Dispatch advised that the suspect was armed with a knife. Upon arrival at the bus station, I made contact with a black male in a blue sweater jacket and blue jeans. The male was later identi?ed as Donald Robinson. As I approached the male, I realized that I had previously spoken with him, for an incident in which he had brandished a knife against someone he believed had a gun. I asked Robinson what was going on and he stated that the victim, had threatened to shoot him. I asked Robinson if he had ever seen- before. to which he stated he had not. Ofc. McKenna #325 arrived on scene and conducted a pat down of Robinson for weapons. Robinson stated that he had a pair of pliers but did not have a knife. No knife was found on his person. ?stated that he had been at First Presbyterian Church to get food. When he walked out of the church, he said the suspect walked to him and told him he was going to "do him in". The suspect then stated, "I'm an 00 from California". Estated he had never seen the suspect before. and had never en a ed in any verbal altercation with the suspect. -said he asked Robinson to leave him alone, and proceeded to walk north towards the bus station-said Robinson then followed him to the bus station-stated when they were near the water fountain in a secluded area at the bus station. Robinson pulled a small silver knife out of a pair of gloves he was wearin .-said the blade to the folding knife was open. and Robinson proceeded to swing the knife at him. stated that he jumped away, and the knife did not strike his person-stated that in self-defense. he picked up an oran traf?c cone that was lying near by. -said he used the cone to attempt to block Robinson's knife?aid Robinson then took a second swing with the knife. said after the second attem ted strike he dropped the cone, and proceeded to run out into the open area at the bus station to call for help. tated that he was extremely scared that Robinson was going to stab him. During my contact with Bunch, Ofc. McKenna stood with Robinson-and Robinson were far enough apart that they could not overhear each other. Ofc. McKenna said he asked Robinson about a pair of gloves. to which Robinson made a spontaneous utterance of. "Oh, are you looking for the knife'" Ofc. McKenna said yes. Robinson then responded. don't want to lie to you, I threw it in the trash can." Robinson had previously told me when I arrived on scene. that he was not currently in possession of and had never had possession of a knife during this incident. His spontaneous utterance contradicted his previous statement. I detained Robinson to conduct further investigation. I read Robinson his Miranda Rights via my Tallahassee Police Department issued Miranda Card. Robinson acknowledged his rights and consented to speak with me further about this incident. Robinson stated he was standing outside the church when -bumped into him. SECOND JUDICAL CIRCUIT CAUSE AFFIDAVIT 3/ 5 Robinson said-then stated "Pm goin to kill you. You only got six months to live". Robinson said then repeatedly asked that he follow to the bus station to ?ght. Robinson said "being raised on the streets you dongt back down from a figh.". Robinson said he followed -to the bus station. where he believed that they would ?ght. Robinson said- proceeded to (come at me in an aggressive manor?. Robinson said -"took swings at me" with his ?sts. Robinson said he also believed -was in possession of a gun. When I asked Robinson about the knife, he stated that he did not pull the knife out at all during the incident. He said he was wearing the gloves and had the knife stuffed down inside the gloves with the blade open. Robinson said when he realized that-did not have a weapon, he never brandished the knife. I asked how the knife got in the trash can, to which Robinson stated that after he took the knife from his gloves during the altercation, he put it in his back pocket. This contradicted his initial statement that he never pulled the knife out of his gloves. at all, during the incident. I asked him again about brandishing the knife, to which Robinson then stated that he pulled the knife out of his gloves in front of - and placed it in his back pocket. Robinson then stated that he took the knife out of his back pocket and threw it in the trash can after -ran out of the area to call the police. Robinson's statement about the knife changed multiple times. -provided a written statement about the assault. Video surveillance cameras were present in the area of the assault. The bus station was closed for the weekend. so video of the incident could not be collected at this time. No witnesses were present during the assault. Ofc. McKenna collected the knife from the trash can, and I impounded it for evidence. Based on the statement from- Robinsongs con?icting statements regarding the use and possession of the knife. and the evidence on scene I arrested Robinson for aggravated assault. I placed Robinson in double locked handcuffs and performed a search of his person. No