INVESTIGATION 4/12/2016 At 0339 hours, I was called on my department issued cellular phone by Detective Sergeant Brimmer. Sgt. Brimmer advised he needed me to respond to the Nisqually Jail to assist in investigating the death of a Nisqually Jail inmate. Sergeant Brimmer advised he was attempting to activate the multijurisdictional Critical Incident Team, but he was unsure of what other investigators may be joining the investigation. Sergeant Brimmer advised the coroner was already onscene and had been waiting for investigators since she arrived at 0219 hours. Sergeant Brimmer instructed me to respond to Nisqually Jail and begin to document the scene. I arrived at the Lacey Police Department so I could retrieve my detective vehicle and supplies. I met with Sergeant Brimmer, who advised we were going to be the only investigators responding to the scene. Detective Brimmer and I set off for the Nisqually Jail in separate vehicles at 0414 hours and we arrived at 0424 hours. I was contacted prior to entering the scene by Thurston County Deputy Coroner Karen Peek. Peek advised the deceased was a 19 year old male named Andrew J. Westling. Peek advised she had not examined Westling’s body yet, but advised his body was covered and on the floor of the intake area, just outside of the holding cells. Also on scene was Nisqually Police Officer A. Sparkhul. Officer Sparkhul responded to the scene at 0054 hours, but was not involved in the lifesaving efforts for Westling. Peek showed me to the area which contained Westling’s body, where I was introduced to Nisqually Corrections Officer E. David. David was taking notes of the actions taken on scene and the persons involved. A copy of these notes were later obtained and added to the case file. Upon entering the facility, I photographed the scene with my department issued digital camera. I photographed the intake area, the area of Westling’s body and holding cell 3, where Westling was found unresponsive. The following is a brief synopsis of the photographs taken: 4 • • • • • • • • Westling’s body was atop a mattress and covered by a blanket. Westling’s body was in a walkway between the booking podium and holding room 5 and a few feet from holding room 3. There was an electronic defibrillator on a shelf, next to Westling’s body. There was a pair of black “Croc” type shoes next to Westling’s body which were presumed to be the ones he was wearing. Next to the doorway of holding room 3 was a damp white towel. On holding room 3’s door was a “special housing sheet” which Westling’s name was written and was absent any other markings. Inside holding room 3 was an orange rubber mug which contained a small amount of water, an empty package of ammonia inhalant, a comb, deodorant, and a Telmate phone card. I also took photos of the areas in which surveillance cameras would have been able to view Westling while he was in holding room 3 and when he was removed from holding room 3. (It should be noted that holding room 3 has a single surveillance camera attached to the celling and a grate in the floor which acts as a toilet. There is no furniture or other fixtures in this cell. After photographing the scene and Westling’s body as it was when I arrived, I collected the evidence from the scene. The following items were collected: • • • • • • • • • White towel AED with accessories (SN# 102048563) Inmate Special Housing Sheet Syringe cap (located to the right of Westling’s body) Inmate shoes (size XL) Yellow plastic IV type cap Toothbrush (still in wrapper from next to Westling’s mattress left side) Orange rubber mug, AED pad pouch, comb, deodorant, Telmate phone card, empty ammonia inhalant pouch, and miscellaneous medical packaging 2 blankets were also collected while processing Westling’s body All of the aforementioned items were later logged into evidence at the Lacey Police Department. After collecting the evidence, Peek and I uncovered Westling’s body and photo documented it. The following is a brief synopsis of this set of photographs: • Westling was lying on his back with his head toward holding cell 3. • Westling was dressed in the orange jail clothing and was not wearing socks or shoes. • Westling was intubated and had the AED patches still attached to this chest and side. • Westling had blood on his face and there was also blood on the blanket on top of which he was located. 5 • There were no items in Westling’s hands and there did not appear to be any abrasions to Westling’s body. After photo documenting Westling’s body, I photographed the steps in which Peek bagged his head, hands and feet as per the homicide protocol. While I was taking these photographs, Sgt. Brimmer took similar photos with Peek’s camera. Peek, Sgt. Brimmer and I placed Westling’s body into a body bag and I observed Peek place the red serialized lock on the bag. Westling’s body was then removed from the scene and Peek transported his remains to the Thurston County Coroner’s Office morgue. Once Westling’s body was removed and the evidence was collected, I released the scene at 0532 hours. Once the scene was released, Lt. Jeff Smith secured a conference room in which I could interview the Nisqually Jail employees who had interactions with Westling. The following are synopses of these interviews: