on 3/19/12 at 11am the nurse-- reported that resident -- reported being rapped last night. Writerwerlt to 3 gamble intcl resident's room. 3 daughters were present, i asked the daughters to step out while I interviewed the resident. Upon interviewing the resident, she was Alert and oriented to self-- stated her name was net oriented to place- stated she was ~where the bananas are"; not oriented to time, stated "it is late afternaon" when it was 11am. proceeded to ask her how she was; she stated "not good" asked why? she proceeded to state: "Some marl attacked me at night early morning; he pushed me with his hands into my daughter's bed. Everyone went down to get dressed." asked who pushed you? she stated "a hlaek man with a white hat, i don't know it his blackness was real or if he had someone with him. i don't like him." I asked what happened when he pushed you? she stated staggered and went down on my bottom. That was it. He laid on the ground, don't know who pushed him. guess we were pushing each other, I don't remember. am sore in the vagina." laslted why? she stated "because he rapped me last night atter everyone was gone." Writerthen interviewed the three They stated when they arrived in the murning this resident was crying and shaking saying that someone black hurt her and she was afraid. The family state this resident is afraid to be alone and that they usually stay with the resident from 8am-8pm since admission to WMHC. They stated they left the facility at about 8pm yesterday 8/18/12 evening. They stated this resident has never made these accusations in the pas1 and has never made racial comments. Writer asked family If this resident has a Mo being mulested or rapped, they stated no. in general family believes that this may be related to residents' dementia and the fact that this resident likes to he cared for my female staff. They state it may have been the resident complaining about not wanting to be toileted by a male NARand perhaps a male NAR was being rough. Family stated this resident stated not to call the police because the man would know it was her who called and would hurt her again. At 2pm the daughter stated she asked her muther if she was hurt and the daughter repurts the resident states no she has not been hurt by anyone. Famllv also stated resident did not like the police and would be afraid irone were to show up because she would be afraid to go MD notified ofthe situation and MD felt it was not her place to order resident to be seen at ER fora sexual assault examt MD referred writer to WMHC policy and procedure, Writer contacted -- admission nurse atthe time and DON _and together decided that the police needed to he informed of the matter and family needed to be notified that the best decision would be to have resident examined in the ER to rule out sexual assault. Writer informed the famiiythat police would need to be called and that resident should be seen at the ER to rule out sexual assault. Family did not want resident to be sent to ER and requested if police officercould be ununiiormed dueto residents fear, Writercaiied the precinct they stated that this had to be called into 511 and that a uniformed police officer had to come in. 911 was called and a police officer arrived and interviewed family and found it unnecessary to interview resident as family state resident'has a phobia at police, also police officer states that a police report would be unfounded at this time due to the resident being severely cognitively impaired. The police officer and writer stro ngiy encouraged family to allow resident to be seen at ER to be examined forsexuai assault, All three daughters refused stating they did not want their mother being put through that and they firmly believe this did not occur. Family reports they know there mother and she has a history of watchingTV programs which involve situations of this matter. Family refused to have patient be evaluated at ER female nurses on the unit completed a body audit of the resident's genital area they stated no redness, irritation, bruising, or bleeding was noted at that time Two black male night staff were interviewed and suspended pending investigation, The social worker on duty --was informed and updated the care plan. This resident is In have a female caregiver at all times and 1 staff members at all times with one being a female. MD contacted again and informed that police were contacted regarding this allegation the resident made and that the police made the decision not to file a report and that the resident's Emily refused tn have resident be seen at an ER fora sexual assault exam. Writersuggeszed a MD stated that she would like to see the resident before gluing those orders, Writer asked if MD would see patient tomorrow 8/20/12, MD stated yes. --RN