illegal weapons or contraband was found. I transported Robinson to Leon County Jail without incident. After arrest, I conducted a search of Tallahassee Police Department records in conjunction with Robinson. It should be noted that Robinson has had eight other cases in eighteen months with TPD. In two reports, Robinson told of?cers he was diagnosed as a Paranoid Schizophrenic (since 1990) and suffers from Bi-polar Disorder. In ?ve other cases, Robinson reported that he was being followed, harassed, and threatened with guns or knives, which he never saw. Aminson #702 and I were dispatched to 1944 N. Monroe Street (McDonald's) in reference to a disturbance. Dispatch notes indicated two black males were in a physical altercation and it was unknown if any weapons were involved. Upon my arrival on scene, I noticed Officer J. Aminson was making contact with two black males and a black female. A few feet away from her was another black male. who was talking to a McDonald's employee. I initially made contact with the black male and the McDonalds employee. The black male was identi?ed his Florida Identi?cation card as Donald A. Robinson and the McDonalds employee identified himself as and stated he was the night manager. I then asked Robinson if he knew why the police had been called. According to Robinson, he and the other group of people (he pointed to the two black males and black female standing near Of?cer Aminson) had been having issues. Robinson explained that he had been having issues with the black males and the female since yesterday. According to him, the black males thought he was trying to "holla at" the black female when they were not around. On tonight, Robinson stated the two black males came up to the McDonalds and started looking at him real aggressive like. At some point, Robinson stated he decided to go outside to talk with them, however when he got outside they tried to hit him. Robinson was very confusing in his explanation of why he went outside or how the verbal altercation became physical. According to Robinson he never pushed, pulled or touched any of the other party. Robinson continued to explain, once he was outside the other two black males became so angry with him that they took out a pair of scissors and tried to "stick" him with them. When asked Robinson stated he did not know where the scissors came from and stated he was never struck with the scissors. Robinson refused to write a sworn written statement and denied needing medical attention. As I looked at Robinson he appeared to be in good physical condition and did not have any marks. breaks or contusions. I then walked inside McDonald's and made contact with the night manager,?stated he did not see either party with a weapon (knife) and stated he only went outside to calm done the situation. tated the incident was mostly verbal while he was scene. I then made contact with the caller/complainant inside the restaurant. He identified himself as while he was sitting inside McDonalds he witnessed Robinson leave out of the lobb area and walk directly in the direction of two black males and a black female. Once he was outside, itated he witnessed Robinson walk over to one of the black males. saw him pull on the black males right arm. At this point, Robinson got into a loud verbal with the other larger black male. During the verbal altercation-stated he saw Robinson pull something out of his front pocket and make a motion as if it was a weapon and he was going to use it against the other black male(s). Due to this action by Robinson, .. I then made contact with Officer Aminson and the black males with her. The larger of the two black males was wearing an Orange and identified himself The other black male initially did not want to give his name or his account of what occurred. However, after speaking with Sergant Connell he decided to provide the name of The black female was identified by her Florida Identification card as and Chelsea were all separated and questioned. When asked. each person con?rmed the fact that Robinson came outside. and confronted them. They explained that Robinson pulled on - arm and when -attem ted to pull them apart, Robinson pulled a metal pair of scissor with a blue handle out his pants pocket. mobinwn made gestures towards him as if he was going to "stab" him with the scissors. When asked stated he was in fear for his life or being seriously hurt by Robinson while he had the scissors in his hands. both wrote sworn written statements of the above mentioned events. Due to the fact that Robinson is homeless his personal belongings were impounded at the Tallahassee Police Department. Due to-stating he was in fear for his life and Robinson having the scissors in his hands at the time of the altercation. Robinson was arrested for aggravated assault with a deadly weapon. Robinson was transported to the Leon County Jail in double-locked handcuffs without further incident. During the investigation, I noticed there were no cameras on the outside