RE: IN THE CIRCUIT COURT OF THE 15*? JUDICIAL CIRCUIT IN AND FOR PALM BEACH. FLORIDA CASE NO.5020I ALBERT VASSALLO. OBJECTION TO PAYMENT TO SUSAN MAST COMES NOW. JAMES VASSALLO, son of the Ward (deceased) ALBERT VASSALLO. by and through his undersigned attorney. and files this, his Objection to Payment by the Guardian/Trustee Elizabeth Savitt to SUSAN MAST any funds for care of the Ward prior to the Guardianship and states as follows: On or about April 18. 20l 7. the Guardian/Trustee Elizabeth Savitt sent an email to ?all vassollo" (copy attached) stating, in part, that a meeting was conducted at the office of her attorney with Susan Mast and Albert Vassallo. The Guardian/Trustee did NOT send the email to James Vassallo nor his attorney. The meeting was scheduled and conducted without prior knowledge of all beneficiaries of the Trust. At said meeting, it appears that Susan Mast is claiming she is owed monies (approximately $128,000.00) for care of the ward prior to the establishment of the Guardianship but will settle for $54,000.00. The Guardian/Trustee is proposing paying Susan Mast for these ?services". JAMES VASSOLLO objects to the payment of any additional amounts to Susan Mast for any alleged services based on. but not limited to the following: or) Susan Mast was accused of stealing from the Ward prior to the Guardianship and entered into an agreement concerning payment of funds misappropriated. Said settlement was approved by the Court and is Res Judicata regarding any amounts claimed due: b) Susan Mast DID NOT provide any service which are compensable and in fact still has not accounted for all assets she stole form the Ward; c) Guardian/Trustee Elizabeth Savitt continues to engage in a pattern of behavior which tends to treat the person accused on harming the ward more favorably than other beneficiaries as evidenced by meeting with Susan Mast without notice to all beneficiaries and not seeking recovery of all fund misapprOpriated by Susan Mast; d) The Guardian/Trustee Elizabeth Savitt has failed to investigate any such claims and has failed to protect the assets of the Guardianship and Trust; e) Any claim by Susan mast should have been raised at the time of settlement. Further, a Notice of Trust has been filed and Susan mast should file a claim against the Trust one beneficiary 4. The Guardian/Trustee Elizabeth Savitt fails to state any grounds to justify payment and in fact appears to be colluding with Susan Mast to secure an unfair and unbalanced distribution to Susan Mast. 5. The above are just part of the grounds for Objection to the proposed actions by the Guardian/Trustee Elizabeth Savitt to pay Susan Mast. 6. The claim of Susan Mast and the action proposed by the Guardian/Trustee Elizabeth Savitt is devoid of any merit claim of benefit to the Trust. 7. The undersigned is currently out of the office and will supplement this objection when he returns to the office April 24, 20l 7.
