Denmark has requested the 28 provisional arrest of the fugitive, MOGEN~DI Ei ~ H:b 1 2 ("PEDERSEN") on charges of embezzlement and tax evasion . There is a treaty of extradition in force between the 3 United States of America and the Kingdom of Denmark, signed 4 June 22, 1972, and entered into force on July 21, 1977: 25 5 UST 1293; TIAS 7864 . 6 Exhibit A . 7 A copy of the Treaty is attached as Provisional arrest and detention of alleged fugitives 8 pending the submission of a formal request for extradition 9 and supporting documents are covered by Article 12 of the 10 Treaty. 11 covered, respectively, by Articles 11 and 24(B)of the 12 Treaty. 13 The crimes of embezzlement and tax evasion are In accordance with the provisions of the treaty, the 14 government of Denmark has asked the United States for the 15 provisional arrest of PEDERSEN with a view towards his 16 extradition to Denmark. 17 Provisional Arrest of PEDERSEN, transmitted to the United 18 States Department of Justice by the Danish Ministry of 19 Justice on February 18, 2002, is attached as Exhibit B. 20 A copy of the Request for the I have been informed by Paul Gade, a Deputy Public 21 Prosecutor for the Danish Ministry of Justice, that PEDERSEN 22 has been charged with embezzling approximately US $10 23 million from an allegedly charitable foundation named "The 24 Foundation for the Support of Humanitarian Purposes, the 25 Promotion of Research, and the Protection of the Natural 26 Environment" 27 that PEDERSEN has used the funds from The Foundation for 28 several unauthorized uses, including without limitation to ( "The Foundation"). 2 Mr. Gade has informed me 1 purchase real estate for his own personal use in or near 2 Miami, Florida. 3 Public Prosecutor for Serious Economic Crime, is attached 4 hereto as Exhibit C. 5 Summary summarize the basis for the probable cause found by 6 Danish authorities to support the embezzlement and tax 7 evasion charges against PEDERSEN. On January 15, 2002, the Seventh Division of the Danish 25 Western High Court denied PEDERSEN'S appeal from the 26 December 18, 2001 o rder of detention by the Court. 27 o f the Order upholding the December 18, 2 00 1 order of 28 detention is attached as Exhibit D. 3 A copy 1 I have been informed by Special Agents David Beall and 2 Laughn Rowe of the Federal Bureau of Investigation ( "FBI" ) 3 that PEDERSEN was stopped by agents of the Immigration and 4 Naturalization Service ( "INS" ) on the evening of February 5 16, 2002 at Los Angeles International Airport after 6 disembarking from a plane believed to have originated from 7 London, England . 8 passport check revealed that there appeared to be an 9 outstanding warrant for his arrest from Denmark. 10 PEDERSEN was temporarily detained after a FBI Special Agent Beall further informed me that 11 PEDERSEN admitted that he has previoulsy been to Denmark and 12 was aware that he is currently being investigated regarding 13 various financial matters in Denmark. 14 PEDERSEN had the same date of birth and passport number as 15 listed in a search report issued by Interpol/Denmark and 16 that his appearance matched that of the photograph attached 17 to the Interpol/Denmark search report, Agent Beall took 18 PEDERSEN into custody at approximately 1:30 a.m. on February 19 17, 2002. 20 attached as Exhibit F . 21 t he Metropolitan Detention Center . 22 O.