Corrections Officer Edna David (0600 hours) • • • • • • • • • • • • • David’s shift began at 1800 hours on 4/11/2016 and she was scheduled off at 0600 hours on 4/12/2016 (graveyard shift). David advised she attended shift briefing at 1800 hours, taking her post in booking shortly thereafter. David stated Westling was already in holding room 3 when she arrived at her post and advised Westling was relocated there just prior to the start of her shift. David stated she was able to see Westling moving about his cell. David stated between 1830 and 1900 hours, she had her first contact with Westling as he was “pounding on the door” and “said that he was having heart skip… skipping beats.” David stated Westling was “leaning over the toilet” and had a “drenched” towel on top of his head. David stated she told Westling that she would “grab his file” and refer it to the senior officer. I asked David if she was briefed on Westling prior to taking her post and she stated she was not, but she was told he was in holding cell 3 for “medical observations.” I asked David if anyone had called for a nurse or medics to evaluate Westling and she stated, “No.” David stated AJ (Andrew) Robertson was in charge during this shift, but he was in House 1 when Westling first called her attention. David stated she looked through Westling’s file, looking for medical conditions, but found none. David stated she addressed this with Robertson, who stated there “was nothing” on Westling’s medical and Robertson stated he would talk to Westling. David stated she continued with her normal duties (bonds, booking, etc.) 6 • • • • • • • • • • • • • • • • • • • • • David stated the inmate housed next to Westling was on a 30 minute watch for vomiting blood. David stated all the holding cells in which Westling was housed are located in this area so the corrections officers can keep a better watch on these subjects. I asked David if Westling was on the same 30 minute medical watch and she stated he was not. David stated Wesling’s paperwork only stated “medical observation,” which “could mean a lot.” David stated she did not find the “SAG Referral” until approximately 20 minutes prior to the medics being called. David stated the SAG referral stated Westling was complaining of “irregular heartbeats” and this was the reason for his relocation to holding room 3. David stated the last time she saw Westling alive (approximately 0015 hours), Westling had his shirt off and other corrections officers were going to see why his shirt was off. David stated she was conducting a cash bond and did not remember which corrections officers contacted Westling. David stated she completed the cash bond, got a soda and when she returned she was made aware of the medical emergency by “control.” David stated she responded to the booking area where she witnessed Gorman, Bailey and Kalama performing life saving measures. David stated Kalama was performing CPR inside of Westling’s holding cell. David stated Kalama told her he checked on Westling and found that his feet “were kind of blue.” David stated Kalama opened the door and tried to wake Westling, but he received no response. David stated this was approximately 45 minutes since she had last seen Westling moving about in his cell. David stated medics arrived within 5 minutes of the start of CPR. David stated medics asked the corrections officers to pull Westling out of the holding cell to allow them more room to work on him. David stated she and the other corrections staff observed while CPR was being performed and stated there were 2 sets of medics which had arrived. One with an engine and one set in an ambulance. David stated the medics performed CPR for approximately “27 minutes with some Eppi.(Epinephrine) and oxygen, but they were getting no response.” David stated the medics provided her with the medical paperwork and advised the coroner was on the way and the medics remained on scene until the coroner arrived. I asked David if she witnessed Westling doing anything out of the ordinary in his cell (i.e. hitting his head) and she only witnessed Westling leaning over the toilet in the cell and she witnessed Kalama bringing him water. David stated she “thought he was detoxing.” 7 • • • • • • • David stated Westling was talking about his heart and she saw the towel on his head and she thought these were signs of detoxing. David stated they kept telling Kalama to give Westling water. David stated this was her first interaction with Westling. David stated Westling “seemed perfectly fine other than I thought he was detoxing” “there was nothing out of the ordinary, he was compliant, he was talking.” David stated Westling was booked for 2 charges by Yelm PD. David stated Westling went to court the day before and had a bail of $1500. David’s statement ended at 0612 hours. Corrections Officer Samphlis Gorman (0620 hours) • • • • • • • • • • • • • Gorman’s initial statement was stopped to collect the Nisqually Jail’s address for his statement (as noted at the end of this statement). Gorman stated he was performing “cell checks” when he witnessed his “partner moving up front.” Gorman initially thought his partner may need assistance with a combative subject. Gorman stated his partner was actually in need of