Seven Dees Landscaping. Inc. (Seven Dees) as authorized by statutory and regulatory provisions including, but not limited to, ORS 634.900 to ORS 634.915 and OAR 603-057?0500 to 603-057-0532. The findings and conclusions on which this determination is based, and the criteria used to calculate the penalty, are set out below. I. APPLICABLE LAW 1. The applicable law includes the following: Oregon Revised Statutes (ORS) Chapters 60 (corporations), 183 (administrative law), 561 (agriculture), and 634 (pesticides); Oregon Administrative Rules (OAR) Chapter 137, division 3 (contested case procedures); and OAR Chapter 603, division 57 (pesticide control). 2. Oregon?s pesticide control law is known as the State Pesticide Control Act and is codified in ORS Chapter 634. 3. ORS 634.006(8) states: ?Pesticide? includes: . . ?Defoliant? which means any substance or mixture of substances intended for causing the leaves or foliage to drop from a plant with or without causing abscission; ?Desiccant? which means any substance or mixture of substances intended for artificially accelerating the drying of plant tissue; (0) ?Fungicide' which means any substance or mixture of substances intended for preventing, destroying, repelling or mitigating any fungus; ?Herbicide' which means any substance or mixture of substances intended for preventing, destroying, repelling or mitigating any weed; ?lnsecticide? which means any substance or mixture of substances intended for preventing, destroying, repelling or mitigating any insects which may be present in any environment whatsoever; ?Nematocide? which means any substance or mixture of substances intended for preventing, destroying, repelling or mitigating nematodes; (9) ?Plant regulator? which means any substance or mixture of substances intended, through physiological action, to accelerate or retard the rate of growth or rate of maturation or to otherwise alter the behavior of ornamental or cr0p plants or the produce thereof, but shall not include substances to the extent that they are intended as plant nutrients, trace elements, nutritional chemicals, plant inoculants or soil amendments; or Any substance, or mixture of substances intended to be used for defoliating plants or for preventing, destroying, repelling or mitigating all insects, plant fungi, weeds, rodents, predatory animals or any other form of plant or animal life which is, or which the Dennis' Seven Dees Landscaping, Inc. Civil Penalty Page 2 of 8 department may declare to be a pest, which may infest or be detrimental to vegetation, humans, animals, or be present in any environment thereof." 4. ORS 634.372(15) states person may not: Deliver, distribute, sell or offer for sale any pesticide that is misbranded." 5. ORS 634.372(19) states person may not: Distribute, sell or offer for sale any pesticide except in the manufacturer's original unbroken package.? 6. ORS 634.032(2) states ?Pesticides shall be deemed misbranded if: The container or package of such materials is not labeled as required by ORS 634.026." 7. ORS Chapter 634 authorizes the Oregon Department of Agriculture to issue pesticide licenses, including licenses for operators and applicators. ORS 634.057, 634.116, and 634.122. 8. The Department is responsible for enforcing the Oregon State Pesticide Control Act and may make any rule necessary for enforcement of program requirements. ORS 561.020; ORS 561.190; ORS Chapter 634. 9. Oregon Administrative Rules (OAR) Chapter 603 Division 057 is entitled Pesticide Control and implements provisions of the State Pesticide Control Act, ORS Chapter 634. 10. ORS 561.190 states: ?The State Department of Agriculture is authorized and directed to make any and all rules and regulations necessary for the administration or enforcement of any law with the administration or enforcement of which the department is charged, and not inconsistent with the authority with which the department is vested or with any such law. Such rules and regulations shall be compiled and printed in pamphlet form for distribution. The violation of any rule or regulation made by the department pursuant to this section shall be a violation of the law to which such rule or regulation applies and shall be punishable in the manner provided for violations of such law." 11. ORS 634.900 et seq. authorizes ODA to impose civil penalties for violations of provisions of ORS Chapter 634. ORS 634.375 states: "The State Department of Agriculture may suspend, revoke or refuse to renew a license, certificate or other authorization issued to a person under this chapter if the person fails to pay a civil penalty under ORS 634.900 on or before 90 days after the date that the order imposing the civil penalty becomes final by operation of law or on appeal.? 12. OAR 603-057-0500 of seq. provides formulae for calculating the civil penalties authorized by ORS 634.900. OAR states ?Civil penalties shall be due and payable ten (10) business days after the order becomes final by operation of law or on appeal. A person may pay a civil penalty before an order becomes final. Payment of a civil penalty before an order becomes final is an admission by the person of all ofthe allegations in the Notice of Imposition of Civil Penalty." 13. ORS Chapter 60 regulates corporations transacting business in Oregon. II. FINDINGS OF FACT ODA Pesticides Case No. 150528 1. This Notice and Order is the result of a pesticide investigation conducted by the Department in response to a complaint received about a pesticide being delivered to a homeowner in a Pulp Free Simply Orange orange juice plastic bottle in June of 2015. The person in contact with the Department regarding this matter was Dean Snodgrass (Mr. Snodgrass) as senior agent or employee of Dennis? Seven Dees Landscaping, Inc. Dennis? Seven Dees Landscaping, lnc. Civil Penalty Page 3 of 8 2. Dennis? Seven Dees Landscaping, Inc. (Seven Dees) is a domestic business corporation with a principal place of business at 7355 SE Johnson Creek Boulevard, Portland, Multnomah County, Oregon. David Snodgrass is the president of Seven Dees, which provides landscaping services to residential and commercial properties in Oregon. These services include the application of pesticides. 