THE ASSOCIATED STUDENTS OF ARIZONA STATE UNIVERSITY UNDERGRADUATE STUDENT GOVERNMENT DOWNTOWN TENTH LEGISLATURE FOURTH SPECIAL SESSION April 21st, 2017 SENATE RESOLUTION XXII INTRODUCED BY TYLER TOBYNE SENATOR, COLLEGE OF INTEGRATIVE SCIENCES AND ARTS CASEY RHODE SENATOR, COLLEGE OF INTEGRATIVE SCIENCES AND ARTS ARIANNA KURTZ SENATOR, BARRETT, THE HONORS COLLEGE CASE SMITH SENATOR, BARRETT, THE HONORS COLLEGE JACKSON DANGREMOND PRESIDENT JADE NICOLE YEBAN CHIEF OF STAFF A Resolution by Undergraduate Student Government Downtown’s Tenth Legislature to serve as the articles of impeachment against the elected Vice President of Services, Ernesto Hernandez. WHEREAS, the Undergraduate Student Government Downtown, hereafter USGD, strives to continually hold members accountable for their actions or lack thereof, WHEREAS, the USGD operates off of a six (6) point structure, where members are allowed to accumulate six (6) absence points before being declared nonfeasant, WHEREAS, the six (6) point system is declared in the USGD bylaws, Title II, Article 8, where it states: "8-1.4 Any member of the Executive Board, upon accumulation of more than six (6) absence points during one academic semester shall be considered to be committing an act of nonfeasance. Unexcused absences from mandatory meetings shall be worth two (2) absence points. Excused absences shall be worth one (1) absence point. Upon accumulation of more than six (6) points, a staff member shall be deemed to be committing an act of nonfeasance, which may result in a nonfeasance hearing. A. Excusal of absences will be determined by the President. B. In case of an unanticipated absence, Executives and Directors are allowed one (1) opportunity per semester to participate in the meeting via phone, which will not constitute as an absence. C. Arrangements must be made prior to the start of any Executive/Directors meeting with the President and Chief of Staff at least twenty-four (24) hours in advance or it will be considered an unexcused absence. D. If a member is tardy to any of the mandatory meetings it will be considered an absence against the Executive or Director. E. Any absence deemed excused with no-points by the President shall receive no points and shall not increase an individual's total point tally." WHEREAS, Vice President of Services Ernesto Hernandez has accumulated seven (7) absence points in the Spring 2017 semester, including two unexcused and three excused absences, WHEREAS, Mr. Hernandez was absent from the President's Meeting on January 31st, 2017 (unexcused - 2 points), Executive Board Meeting on February 10th, 2017 (excused - 1 point), Executive Board Meeting on March 24th, 2017 (excused - 1 point), Executive Board Meeting on April 7th, 2017 (excused - 1 point), and the mandatory service event at Devils in Disguise on April 1st, 2017 (unexcused - 2 points), WHEREAS, all members of the USGD are expected to be in attendance for all mandatory meetings, events and trainings in order to best serve the students of the Downtown Phoenix Campus, WHEREAS, Mr. Hernandez, as Vice President of Services, is required to attend USGD Senate Sessions, Executive Board Meetings, President's Meetings and any other meeting, training or event deemed mandatory by the President, NOTING, Mr. Hernandez was granted an absence excused with no points added on March 31st, 2017 for his absence from the Senate Meeting for representing USGD at a different student organization's meeting, FURTHER NOTING, Mr. Hernandez was made aware of his accumulating absence points electronically on March 17th, 2017, FURTHER NOTING, Mr. Hernandez has also accumulated two (2) out of the five (5) strikes allowed for failure to meet the required deadline for mandatory assignments, including the Accountability Report Form on March 17th, 2017 and the blog post on April 14th, 2017, BE IT RESOLVED, by a vote of at least three-fourths (¾) of the current membership of the USGD Senate, as required by Title III, Article 9, Section 1, Point 5 of the USGD bylaws, the Tenth Legislature of the Undergraduate Student Government Downtown Senate finds the accused, Vice President of Services Ernesto Hernandez, in violation of the provisions listed in this resolution, BE IT FURTHER RESOLVED, the Tenth Legislature of the Undergraduate Student Government Downtown Senate does convict the accused of the charges brought forth, BE IT FURTHER RESOLVED, pursuant to Title III, Article 9, Section 1, Point 6 of the USGD bylaws, the accused is impeached and shall be removed from office.