assistance with a medical emergency. Gorman stated CPR was started as soon as they “got there.” Gorman stated he retrieved the AED and attached it to Westling. Gorman stated his team performed CPR until the medics arrived (approximately 2-6 minutes later). Gorman advised he works the graveyard shift (6 pm until 6 am). Gorman stated prior to the medical emergency, he was working in the south wing. I asked Gorman who was first to perform CPR and Gorman stated he was “not sure” but it was already in progress when he arrived. Gorman stated he participated with CPR and the AED in regard to life saving measures. Gorman stated he had no other interactions with Westling. Gorman’s statement ended at 0623 hours. Corrections Officer Noelle Winchell (0632 hours) • • • • • Winchell advised she was one of the corrections officers who booked Westling into the jail. Winchell stated Westling was “a little mouthy” yet “cooperative” when he was booked. Winchell stated Westling asked what he was being booked in for after the arresting officer had left. Winchell recalled Westling was booked for MIP/MIC. Winchell advised Westling asked if he was able to be booked for MIP/MIC and she told him he could be booked for this charge. 8 • • • • • • • • • • • • Winchell stated Westling asked when he could have a phone call and she told him the times which the phones are available. Winchell stated another officer was performing his booking and she was the support officer for this booking process. Winchell stated another officer escorted Westling from the booking area once his booking process was completed. I asked Winchell which police agency had brought Westling to the jail and she could not recall. Winchell stated she remembered an officer told her that he was booked for “spitting” on a woman, but she did not recall if he was booked for this reason. Winchell stated Westling was behaving “flustered” once he was booked and it appeared “he did look like he was under the influence of some type of substance,” but she did not know what. Winchell advised Westling had a “very cocky attitude when he came in.” Winchell advised she worked the night shift from 6pm until 6am. Winchell advised she had not had any other interactions with Westling before or after this instance. Winchell was working at Nisqually’s other jail the night of Westling’s death. Winchell stated she did not remember Westling complaining of anything medically wrong with him when he was booked, but she was not filling out the booking sheet. Winchell’s statement ended at 0632 hours. Corrections Officer Kennan Kalama (0638 hours) • • • • • • • • • • • • Kalama advised he was doing his “standard 30 minute cell checks.” Kalama stated, “At approximately 0050, I was doing my cell check and witnessed him unconscious.” Kalama stated he opened the cell and called for backup and his supervisor. Kalama stated a “trustee” called to another area of the jail for other officers to respond. Kalama stated he and the other officers performed CPR and awaited medics. Kalama stated he was Westling’s booking officer from the day before and stated, “he gave us no indication of any medical issues at all.” Kalama stated when he books prisoners in, he “thoroughly asks everything,” referencing the intake sheet. Kalama stated Westling was booked for MIP and Assault 4th degree DV. Kalama stated Yelm PD had brought him to the jail. Kalama stated at booking, Westling “seemed like a normal young kid that you know, had a little too much fun.” Kalama obtained Westling’s emergency contact and health care info. and all of his other particulars. Kalama stated “there were no signs of any medical issues.” 9 • • • • • • • • • • • • • • • • • • • • • • Kalama stated he believed it was the following day when Westling was in the housing unit where he “explained the complication with his heart.” Kalama stated when he began his shift this day, Westling was already in holding cell 3 and remembers “pulling him out” of his cell and providing Westling water and fresh air. Kalama stated he provided Westling with water multiple times this night and performed more cell checks. Kalama stated he worked from 6pm until 6am this day. Kalama stated when he began his shift, he remembers Westling “complained of his heart, um I told him to get some air, try to relax, get some water.” Kalama stated he and C.O. Ellis talked to Westling outside of his cell and then put him back in his cell. I asked Kalama if Westling was seen by a nurse or medic and Kalama stated, “Not that I’m aware of.” Kalama stated the C.O. in housing filled “out a SEG referral for his complications.” Kalama stated Westling was brought straight from the housing unit to the holding cell. Kalama advised the SEG referral “explains in detail what’s going on with the inmate.” Kalama stated there were copies of the SEG referral provided to the others. Kalama stated the first officer to start CPR was Officer Bailey while AJ or Officer Gorman got the AED. Kalama stated he thought Bailey started CPR, followed by Gorman, followed by himself, after which the fire department arrived. I asked Kalama if Westling was giving him any problems this night and Kalama stated, “No, nothing at all.” Kalama stated Westling appeared a little distraught and was crying at times. I asked Kalama if Westling was “banging around in his cell at all and Kalama stated, “No.” Kalama stated Westling would “come up to the glass here and there where you could see him.” Kalama stated Westling would ask for water, but nothing out of the ordinary. Kalama stated Westling was “such a young kid, he just… I couldn’t, I couldn’t tell you that he had this complication and we were aware of it and I couldn’t see anything at all with it.” Kalama stated Westling seemed healthy and wished he “could have spotted something.” I asked Kalama if the officer who had brought Westling in had mentioned any sort of use of force with Westling and Kalama stated, “No, nothing at all.” Kalama’s statement ended at 0647 hours. 