3. Seven Dees employs various agents or employees, some of them as pesticide handlers and applicators. These persons include or have included Travis Smith (Mr. Smith). 4. Prior to June 15, 2015, Travis Smith, in his capacity as an employee of Seven Dees provided a pesticide product to Karen Durbin (Ms. Durbin), a customer, for use on her lawn. Mr. Smith transferred the pesticide into an empty orange juice bottle provided by Ms. Durbin. No additional labeling or information was provided to Ms. Durbin. 5. Jonathan Perry (Mr. Perry) owns a lawn mowing and maintenance company, which provides lawn maintenance services to residential and commercial properties in Oregon. On June 15, 2015 Mr. Perry told the ODA that Ms. Durbin had asked him about a pesticide in an orange juice bottle which she had been given by Seven Dees, as she could not remember what was in the bottle, nor how she was supposed to use it. 6. On July 7, 2015, ODA met with Mr. Perry and collected the orange juice bottle with the pesticide product inside. 7. On August 11, 2015, the Department contacted senior agent or employee of Seven Dees, Mr. Snodgrass. During this and subsequent conversations, Mr. Snodgrass indicated that the product that was provided to the customer was the herbicide SpeedZone. 8. PBI/Gordon Corporation has four products registered as pesticides with the United States Environmental Protection Agency (EPA), defined as a pesticide by ORS which are different formulations under the SpeedZone brand name. The SpeedZone Safety Data Sheet (SDS) identifies the product as an amber liquid. These products may be referred to herein collectively or individually as SpeedZone. 9. The labels on all of the SpeedZone pesticides prescribe storing the pesticides in their original container, and keeping them out of reach of children. They also state that exposure can cause substantial adverse health impacts. ULTIMATE FINDINGS OF FACT 1. Seven Dees is a landscaping service provider in Multnomah County, Oregon. Its activities include the application of pesticides to residential and commercial properties in Oregon. Seven Dees is operated by its president, David Snodgrass. The agents and employees of Seven Dees include or have included Mr. Snodgrass and Mr. Smith. 2. During June of 2015 Seven Dees and Mr. Smith provided a pesticide product to a customer in an orange juice bottle without any additional labeling or information. 3. Following the delivery of the pesticide, an agent or employee of the customers? lawn maintenance company reported to ODA that their customer had received an unlabeled pesticide in an orange juice bottle from Seven Dees. ODA collected the pesticide filled bottle. Dennis' Seven Dees Landscaping, Inc. Civil Penalty Page 4 of 8 4. The label for the pesticide that was indicated by Seven Dees as being in the orange juice bottle prescribed storing the pesticide in its original container, and keeping it out of reach of children. These ultimate findings of fact are based on the findings of fact. IV. CONCLUSION OF LAW The Oregon Department of Agriculture determines that Dennis' Seven Dees Landscaping. Inc. violated Oregon Revised Statutes (ORS) Chapter 634 as follows: VIOLATION No.1 Seven Dees violated ORS which states A person may not: Distribute, sell or offer for sale any pesticide except in the manufacturer's original unbroken package. Specifically. in June of 2015, Seven Dees. through agent or employee Travis Smith, provided a pesticide product to a customer in an orange juice bottle without additional labeling or information. Seven Dees indicated that the product provided was SpeedZone. Each of the SpeedZone product labels prescribes storing the product in its original container and keeping it out of reach of children. Distributing this pesticide product in an orange juice bottle was in violation of ORS 634.3720 9), and is designated as Violation No. 1. VIOLATION NO. 2 Seven Dees violated ORS which states A person may not: Deliver, distribute, sell or offer for sale any pesticide that is misbranded. Specifically, in June of 2015, Seven Dees, through agent or employee Travis Smith, provided a pesticide product to a customer in an orange juice bottle without additional labeling or information. Seven Dees indicated that the product provided was SpeedZone. Each of the SpeedZone product labels prescribes storing the product in its original container and keeping it out of reach of children. Distributing this pesticide product in an orange juice bottle without additional labeling or information was in violation of ORS and is designated as Violation No. 2. These conclusions are based on the findings of fact and ultimate findings of fact. V. PENALTY VIOLATION N0. 1 The penalty for Violation No. 1 is $150.00. The penalty is determined using the criteria in OAR 603-057- 0525 to 603-057-0530. Based on this license history, Seven Dees should have been aware that pesticide products must be kept in their original containers. 6. Any future violations of ORS Chapter 634 or OAR Chapter 603, division 05? within the next three years will subject Seven Dees to additional enforcement actions including, but not limited to, civil penalties, product seizure, or license revocation. VI. RIGHT TO A HEARING You are entitled to a contested case hearing as provided by statues and rules including. but not limited to: ORS Chapter 183, including 183.413 to 183.470, and ORS 183.745; OAR Chapter 137, division 3, including OAR 137-003-0501 to 137-003?0700; ORS 634.905; and OAR chapter 603, division 57.
