I declare under penalty of perjury t ATURE OFCO I / rr S BS c EEOC FORM 5 (REV. 3/0 I) !BED AND SWORN TO\i{FE ME THI ay.,;tf;:\ZD lr ATTACHMENT TO CHARGE OF DISCRIMINATION MARGARET DEWEESE.BOYD V. GORDON COLLEGE, ET AL. 1. My name is Margaret DeWeese-Boyd. I am a tenured Associate Professor in the Department of Sociology and Social Work at Gordon College in Wenham, Massachusetts. 2. I have been employed as a professor at Gordon College since 1999. I was promoted to Associate Professor in 2004, and I was approved for tenure in2009, effective September 2009. 3. In Februa ry 2017,the Respondents denied my application for promotion to full professor, despite the fact that I had received the unanimous recommendation of the Faculty Senate for the promotion and after I had vocally and publicly challenged Gordon Colleges' exclusionary policies relating to LGBT+ individuals. 4. While employed at Gordon College, I have been actively involved in challenging Gordon College's policies and practices reiating to LGBT+ issues. 5. Some examples of my involvement in this advocacy are: a. Since 2013,I have vocally advocated for the need to remove the prohibition against "homosexual practice" from Gordon College's policies, including speaking to members of the Gordon College administration about this issue, addressing President Lindsay at a faculty meeting about faculty opposition to this policy, and signing a petition about this issue. b. I have also planned and co-hosted dialogues among faculty members relating to same-sex relationships. c. I have organized a training and other events at Gordon College to discuss LGBT+ issues and to advocate for safety and inclusion of LGBT+ members of the community. d. 6. On numerous occasions, I have directly addressed President Lindsay and other members of the c.olle$e administration about LGBT+ issues. Gordon College and its leaders have been public about the college's discriminatory policies on LGBT+ issues. For example, in July 201.4, D. Michael Lindsay, President of Gordon College, was one of fourteen religious leaders who signed a letter that was sent to President Barack Obama, requesting a religious exemption to a planned order barring federal contractors from discriminating on the basis of sexual orientation in their hiring. 7. I signed a petition on Moveon.org asking President Lindsay to remove his signature from the letter to President Obama as did some other members of the Gordon College faculty. 8. My husband was initially denied a promotion to full professor in 2015by the President and Provost in part because he had signed the Moveon.org petition asking President Lindsay to remove his signature from the letter to President Obama. 9. In September 201,6,I applied for promotion to full professor. I received the unanimous recommendation of the Faculty Senate for the promotion. 10. In February 2017, President Lindsay and Provost Curry denied my application for promotion to full professor. It is very rare for professors who receive a unanimous recommendation of the Faculty Senate to be denied promotion. 1L. I am not the only female professor against whom the college has retaliated for advocating on LGBT+ issues. It is my understanding that President Lindsay urged Professor Lauren Barthold to resign after she had written a letter that was published in the Salem News in which she voiced her disapproval of Gordon's LGBT+ disuiminatory hiring policy. Professor Barthold instituted legal action against the College because of this discriminatory and retaliatory treatment against her. 12. I believe that Respondents have discriminated and retaliated against me, as described above, because of my advocacy relating to LGBT+ issues, in retaliation for my protected activity 13. Women faculty members, including myself, who have challenged the College's stance on LGBT+ issues have experienced more discrimination and retaliatory treatment and adverse employment actions than men who have challenged the College's stance on LGBT+ issues. Male professors who have been similarly outspoken were not punished in the same way$ This includes several male colleagues who signed various petitions in response to President Lindsay's letter to President Obama; a male colleague who organized analternative prayer service on campus as a protest; and several male colleagues who expresqed their opposition to the College's stance on LGBT+ issues in various other ways. To the best of my knowledge, the only male professor who was punished was my husband, Dr. Ian DeWeese-Boyd (who then later did receive a promotion to full professor). I believe that Respondents have discriminated and retaliated against me, as described above, on the basis of my gender. Signed under the penalties of perju ry thisZ)day of March, 2017. Maggie DeWeese-Boydv