10 Corrections Officer Tully Bailey (0651 hours) • • • • • • • • • • • • • • • Bailey stated he was in the south wing of the facility when a Trustee alerted him and pointed toward booking. Bailey stated he thought there was an emergency, so he responded. Bailey stated when he arrived at booking, he noticed the door to holding cell 3 was being held open by Officer Kalama. Bailey looked at Westling and thought he was suffering from a medical condition. Bailey stated he put on gloves and checked Westling for vitals, including checking for breathing (mentioning Westling was not breathing). Bailey stated he checked for a pulse (in the wrist and neck) and could not find one. Bailey stated Westling was “cold to the touch.” Bailey stated he started CPR. Bailey stated Officer Gorman brought the AED and attached it. Bailey stated Officer Gorman took over chest compressions once he was tired. Bailey stated he stood by Westling until medics arrived at approximately 0059 hours. I asked Bailey if the AED delivered a shock to Westling. Bailey recalled the ARD began activating and reading him, but stated, “a shock was not advised and was not performed.” Bailey stated prior to this, he did not have any other interaction with Westling. Bailey’s statement ended at 0656 hours. Corrections Officer Arron Robertson (Acting Supervisor) (0701 hours) • • • • • • • • Robertson stated he was the “OIC” (officer in charge) for the first part of the evening as they did not have an actual supervisor at this time. Robertson stated he is not a supervisor. Robertson stated Officer David had come to him in regard to Westling and had brought him Westling’s file. Robertson stated he was wondering why Westling was in holding. Robertson stated Officer David told him that Westling was “having a strange or complained of an irregular heart beat earlier that day before he was moved to holding.” Robertson stated Westling was taken from housing 2 to holding prior to his shift due to “whatever he complained of, because I wasn’t familiar with his case.” Robertson stated, “We looked at his medical history and stuff like that in the file and it stated that he didn’t have anything related to that and he was just allergic to a couple of antibiotics and some other um, I won’t go into the issues, but venereal issues.” Robertson stated this was all of the medical information in the file. 11 • • • • • • • • • • • • • • • • • • • • • • • Robertson stated he was on duty the night before and had observed Westling’s booking. Robertson stated during Westling’s booking, “He was not nice, you know he was standing there agitated.” Robertson stated he would check in with the booking counter regularly during his shift in the course of his duties. Robertson stated at approximately 2230-2245 hours, he was eating his dinner in the corner of the booking podium and could see into Westling’s cell window. Robertson stated he watched Westling as Westling was standing and urinating into the cell toilet (seen from the waist up). Robertson stated he could see Westling wetting his hair and running his towel through it, noting this was “normal activity.” Robertson stated “He didn’t beat on the door he wasn’t inactive,” noting Westling was “seeable” in the cell. Robertson stated, “He was checked on multiple times.” Robertson stated at approximately 0050 hours, he was on the booking podium when C.O. Kalama checked on Westling. Robertson stated C.O. Kalama advised Westling was “unresponsive.” Robertson stated he entered the holding cell with the other officers while Gorman retrieved the AED. Robertson stated Bailey started CPR while he got the pads out for the AED. Robertson stated the AED analyzed Westling and no shock was advised. Robertson stated he left the cell while CPR was in progress so he could call the jail’s control. Robertson stated he called control and told them to call 911 for an unresponsive male in holding 3. Robertson stated control alerted medics and estimated by 0100 hours, medics had arrived and took over lifesaving measures. Robertson stated he had 2 duties these nights: Responsive Moving Officer (RM) and Officer in Charge (OIC). Robertson stated he remembered noticing Westling was “semi agitated” when he was booked, but he only caught pieces of the booking process as he had other duties to attend to. I asked Robertson what charges Westling was book on and he stated, “Simple assault DV and MIP/MIC.” I asked Robertson which police department brought Westling in and Robertson stated, “Yelm.” I asked Robertson if he remembered Westling disclosing