Fellow Conservative,
Last week, the President nominated Merrick Garland as the replacement for conservative
icon Justice Antonin Scalia.
Two Constitutional duties exist in the filling of a Supreme Court vacancy: the President’s
duty to nominate and the Senate’s duty to confirm or not confirm. These duties are equal.
The President must realize that just because the Senate is not acting in the way he wants,
doesn’t mean they aren’t doing their job; in fact, they are doing exactly their job in standing
strong and exercising their Constitutional authority.
That’s why as Chairman of the Rule of Law Defense Fund, the policy arm for Republican
Attorneys General, I asked my fellow AGs to sign onto a letter urging Senate Majority
Leader McConnell and Judiciary Chairman Grassley to stand strong and continue to
hold fast against this nomination. You can read the letter here.
You’d hardly know it from the mainstream media, but the federal courts of late have been
recognizing that the President is stretching power far beyond Constitutional limits.
In the last year, along with several other states, we have successfully blocked the
President’s Clean Power Plan, his immigration rule and his attempt at a massive
takeover of the waters of the U.S.
These are solid, conservative wins, but the future for state and legislative sovereignty
remains very much at risk.
My efforts to protect the sovereign rights of Oklahoma and every state continue, and if you
