PRIVILEGED & CONFIDENTIAL FINAL ACCIDENT REPORT This report is for improving overall Metro System Safety. It is intended to be for confidential use only. SUMMARY OF FACTS RELATED TO TRAIN #718, (LRV 101S-113N) AND A PEDESTRIAN INCIDENT AT FULTON STREET AND PATTON STREET, RED LINE, MONDAY, FEBRUARY 1, 2016. DESCRIPTION OF OCCURRENCE On Monday February 1, 2016 at 7:07PM, Train #718 (LRV #101S-113N) was traveling southbound on Fulton St. (Track #2) entering the intersection at Patton when a pedestrian on a bicycle attempted to cross in front of the train and was contacted by the LRV. The bicyclist was transported to a hospital where he passed away 30 days later. INJURIES None. FATALITIES One male, Federico Gallegos Iracheta age 66, transported via HFD A-12 to Ben Taub Hospital. Iracheta died at the hospital on March 1, 2016. Mr. PROPERTY DAMAGE LRV 101 sustained minor scuff marks to the coupler cover. Cost to reset monitoring equipment - $385.15. STREET CHARACTERISTICS Fulton Street is a two-way street that runs north and south with one lane for vehicular traffic in each direction. Parking is not allowed on either side of the street. There is a separate turn lane in each direction at the intersection with Patton. Patton is two-way street that runs east and west across Fulton Street with two lanes for vehicular traffic in each direction. Parking is not allowed on either of the street. East and Westbound traffic on Patton can turn left or right onto Fulton. TRACK CHARACTERISTICS The two tracks in this area are level, tangent, located at grade, and embedded in concrete that run northbound and southbound. PRIVILEGED & CONFIDENTIAL FINAL ACCIDENT REPORT FULTON AND PATTON Red Line Train #718 and Pedestrian, 2/01/2016 Page 2 SPEED AND SIGNAL RESTRICTIONS Train movement through the intersection is governed by a Bar Signal Indicator north and south of the intersection. Authorized train speed at this location is 25 MPH. ENVIRONMENTAL CONDITIONS The temperature was approximately 71° Fahrenheit, with overcast skies. CIRCUMSTANCES A post incident investigation was conducted with Train Operator #27095. The Operator stated in substance, but not verbatim that on Monday February 1, 2016, at approximately 7:07PM, “I was operating the train southbound and noticed a person on a bike in the turning lane between cars. I audibles to let them know the train is approaching and to be aware of the train. The cars ahead and biker stopped then the biker eased forward and made a sharp left in front of the train and contact was made.” CAUSE The cause of the incident was due to the bicyclist entering the trackway in front of the train after attempting to make a left turn from the traffic lane. CONTRIBUTING FACTORS None. DRUG AND ALCOHOL TESTING The Rail Field Supervisor at the scene determined that the employee's performance could not be completely DISCOUNTED as a contributing factor to the accident and therefore, FTA post-accident testing was conducted. The results were negative. ACTION TAKEN Train #718, LRV 101, was released back into service and inspected later by Rail Vehicle Maintenance. No defects were found to the train that would have contributed to the accident. RECOMMENDATIONS The LRV/Auto incident was ruled non-preventable by the Safety Department. The final investigation by System Safety revealed that the last PM inspection on Train #718 (LRV 101) was performed on Sunday January 11, 2016. There was an inspection completed following the incident. All components to LRV 101 were functioning properly at the time of the incident. The work hours for the operator #27095 was reviewed; work related fatigue does not appear to be a contributing cause for this incident. NTSB was notified on March 2nd at 2:25PM after receiving notification of his passing the night before. Case #114-1832. CORRECTIVE ACTION PLAN None.