any medical issues upon booking and Robertson stated, “No, I didn’t hear anything directly.” I asked Robertson if he performed CPR on Westling and he sated he did not. Robertson stated he was not briefed as to why Westling was in holding room 3 when he came on duty and stated he was only knew he was on 12 • • • “medical observation” and noted Westling was not “acting out of sorts or anything.” I asked Robertson if Westling had requested medics and Robertson stated, “I don’t believe so,” but also stated, “I never interacted with him directly.” I asked Robertson if any medics or nursing staff were called to check on Westling prior to this and Robertson stated, “I’m unclear.” Robertson’s statement ended at 0709 hours. Corrections Officer Marco Garay (0713 hours) • • • • • • • • • • Garay started he worked the night shift in housing 2 the day before. Garay stated Westling entered his housing unit the night before and he advised Westling he would be staying in unit H2A. Garay stated Westling did not say much to him and did not say anything about his medical condition. I asked Garay how Westling looked when he arrived at his area and Garay stated he did not get a good look at Westling as the lights were low, but he mentioned Westling’s eyes were bloodshot and his walk “was good.” Garay knew Westling was brought to the jail by Yelm PD, but did not know what his charges were. I asked Garay if Westling caused any problems with the other inmates and Garay stated Westling did not as Westling went straight to bed. Garay stated when he arrived at work today, Westling was already transferred to the holding cell and advised he was told Westling was transferred because, “he was having a…the pulses were off…he said that the inmate was telling him um that he only stated that he had heart conditions, previous heart conditions.” Garay stated the officer he relieved was writing the report for the transfer. I asked Garay if he had seen this report and he stated he had not. Garay’s statement ended at 0717 hours. The above listed personnel were the only staff members still on site whom had contact with Westling. Upon returning to my office, I was notified by dispatch that Carmen Rowe, who advised she was Westling’s mother, wanted a call at 425-931-8196. At 0853 hours, I called Rowe, and immediately after dialing her telephone number, I was forwarded to her voicemail. I left Rowe a message with a request for an interview, and to collect Westling’s medical records for the case file. I did not receive a return call from Rowe. At 1425 hours, I received a voicemail from Peek, who advised Westling’s autopsy was scheduled for 0900 hours on Thursday, April 14th. 13 Autopsy 4/14/2016 At 0900 hours, I contacted Thurston County Deputy Coroner Peek and Forensic Pathologist Dr. Fino, at the Thurston County Coroner’s Office reference the autopsy of Westling. Peek and I briefed Dr. Fino about the specifics of the case prior to the autopsy. While briefing Dr. Fino, Peek advised her of Westling’s medical history. Westling’s medical history included instances of tachycardia in 2012, where he was seen by Medic One and St. Peter Hospital. Westling was referred by St. Peter staff to a cardiologist, but Peek was unable to locate any documentation of Westling following up with a cardiologist. This medical history showed a past history of prescribed medication for this condition and an alternative method of dealing with bouts of tachycardia by “plunging” (placing a towel which was dampened by ice water over his head and leaning forward). During autopsy, Peek and I observed the entire procedure. After the autopsy was completed, Dr. Fino stated Westling suffered from 2 underdeveloped coronary arteries and his third coronary artery was partially imbedded. Dr. Fino stated Westling’s partially imbedded coronary artery would have been “pinched off” during his heart beat and the underdeveloped coronary arteries would not allow for normal blood flow and the imbedded coronary artery would have been the one compensating for the other two. Dr. Fino advised she was leaving the cause and manor of death as “Undetermined”, pending pathology and toxicology results. Dr. Fino also noted that the intubation performed by responding medical personnel was a “total miss”. It should be noted that the medical paperwork provided to the coroner’s office advised the intubation was most likely unsuccessful(see coroner’s report for more information). Upon completion of the autopsy, Peek requested a Lacey Evidence Tech respond to collect the evidence which was collected during autopsy. I later forwarded a request to Evidence Tech Liening to complete this on Monday, April 18th (she was on vacation until the 18th). At 1020 hours, I received a voicemail from Nisqually Police Lieutenant Jeff Smith. Smith advised the video download of the Nisqually Jail surveillance cameras is nearly completed, but there has been some difficulty in collecting all of the footage. Smith advised they have an information technology (IT) employee working on the issue and the footage should be ready the following day. Smith also advised there were two other employees who had contact with Westling who would be available for interview the following day: C.O. Alhouser and C.O. Pino. I called Smith back in the afternoon and left him a voicemail that I would be contacting him on Friday to retrieve the surveillance footage and interview the aforementioned employees. 