of the building. The call notes stated that Perez told the dispatcher that his girlfriend was dead, a?er two armed men had forced him to assault her and bury her body. When of?cers with the Tallahassee Police Department an'ived at they met with Perez and began a search of the wooded, vacant lot to the east of the residence for Perez's girlfriend, in order to determine if she was injured, deceased, or otherwise required assistance. The body of Idelcira Yadira Perez was discovered concealed in what appeared to be an attempt to render it clandestine by covering it with leaves and debris. Near the body was an article of clothing with suspected blood on it. An audio-recorded interview was conducted with Perez by investigators with the Violent Crimes Unit and Of?cer Endara. Due to Perez's inability to understand converse in ?uent English, Of?cer Endara spoke to him in Spanish, first reading him a Statement of Rights form in both English and Spanish before asking him any questions. Post-Miranda, Perez provided this original statement concerning the events of Saturday, January 9, which was translated by Of?cer Endara to investigators: Around 1 1:30 P.M., Perez had been outside of his residence drinking beer when Idelcira came outside and asked him to go to Wal-Mart. He asked her wait until after he was done drinking, and then agreed to go. As they went to get into her vehicle in the driveway, two unknown males (both wearing all black clothing with black masks and armed with handguns) approached the couple. Perez said one of the suspects was speaking English and the other Spanish. When they demanded that Perez and Idelcira come towards them, Perez offered them money, thinking it would cause them to leave him alone. However, the suspects indicated to Perez that they wanted him to strike Idelcira. Perez continued his story, stating that the suspects forced Perez and Idelcira to attack each other, eventually resulting in Idelcira being knocked unconscious or killed. Perez was told to cover her body, which he did, and then ran into the house when one of the men tried to grab him and gouge his eye. Perez maintained that he then told Idelcira's daughter, -, to go to bed and that her mother would be there in the morning. Due to his injuries and level of intoxication, he said he passed out. In the morning, around 10 A.M., he went to work. Feeling uneasy about Idelcira's last known condition, he decided to go home on his break and looked in the wooded area, where he saw her foot sticking out from under the bundle of leaves. At this point, he decided to call 91 for help. While en route to the station for a more complete interview, Perez told Of?cer Endara that he had killed Idelcira. During an audio/vidco?recorded at the Tallahassee Police Department, Perez provided a full confession. His said the majority of the original statement was true, but that the two men were actually demons SECOND JUDICAL CIRCUIT CAUSE AFFIDAVIT 3/5 in his head telling him what to do. He told Of?cer Endara and me that Idclcira had confronted him regarding in?delity. As they walked down ldlewild Court arguing, she pushed him, and he struck her back. A physical - confrontation began, with Perez punching her in the face head area until she fell down and lost consciousness. He then dragged her body into the wooded lot. He said she awoke and began to struggle, so he struck her several more times with his ?sts until she ceased moving. After he had completed obscuring her body, he went into his house. Perez provided both a sworn written confession in addition to the audio/video-reeorded one. A preliminary examination of Idelcira's body showed injuries that appeared to be consistent with Perez's explanation of events. A search warrant, signed by Leon County Judge Richardson, was executed on ?and and clothing covered in suspected blood was recovered from the house; this clothing was consistent with Perez's statements to investigators. This af?davit of statements constituting probable cause for Perez?s arrest was approved by Chief Assistant Cappleman, Assistant State Attorney, Second Judicial Circuit. According to Perez, he is a Guatemalan national who is residing in the United States illegally. At the time of this af?davit, attempts to contact the Guatemalan Embassy were unsuccessful. On Perez's person, I observed several super?cial injuries and scratches consistent with a struggle, as well as swelling and scratches on his knuckles; all injuries were photographed by Forensics. Based on the recovered physical evidence, the body of Idclcira Perez, and Perez's statements to law enforcement, I believe that probable cause exists and is substantiated for the charge of First Degree Murder, in violation of Chapter Florida State Statutes. Perez's actions, resulting in Idclcira being rendered into an unconscious state, his burial of her person, and subsequent actions to kill her when she awoke demonstrate that Perez was engaged in a willing and determined effort to murder another human being.
