximately 2 weeks ago. We (CCRFO) have not received any response from Seth Jones or Chris Frabatta as of the date and time of this email. The applicant has been very patient with the process and we (CCRFO) feel that the project is in the public interest and would reduce unregulated impacts to special aquatic sites along the Lydia Ann Channel. That said, we owe the applicant a permit decision and are ready to issue the LOP. Let me know if this is something you want to sign or if you are ok with me signing it. We (Bobby and I) just got off the phone with Mr. Mike "Skipper: Edwards and informed him that we contacted Seth and Chris and they would likely be out till next week. But if he wanted to he contact Joe, as they know each other. Mike stated that he did not want to "muddy the water" and would wait till they return next week. Lastly we informed him that from a Regulatory perspective the project is not contray to the public interest, will benefit the aquatic environment (compared to current ongoing activities i.e. barges pushed up on San Jose Island) and should not affect navigation (USCG did not respond to the ICN). 2 USACE0090 I informed him of our converstation that Regulatory is prepared to make a decision next week and if necessary you would sign. Mike informed us that he will wait till next week before going up the chain of command. Hopefully Nav/Ops will make a decision; regardless, we will be prepared to make our decision next week.
