As I mentioned to Meghan, I have been out all week with a family issue.  There were 
several issues or concerns with the contract that we tried to work through with the 
agency and/or SRS with limited success.  I only mentioned a few with Meghan.  Some of 
these concerns included: 
 Timeline and project deliverables (we were aware of these at the beginning but 
we effectively have less little time left in this field season).  This is not a 
contracting concern but logistically, we want to do a good job and given the 
contract lag both from CPA and TAMU, I think it will be difficult to execute at 
this point without a reassessment of deliverables/timeline. 
 AgriLife has made changes to their Intellectual Property stance.  AgriLife is 
willing to give Sponsors a non‐commercial license to use the intellectual 
property, but they are not willing to give away all intellectual property rights.   
 Subcontractor relationships and project program management.  There were 
concerns in how the relationship with subcontractors (i.e., Biowest) was setup 
and described.  In section 6 of the contract, for example, the language conflicts

 with language in Article “2.C.”.  Furthermore, there also were questions in 
how/why Biowest was selected as preferred vendor, especially given nearly ½ of 
the budget goes to Biowest. 
I tried to push it through but it seemed like it was going to require a significant set of 
changes to the contract, which I did not see the CPA accepting.  Talk later…

I tried calling you three times yesterday and didn’t hear back from you.  Meghan said 
that at the last minute IRNR decided not to enter into the $1 million plus contract for 
mussel research on the Colorado River.  She said the driver for that decision was the 
intellectual property provision in the contract.  I believe it is an identical provision to 
what you have agreed to previously.  I hope you will reconsider your decision.  We are 
able to make accommodations in that provision, but can’t do so unless we know your 
specific concerns.  According to Meghan you were not interested in trying to negotiate 
any changes. 
  
I hope you will reconsider and see if there is a way forward.  Give me a call at your