4/15/2016 At 1310 hours, I met with Lt. Jeff Smith at the Nisqually Police Department. Lt. Smith provided me a copy of the surveillance video from the booking area on a 14 zip drive. Lt. Smith advised he attempted to obtain the surveillance video from House 2 where Westling was housed prior to being put in holding room 3, but stated the surveillance DVR was malfunctioning and this video was not able to be recovered. Lt. Smith advised he had contacted the company who maintains their surveillance system and they will be providing documentation of this malfunction. Lt. Smith also advised he would have his staff download Westling’s phone activity at the Nisqually Jail (1 call to his mother). Lt. Smith then arranged for me to interview Corrections Officers Althauser and Pino in the conference room at the Nisqually jail. The following are bullet points from these interviews: Corrections Officer Michael Althauser (1327 hours) • • • • • • • • • • • • • • • • • • Althauser advised Westling was in House 2A. Althauser stated he pulled Westling out of the housing unit at approximately 1400 hours for his “phone call with the judge.” Althauser stated at the end of the call, Westling was showing anxiety and Althauser thought it was a result of the phone call with the judge. Althauser stated Westling told him the Yelm Judge told him that he could “get up to possibly a year in jail for his charge.” Althauser told Westling that he could talk with him later if needed to ease his anxiety. Althauser stated Westling returned to the housing unit and seemed “perfectly fine.” Althauser stated at approximately 6pm, Westling began to “bang on the door.” Althauser stated he went to see what Westling needed and noticed Westling “holding his neck.” Althauser stated he thought Westling may have “cut his neck open” as he was unsure of why he would be holding his neck. Althauser stated he immediately pulled Westling out of the holding area and did not try to communicate with him through the door. Althauser stated Westling removed his hand from his neck and Althauser stated there was nothing wrong with Westling’s neck. Althauser stated Westling then “proceeded to tell me about his heart condition.” Althauser stated Westling told him he “has an abnormal heart beat.” Althauser stated Westling told him “the last time his heart condition acted up, he had to be resuscitated in the ambulance.” Althauser stated at this moment he made the decision that Westling was not going to stay in the general holding area because he didn’t want Westling’s heart condition to act up in the general holding area where he is only checked on “every thirty minutes where it’s going to be too late.” Althauser stated he called C.O. Pino immediately who was in booking. Althauser asked Pino what holding cells were available and Poni told him holding cell 3 was available. Althauser stated he told Pino that Westling needed to “go on medical watch for his heart condition.” 15 • • • • • • • • • • • • • • • • • • • • Althauser stated he began to explain the holding cell to Westling and Westling initially “was almost declining medical attention.” I asked Althauser what he meant by this and Althauser stated, “He was like ‘I don’t want to go because I feel like this is punishment.” Althauser stated he explained to Westling that the transfer was not punishment and it was a safety procedure to take care of him. Althauser stated it would not matter if Westling refused as he was now required to be placed in the holding cell due to his complaint. Althauser stated Pino asked Westling if he had disclosed this medical condition upon booking and he believed Westling stated he did not. Althauser stated Westling said he “was taking medications previously for the heart condition, but he stopped because he didn’t have the funds for them and he didn’t bring them to our attention knowing that he could have gotten the medication here.” Althauser stated he hung up the phone with Pino and Pino responded to housing 2 where he took custody of Westling and transferred Westling to holding cell 3 in the booking area. Althauser stated this was the last he saw of Westling and Althauser advised he wrote a SEG referral and a report about this. I asked Althauser if Westling told him if his heart was currently acting up or if he only told him of his heart condition. Althauser stated “He said he previously has had problems with his heart condition but he didn’t say anything was happening right that second.” Althauser stated Westling was not saying he needed to go to the hospital or requesting immediate medical attention. Althauser stated when Westling brought his condition to his attention, he took this to mean that he needed to go on a medical watch only. I asked Althauser if Westlig told him why he had his hand on his neck and Althauser stated, “He didn’t.” Althauser stated “it looked like he had a bit of anxiety or he was nervous or afraid, like he was scared because he didn’t want the heart condition to act up, he didn’t know if it was going to happen.” Althauser stated he has not been at work since this incident as he was on normal days off. Althauser stated he was “shocked” when he heard that Westling had passed away at the jail, but he had not heard anything else about the circumstances of his death. Althauser stated his only other interactions with Westling were when he offered Westling a haircut and provided him with a phone PIN. Althauser stated it appeared that Westlign interacted with the other inmates appropriately and stated Westling was “playing cards and playing games with people at the tables and he looked…he actually had a smile on his face even though…I mean…he’s in jail.” Althauser stated this changed after the call with the judge, after which Westling would mostly stay in his bunk and not talking with other people. Althauser’s statement ended at 1336 hours. 