I also have a second question regarding the same company. My brother works for a company that the city has a contract with that provides transportation services to our residents. My brother is a low level employee with the company which includes maintaining the office place clean, washing the vehicles and answering phones. In this upcoming agenda, there is a ratification to the budget that will transfer funds from one fund to the company he works for in order to cover the year end costs. Do I have to recuse myself? My second question: My brother started working for the company after the city contracted the company for transportation services mentioned above. We are currently going for RFP for a different transportation services contract for our senior citizens. The company my brother works for may apply for that contract as well. If they do apply, will I have to recuse myself from the item regarding the senior citizen transportation services now that my brother is an employee. Thank you Advice To: Advice Cc: "gracielaortiz24@gmail.com" Tue, Jul 5, 2016 at 4:58 PM Dear Ms. OrƟz, It does not appear you have a financial interest in this decision that is recognized under the PoliƟcal Reform Act. There are six financial interests recognized under the Act as being potenƟal for a conflict of interest. Generally, an official does not have a financial interest in those interest of a sibling unless the official has some financial connecƟon to the sibling’s financial interest as well. For example if the company your brother works for has been a source income for you or you have an investment in that company you could potenƟally have a conflict. You have not idenƟfied any financial interests that could give rise to a conflict. I have listed the potenƟal financial interests that could give rise to a conflict below. Please note that immediate family is defined as only your spouse or dependent children. 1. Any business entity investment worth two thousand dollars ($ 2,000) or more. 2. Any real property in which interest worth two thousand dollars ($ 2,000) or more. 3. Any source of income aggregating five hundred dollars ($ 500) or more in value provided or promised to or received by the public official within 12 months prior to the time when the decision is made. 4. Any business entity in which the public official is a director, officer, partner, trustee, employee, or holds any position of management. https://mail.google.com/mail/u/0/?ui=2&ik=e06af75722&view=pt&q=Advice%40fppc.ca.gov&qs=true&search=query&th=155a904fe8def777&dsqt=1&siml=155a9… 1/3 1/21/2017 Gmail - Agenda Item Advice and question 5. Any donor of, or any intermediary or agent for a donor of, a gift or gifts aggregating [$ 460] or more in value provided to, received by, or promised to the public official within 12 months prior to the time when the decision is made. 6. Personal finances, meaning the financial effect of a governmental decision on the personal finances of a public official or his or her immediate family. Also, please note we are only advising on the applicable rules under the PoliƟcal Reform Act. There may be other conflict of interest laws that apply to your situaƟon and you should consult with your agency counsel for more informaƟon on those laws. -Sukhi Sukhi K.
