SEPARATI .AGRE . THIS AGREEMENT is made and is effective as of the date of execution (the ?Execution Date?) by and between Clark County (the ?County?), the Wisconsin Professional Police Association Law Enforcement Employee Relations Division (the ?Association?), and Travis Boyer (?Employee?). WHEREAS, the Employee is an employee of the County under a collective bargaining agreement (the between the County and the Association, which is in full force and effect; WHEREAS, Employee was employed by the County as a Patrol Deputy; WHEREAS, the County, the Association, and Employee desire, through this Agreement, to settle all claims between the parties related to Employee?s employment with the County, the termination of that employment relationship and any other known claims related to Employee; and WHEREAS, Employee desires, through this Agreement, to ?nalize his separation from employment with the County and accept the terms of this Agreement. NOW, THEREFORE, the parties to this Agreement, in consideration of the mutual promises herein contained and other good and valuable consideration, the receipt and suf?ciency of which are hereby acknowledged, agree as follows: 1. Resignation Date and Payment. In consideration for Employee?s commitments under this Agreement, Employee and the County agree the Employee?s voluntary and irrevocable resignation is effective on February 3, 2017 (the ?Resignation Date?). Employee agrees he will not be employed with the County in any capacity in the future. The County relies on and accepts Employee?s irrevocable resignation and the parties agree the County?s reliance is genuine and binding on the parties. Employee?s accrued KW geld!? but unused paid leave Sin CBA) shall be exhausted following the Execution Date and paid in wages only, subject to applicable withholding, and as if he was scheduled to work until the exhaustion of that time. Upon exhaustion of Employee?s accrued but unused paid leave, Employee will be placed on paid administrative leave until the Resignation Date. Employer shall continue to pay the Employer?s share of Employee?s County-offered health insurance premiums from the Resignation Date for coverage ending February 28, 2017, the Employee share of the insurance premium contribution for which shall be withheld as per normal payroll practices. Employee understands and agrees the County has no obligation to continue Employee?s benefits or pay Employee?s premiums for any other bene?ts beyond the Resignation Date, except as is provided by COBRA or other state or federal law at his own expense. 2. Waiver and Release. In consideration of the County?s obligations and promises under this Agreement, Employee does hereby fully and forever discharge and release the 10. ll. 12. representatives, agents, or employees regarding the rights Association member may have under any state, federal or local law prohibiting discrimination on the basis of any protected class, or which prohibit retaliation in any way related to the ?ling of such a claim. Neither the Association, nor its representatives, agents, or employees make any representation by their signature of Employee?s rights under any such claim. Duty of Fair Representation. Employee acknowledges that the Association has met its Duty of Fair Representation to him in that the Association has represented his interests fairly, impartially and without discrimination. Choice of Law and Entire Agreement. This Agreement shall be construed and enforced in accord with the laws of the State of Wisconsin. This Agreement constitutes the entire agreement between the parties as to issues provided for in this Agreement. Headings are for the convenience of the parties only and shall not affect the interpretation or application of this Agreement. Severability. If for any reason a court of competent jurisdiction finds any provision of this Agreement to be illegal or unenforceable, the offending provision will be deemed amended or deleted to the extent necessary to conform to the applicable law. Counterparts. This Agreement may be executed in counterparts and shall be as effective as if executed on one document. Faxed and/ or scanned signatures will have the full force and effect of original signatures hereto. Acceptance. Employee acknowledges that he has had sufficient time to read this Agreement and consider acceptance of it and voluntarily enters into this Agreement with full knowledge of its meaning and with the speci?c intention of resolving all outstanding matters pertaining to employment with the County. Employee acknowledges he has been given the opportunity to seek the advice of non-Association counsel in his review and consideration of this Agreement. In entering into this Agreement, Employee is relying on his own judgment and knowledge and not on representations or statements made by the County, its employees or agents. IN WITNESS THEREFORE, the undersigned further state that they have carefully read the foregoing Agreement, know and understand its contents and sign the same under their own free will, being duly authorized to do so.