16 Corrections Officer Michael Pino (1404 hours) • • • • • • • • • • • • • • • • • • • Pino came in for the statement as this was not his regular work day. Pino stated he worked from 6am to 6 pm the day Westling passed away. Pino stated he was working in booking this day. Pino stated approximately 5 minutes before the end of his shift, he received a call from Althauser who told him “he has an inmate here that was showing anxiety…or was having anxiety and that he did mention ....um…. something about a rare hearth condition he had but it was mainly with anxiety.” Pino stated Althauser put him on speaker to talk with Westling. Pino asked Westling if he had mentioned any of this on the booking sheet and Westling told him “yes.” Pino asked Westling if he took medication for this condition, to which he also said “yes.” Pino asked Westling what the medication was called and stated Westling did not know. Pino stated Althauser asked him what to do next and Pino stated he told Althauser to gather Westling’s belongings so he could move Westling to holding for medical observation. Pino stated he collected Westling and while they were walking back to booking he asked Westling again if he knew what medication he took, but again Westling advised he did not know the medications’ name. I asked Pino about Westling telling him that he had told this to the booking officers when he was booked at the jail. Pino stated, “From what he told me, yes.” Pino stated as he and Westling were walking toward booking, Westling told him that he was only dealing with anxiety at this time which was brought on by being in the housing unit and being housed with too many people. Pino advised he explained to Westling why he was being transferred to the booking area and if he needed anything here, he could knock on the door or push the intercom button in the cell. Pino stated Westling did not show any signs of distress when he was walking with him to the booking area. I asked Pino again what Westling had communicated to him in regard to why he needed to be moved to the booking area and Pino agreed that it was only Westling’s anxiety which was bothering him. Pino also agreed that he did not believe Westling was worried about his heart condition as this point. I asked Pino if Westling told him anything else about his heart condition and Pino stated, “No.” I asked Pino if he had any other interactions with Westling and he stated he did not. 17 • • • • Pino stated before he left for the day, he told the officer who was relieving him (Officer Kalama) why he had moved Westling to holding cell 3. I asked Pino if he told Officer Kalama if Westling was on medical watch for his heart condition or anxiety and Pino told me, “Anxiety.” Pino stated he told Althauser to complete the SEG referral and a report. Pino’s statement ended at 1410 hours. These interviews, video, Nisqually Policy manuals and Westling’s Telmate phone call were all later downloaded to the digital evidence locker at the Lacey Police Department. 4/19/2016 Upon arriving at work this day, I received a voicemail from Carman Rowe which was left on 4/15 at 1251 hours. The voicemail message requested I call Rowe back at 425-931-8196. At 0928 hours, I received a call from Rowe. I requested a statement from Rowe, which she agreed to. Rowe advised she would come to the Lacey Police Department to provide her statement at 1500 hours. At approximately 1440 hours, I met with Rowe and her husband, Sean Rowe (Westling’s step-father from age 1 and ½). Both agreed to provide a taped statement. The following are bullet points from both Carmen and Sean Rowe’s joint recorded interview: • • • • • • • • I asked the Rowe’s to provide information on Westling’s medical condition and anything else which was pertinent to this case. Carmen started by providing Westling’s medical history. Carmen stated, “He was fairly healthy most of his life.” Carmen stated, “A couple years ago…..maybe 5 or 6 years ago, he started having complaints of time he was exercising or if he was playing rough or whatever, his heart would race.” Carmen stated, “He figured out different techniques to kinda get it to go back to normal.” Carmen stated, “In 2012, he was at the park with his brother and had another episode and couldn’t get it under control.” “After calling his dad and myself at work, um, I told him he needed to go down the street to the fire department to get help and um, when he got there, it’s my understanding he collapsed when he first got there, so