This matter having come before the Court on Motion of the plaintiff, Arthur
West, and the Court having previously ruled on the City's withholding of the NDA in the
Center for Open Policing Case, 15-2-12200-8 the following is hereby Ordered:

. The defendants violated the PRA by failing to disclose the Non Disclosure
Agreement, especially when all of the allegedly secret information contained therein had
already been published.

2. The withholding was done in bad faith and a consideration of the Yousou?an
factors supports a penalty of $100 per day.
