U.S. Department of Homeland Security DC 20229 U.S. Customs and Border Protection DIS-3 CBP-AP-2017-O34544 KSG April 13, 2017 James Eli Shiffer Star Tribune 650 3rd Avenue South Suite 1300 Minneapolis MN 55488 RE: Freedom of Information Act Appeal; Appeal of CBP-2017-028421 Dear Mr. Shifter: This is in response to a Freedom of Information Act (FOIA) appeal you submitted on February 15, 2017. In your initial request, dated January 30, 2017, you requested the names and origins of international travelers whose final destination was Minnesota and who were detained by US. immigration authorities as a consequence of President Trump?s Executive Order titled ?Protecting the Nation from Foreign Terrorist Entry into the United States." In a letter dated February 14, 2017, FOIA Division, of US. Customs Border Protection stated that responsive records were denied in full pursuant to 5 U.S.C. ?552(b)(6) and You appealed the decision in a letter dated February 15. 2017. We reached out to the Ports in Minnesota and were advised that there were no responsive records to your request. The FOIA Division incorrectly stated that there were responsive records and cited to exemptions and as a basis of denial. Accordingly the determination of the FOIA Division is modified. This is our final determination. If you feel that this decision is an inadequate response to your appeal, you may obtain judicial review of this decision pursuant to 5 U.S.C. in the United States District Court in the District in which you reside, in the District in which you have a principal place of business, in the District where the Agency records are situated, or in the United States District Court for the District of Columbia. As part of the 2007 FOIA amendments, the Office of Government Information Services (OGIS) was created to offer mediation services to resolve disputes between requesters and Federal agencies as a non-exclusive alternative to litigation. Using OGIS services does not affect your right to pursue litigation. If you are requesting access to your own records (which is considered a Privacy Act request), you should know that the OGIS does not have authority to handle requests made under the Privacy Act of 1974. You may contact OGIS in any of the following ways: Office of Government Information Services National Archives and Records Administration, Room 2510 8601 Adelphi Road College Park, MD 20740-6001 E-mail: ogis@nara.gov Telephone: 301-837-1996; Facsimile: 301-837-0348; Toll-free: 1-877-684-6448 Sincerely, Shari Suzuki, Chief FOIA Appeals, Policy and Litigation Branch
