May 2, 2017 in the county of Hidalgo in the Texas the defendant(s) violated: O?ense Description Code Section 21 USC 841 21 USC 846 Knowingly and intentionally possess with intent to distribute approximately 146 kilograms of cocaine, a Schedule ll controlled substance. Knowingly and intentionally conspire to possess with intent to distribute approximately 146 kilograms of cocaine, a Schedule ll controlled substance This criminal complaint is based on these facts: On 05l02/2017 Texas Department of Public Safety CID Special Agent Jorge Lopez initiated surveillance at a warehouse located at 106 International Unit in Mission, Texas (Target Location). Date: 51/ exam Judge ?5 signature City and state: 44% Dorina Ramos, U.S. Magistrate Judge I Printed name and title Case 7:17-mj-OO809 Document 1 Filed in TXSD on 05/04/17 Page 2 of 3 DPS SA Lopez, with assistance of a DPS Analyst, ran a check on the target warehouse in Mission, TX. displaying a sign stating ?International Wholesales and Trade.? DPS was not able to locate said company on any website or via the Texas Comptroller?s Of?ce. This company did not appear to be a legitimate business in Texas. Based on other observations by SA Lopez observations of the target location, and that of an individual, later identi?ed as Jesus Salvador demeanor, SA Lopez along with other Texas DPS Special Agents approached the target warehouse and made contact with GONZALEZ-MENDOZA and an individual identi?ed as Heman Halil MENA- REAL. SA Lopez obtained consent to search target warehouse and truck tractor/trailer from GONZALEZ-MENDOZA and MENA-REAL. Law Enforcement K?9s were used to search the trailer and the target warehouse. K-9 alerted to pallets located in the warehouse and said pallets were searched by Special Agents but no contraband was located at that time. SA Lopez along with other agents left the location. SA Lopez waited for a truck tractor/trailer to leave target location and later made contact with the truck driver. SA Lopez, was advised by driver that she refused to transport the load because she believed that the target warehouse was not a legitimate company and had the pallets removed from the truck tractor/trailer. Believing that contraband was still commingled in the pallets at the target warehouse, SA Lopez approached the target warehouse and obtained consent to search a second time from GONZALEZ-MENDOZA and SA Lopez along with DPS Special Agents then broke down all pallets and searched every box individually in the target warehouse. A total of one hundred thirty three (133) bundles wrapped in cellophane containing a white powdery substance believed to be cocaine was recovered commingled in a pallet of Mexican Imported potato chips. The total weight of the bundles was 146 kilograms. The substance was ?eld tested at the location and came back positive for cocaine. GONZALEZ-MENDOZA and MENA-REAL were then placed under arrest and secured in patrol unit. SA Lopez along with SA .T. Wallen interviewed GONZALEZ-MENDOZA and MENA-REAL at the McAllen DPS Of?ce. GONZALEZ-MENDOZA was read his Miranda rights and waived his rights, stated that he had assisted in loading two other truck tractors with contraband in the last three weeks. GONZALEZ-MENDOZA advised that he was aware there were drugs in the two prior shipments and today?s shipment but never saw the drugs and did not Case 7:17-mj-00809 Document 1 Filed in TXSD on 05/04/17 Page 3 of 3 know what type of drug the shipment contained. MENA-REAL was also read his Miranda rights and waived his rights, stated that he was also aware that he was assisting in the transportation of loads of drugs by commingling the drugs in the load of potato chip boxes. GONZALEZ-MENDOZA and MENA-REAL were advised they were being charged with Possession of a controlled substance with intent to distribute and conspiracy to possess with intent to distribute.
