I Dear Mayor Huether:

Pursuant to SDCL Chapter 3-21, on behalf of Hultgren Construction, LLC, this. letter is
intended to provide notice and preserve any potential claims that Hultgren Construction may
have against the City of Sioux Falls, including crossclaims or counterclaims as it relateslto the
December 2,2016, collapse of the building located at 136 S. Phillips Avenue in Sioux Falls.

To our knowledge, litigation has not begun. This letter is simply an attempt to preserve
Hultgren Construction, potential for any claims against the City pursuant to SDCL
Chapter 3 -21.
