The following was brought to my attention during the discussion: The conduct o f the repair station, and the continued work still being performed under the conditions that created the safety risk originally, still exists, even after implementing corrective action to address these conditions. This new information, along with the lOPs submitted with this EIR. suggests that the repair station w ill not intend, and has not intended, to follow' the air carrier's manuals, which is required per FAR part 145.205(a) 121.369(B)(9). Because o f this situation, the repair station has caused the air carrier to to release the aircraft in question in an unairworthy condition. - FAR part 121.369(B)(9) is not relevant, and should not be cited, because the air carrier does have procedures to ensure that required inspections and other maintenance, preventative maintenance, and alterations that are not completed as a result o f shift changes or similar work interruptions are properly completed before the aircraft is released to service. The issue here is that the repair station did not follow' the air carrier's procedures required by FAR part 145.205(a). - This case does fall under the new compliance philosophy per Order 2150.3B. - Due to the above stated, it is recommended to return the EIR to WP39 to close out the case, under the Compliance Philosophy process, as a Letter o f Correction.
