The matters constituting the contravention or likely contravention are specified in the schedule to this notice. The Operator is hereby required to take the steps specified in the schedule to this notice, within the period specified to remedy the contravention or likely contravention. Under Regulation 67 of the Regulations it is an offence to fail to comply with the requirements of an Enforcement Notice. . There are strategically placed spurs off the main which end in valve and hose connections. Flexible hoses provide a link between the spur main and movable wheel mounted water nozzles, which spray over a wide arc. These can thus be moved around and directed to vulnerable areas. There is also a rain curtain system that produces a ,fine spray and this can be positioned at suitable points around the lagoon edges to further reduce dust blow away from the site. The system is fed from the water reservoir (fed by water from the Bluther burn). Water from other sources can be brought in to ensure the dust suppression system can operate. The dust suppression system is manually operated and is available 24 hours a day. A dust suppression contractor is available as and when required and is on site a minimum of 5 day shifts per week. Site roads around the lagoons are kept in a damp condition to prevent dust blows. Cenospheres are washed from the rock armour around the lagoons to prevent them becoming airborne. In dry conditions, this is ensured by the use of a tractor and water bowser. Following this incident you advised that dust suppression measures were increased at the Site, and included the use of a water cannon, water bowser and the rain curtains on both lagoons numbered 20 and 21. On 20 April 2017 SEPA officers witnessed dust from the lagoon area become airborne and being carried outwith the permitted installation boundary. On 24 April 2017 SEPA officers witnessed dust emissions from the lagoon area being emitted to atmosphere outwith the Site. Officers observed dust emissions from the surfaces of lagoons 20 and 21. SEPA officers observed that dust suppression systems were being used, namely the rain curtain and water h'oses, however, given the witnessed emissions of dust to atmosphere, the officers concluded these measures were not sufficient in dampening down the ash to prevent it become airborne and emitted to atmosphere. Use additional pumps to increase the volume of water used to dampen down the surfaces of lagoons 20 and 21. Investigate and use water from sources additional to the Bluther Burn for suppression purposes and refilling the reservoir. increase staffing at the site in order that dust suppression equipment can be operated at an increased frequency to ensure the lagoon surfaces are. dampened down and the requirements of Steps 1 2 are complied with. Submit a report to SEPA detailing the measures taken to comply with Steps 1 - 4.