they hooked him up to a bunch of stuff and took him to the hospital.” “Along the way they had to shock him, uh, to try and get his heart beat back down to somewhat of a normal rhythm, um, but that was the worst episode he ever had.” Sean stated, “During that episode his heart rate was almost 300 beats a minute.” I asked how often Westling would have complaints of a fast rhythm like this. 18 • • • • • • • • • • • • • • • Carmen stated, “It wasn’t very often. It was usually triggered by working out with his friends or if he was out doing a lot of skating or a lot of jumping or for a little while he did some par-kore stuff, so if he was like super active or um if he was really really stressed out about something or really really upset about something, um, then it would happen, his heart would race and he would go through, he would usually bend over and try to walk it off or he would get himself wet or something just different things that worked for him, um, but it wasn’t all the time.” I asked who had told him how to treat his cardiac episodes. Carmen stated, “He was never diagnosed with a heart condition. His, um, the doctor that he had for the longest time was doctor Jump (Spelling?) out of Tenino and, um, he kind of talked with Andrew about, you know, different techniques and that the stuff that he was doing was working, he did also prescribe him a medication that he can take in an emergency situation if those techniques weren’t working for him, um, so he carried the pills with him…where they eventually ended up I don’t know.” Carmen stated, “I don’t know if he ever had to take them, but he tried to make sure he had them with him, or his friend or his girlfriend or somebody had them but I don’t know if he ever actually had to take them.” I asked if Westling ever saw a cardiologist and Carmen stated, “No it wasn’t anything where the doctors really could tell anything or were really concerned about it, there was just do this and be careful.” Carmen stated, “It was only one time that sent him to the hospital.” Sean stated he remembered receiving the standard medical release paperwork from Westling’s 2012 episode and stated he did not receive a cardiologist referral. He was just directed to have Westling see his primary care physician. Carmen stated Westling was a “good kid and would “make you laugh.” Carmen stated Westling was mad at them a one point and made a report to CPS that he was being abused at home and was taken into foster care for a few months. Carmen stated Westling’s bio-father had a “non-existent relationship with him.” I asked what Westling’s personal habits were and Carmen stated, “He would bounce between cigarettes and then most recently doing the vaping.” “I know that he smoked weed and I assume he drank, he didn’t drink around me, but I’d see videos of him and his friends being dumb and there was usually alcohol involved.” “As far as doing any other kind of drugs or anything other than smoking pot, there wasn’t anything I was aware of.” I asked if there was any family history of heart conditions. Carmen stated, “I don’t even know what his heart condition was, um, there is some, my mom has heart palpitations and my grandpa has had 4 bypass surgeries.” Carmen was unsure of Westling’s fathers’ medical history. Sean added that Westling was “very much into rapping and music.” I asked Carmen about the phone call she received from Westling when he was in jail. 19 • • • • Carmen stated she was at work and received the call from Westling and stated the call was a “one minute free call” on her cell phone. Carmen stated she did not remember much about the call as it was short. Carmen stated Westling tried to tell her what happened and why he was in jail. Carmen stated Westling seemed to be doing okay, but stated he was living in his car off and on and “couch hopping” until he moved in with his roommate in Yelm. This statement ended with Carmen stating, “I miss him every day.” The statement ended at 1502 hours. This statement was later logged into the digital evidence locker. I later reviewed some of the video provided by the Nisqually Jail. Due to the length of the video, not all of it was reviewed. I did review the time when Westling was transferred to the booking area in holding cell 3. The video showed Westling with a towel tied over his eyes, putting a blanket over himself and going to sleep. At approximately 00:08:37 hours, Westling can be seen removing his blanket and appears to be moving in a convulsive motion as if his body is in distress. Westling’s body makes small jerky movements until 00:10:31 when he ceases to move. Westling does not move again after this point. At 00:51:48 Westling’s cell door is opened and a correction officer checks him. After this point, lifesaving efforts are put in place. From the exterior camera by holding cell 3, at 00:01:58, it appears the corrections offices were at this cell. At 00:08:37, it appears a corrections officer is instructing a new inmate directly outside of holding cell 3, but it appears that their attention was not drawn to the holding cell. At 00:51:30, a corrections officer is seen going directly from the booking podium to holding cell 3 where he found Westling unresponsive. Case status: Leads Exhausted pending coroner report.
