COMPLAINT FOR .INJUN CTIVE RELIEF The Metropolitan Government of Nashville and Davidson County ?les this Complaint against Freedom 4 All, Inc. for an order enjoining Defendant?s unpermitted use of the property at 520 Lentz Drive, Madison Tennessee. Defendant is authorized to use the property as a church but is instead using it as a sex club. Speci?c grounds for the injunction are the Violation of these laws: 0 M.C.L. 17.08.030 (allowing uses not permitted); a M.C.L. 16.36.010 17.40.520 (failing to obtain a use and occupancy certi?cate or ?le a zoning permit application prior to changing the use in property); a M.C.L. (operating a sex club within 1000 feet of a community education facility); a TENN. CODE ANN. 7-51-601, et seq. (operating a private club Within 1000 feet of a school); and, TENN. CODE ANN. 29?3-101, et seq., (maintaining a public nuisance). JURISDICTION AND PARTIES 1. The Environmental Court of Davidson County has jurisdiction pursuant to Chapter 212 of the Tennessee Public Acts of 1993 and TENN. CODE ANN. 29?3-102. 2. Plaintiff is the Metropolitan Government of Nashville and Davidson County, Tennessee duly created and existing pursuant to TENN. CODE ANN. 7?1-101 et seq. and having its principal place of business in Nashville, Davidson County, Tennessee. 3. Defendant Freedom 4 All, Inc. is the registered owner of the premises and real estate located at 520 Lentz Drive, Madison, Tennessee. (Quitclaim Deed, Exhibit 1). 4. Defendant Freedom 4 All, Inc. is a corporation organized in the state of Tennessee. (Freedom 4 All, Inc?s Corporate Records, Exhibit 2). 5. Defendant is a proper party pursuant to M.C.L. 17.40.600, which states that ?the owner or the persons or entities determined to be in violation by the zoning administrator shall be noti?ed? and TENN. CODE ANN. 29-3?103, which states that actions to abate a public nuisance may be maintained against ?the person keeping, maintaining, or carrying on such nuisances, and all aiders and abettors therein, and the owners, proprietors, or agents or persons or corporations in charge or control of the building or place wherein such nuisance exists.? LAW AND FACTS 6. The Metropolitan Government seeks relief from Defendant?s violation of M.C.L. 17.08.030, 16.36.010 and 17.40.520 on the grounds that the Defendant is operating a business not permitted pursuant to its Use Occupancy Certi?cate (Exhibit 3), and has not obtained a use and occupancy certi?cate or ?led a zoning permit application prior to changing the use in the property. 7. The Use Occupancy Certi?cate was granted upon the speci?c representation that Defendant would lease the building to either The Church of His Enduring Grace or Pavilion Church and that no other business would operate therein. (Letter of Bill Herbert dated November 11, 2015, Exhibit 4). 8. Defendant has abandoned the representations made to Mr. Herbert and violated the terms of the Use and Occupancy Certi?cate. 9. The use of the property does not meet the de?nition of church under Webster?s Dictionary. 10. The use of the property does not meet the de?nition of ?religious institution? in the Metropolitan Code. M.C.L. 17.04.060. (??Religious institution? means any structure used primarily for religious practices?). 11. The use of the property meets the de?nition of ?sex club? in the Metropolitan Code. M.C.L. 17.04.060. (??Sex club? means anyestablishment, business, or club that allows members to engage in speci?ed sexual activities or the exposure of speci?ed anatomical areas, and which contains either rooms for couples or other adult-themed rooms or both for the use of members?). 12. The use of the property as a sex club is in violation of M.C.L. ?l7.l6.090.l.l and TENN. CODE ANN. 7-51?601, et seq. 13. Sex clubs are a permitted use, with conditions, on properties zoned Industrial. M.C.L. 17,08,030. 14. 520 Lentz Drive is not zoned Industrial; rather, it is zoned Of?ce General. The property, therefore, is not zoned for use as a sex club. 15. As shown by this screen shot of its website (taken April 26, 2017), the public is invited to 520 Lentz Drive every Friday and Saturday night for activities that violate the Use and Occupancy Certi?cate: Ag)! thesociatclub - file ?Edit View Favorites ?Touls?sHelp :?mnve?n, ?v @sam 16. In addition to the zoning violations, the Metropolitan Government seeks relief on the grounds that the Defendant is maintaining a public nuisance by permitting acts of lewd conduct at 520 Lentz Drive by a business known as The Social Club. (Exhibits 5 and 6). 17. The Metropolitan Government avers that Defendant and the employees of The Social Club permit and encourage lewd conduct at 520 Lentz Drive. 18. The Metropolitan Government avers that the customers of The Social Club engage in lewd conduct at 520 Lentz Drive. 19. The use of S20 Lentz Drive as a gathering place for The Social Club constitutes a public nuisance because patrons are permitted to regularly engage in lewd conduct, and such conduct is injurious to the public welfare. 20. The Metropolitan Government also documented acts of lewd conduct onMarch 25, 2017, as shown by the af?davits of Christine Gibson and Bill Earles of the Metropolitan Department of Codes, which are fully incorporated herewith. (Exhibits 5 and 6). These af?davits re?ect that a fee of $40 was charged for entry. Once inside, Gibson and Earles observed approximately one hundred patrons. The building housed 12 individual rooms which all had doors and either a bed or lounge type chair within. Some rooms allowed viewing into the rooms. Gibson and Earles observed patrons openly engaging in sexual conduct and intercourse in the rooms and foyer. 21. Injunctive relief is necessary to abate the continuing zoning violation and nuisance created by the Defendant or permitted by Defendant to continue. It is reasonable to believe that Defendant will continue to operate in violation of the zoning code as codi?ed in the Metropolitan Code of Laws and will continue to operate a public nuisance in violation of the laws of the State of Tennessee. There is no adequate remedy at law; therefore, the Metropolitan Government of Nashville and Davidson County, Tennessee and the public will suffer irreparable injury unless an order remedying the Violation is entered. 22. The Metropolitan Government requests a hearing on the pleadings on Wednesday, May 24, 2017. WHEREFORE, THE METROPOLITAN GOVERNMENT PRAYS: 1. That it be allowed to file this Petition without a bond for costs or damages pursuant to TENN. CODE ANN. 29-3-104; 2.
