ASSAULT, DATING VIOLENCE, AND STALKING 10 11 REPORTING INCIDENTS OF SEXUAL HARASSMENT, SEXUAL Sec.A51.281.AADEFINITIONS. In this subchapter: 12 (1)AA"Dating violence" means abuse or violence, or a 13 threat of abuse or violence, against a person with whom the actor 14 has or has had a social relationship of a romantic or intimate 15 nature. 16 (2)AA"Postsecondary educational institution" means: 17 18 (A)AAan institution of higher education, as defined by Section 61.003; and 19 (B)AAa private or independent college or 20 university approved for purposes of the tuition equalization grant 21 program under Subchapter F, Chapter 61. 22 (3)AA"Sexual assault" means sexual contact or 23 intercourse with a person without the person ’s consent, including 24 sexual contact or intercourse against the person ’s will or in a 85R8040 KJE-D 1 1 circumstance in which the person is incapable of consenting to the 2 contact or intercourse. (c)AAA postsecondary educational institution shall suspend 16 17 for at least one year or expel a student who: 18 (1)AAis required to make a report under Section 51.282 19 and 20 determined by the institution; or 21 (2)AAwith 22 23 24 25 26 27 fails to promptly make the the intent report to harm without or good deceive, cause, as knowingly makes a report under Section 51.282 that is false. (d)AAA person commits an offense if the person is an employee of a postsecondary educational institution and: (1)AAis required to make a report under Section 51.282 and knowingly fails to make the report; or (2)AAwith 85R8040 KJE-D the intent 5 to harm or deceive, knowingly 1 makes a report under Section 51.282 that is false. (e)AAAn 2 offense under Subsection (d) is a Class B 3 misdemeanor, except that the offense is a Class A misdemeanor if it 4 is shown on the trial of the offense that the actor intended to 5 conceal the incident that the actor was required to report under 6 Section 51.282. Sec.A51.286.AACONFIDENTIALITY. 7 (a) Unless waived in 8 writing by the alleged victim, the identity of an alleged victim of 9 an incident reported under Section 51.282: (1)AAis 10 11 confidential which 15 investigation of the report; or the report disclosure is made for the purpose of conducting an (B)AAa law enforcement officer for the purpose of 16 20 to (A)AAthe postsecondary educational institution to 14 19 subject (2)AAmay be disclosed only to: 13 18 not under Chapter 552, Government Code; and 12 17 and conducting a criminal investigation of the report.
