The Complainant submits this complaint to the Court and states that there is probable cause to believe Defendant committed the following offense(s): COUNT I Charge: Liquor-Purchase/Sell/Barter/Furnish/Give to u/21yr Minnesota Statute: 340A.503.2(1), with reference to:  340A.702(8) Maximum Sentence: One year, $3,000, or both Offense Level: Gross Misdemeanor Offense Date (on or about): 02/10/2016 to 08/31/2016 Control #(ICR#): 16062226 Charge Description: That the defendant, Donald Roger Neu, then and there being, did wrongfully and unlawfully sell, barter, furnish, or give alcoholic beverages to a person under 21 years of age. 1 73-CR-17-2220 STATEMENT OF PROBABLE CAUSE Filed in Seventh Judicial District Court 3/13/2017 10:56:26 AM Stearns County, MN   The Complainant states that the following facts establish probable cause:   On January 3, 2017, officers from the St. Cloud Police Department began investigating a report of criminal sexual conduct. Officers made contact with the Y.V., DOB: 2/10/1998, an adult female fully identified in the police reports. Y.V. stated she engaged in a sexual relationship with her chemistry professor, Donald Roger Neu, DOB: 11/3/1966, defendant herein. Y.V. stated she went to defendant's office hours while taking a class as a post-secondary education student. On her 18th birthday on February 10, 2016, defendant pursued a romantic relationship. Throughout the relationship, defendant provided Y.V. with alcohol and marijuana. Y.V. stated she attended a chemistry banquet in April of 2016 where defendant provided Y.V. with alcohol. Y.V. stated defendant repeatedly brought her back to his residence in the City of Paynesville, County of Stearns, State of Minnesota, and provided Y.V. alcohol and occasionally marijuana. During a statement to law enforcement, Y.V. stated that defendant would give her alcohol in unlabeled prescription bottles while on the St. Cloud State University Campus, in the City of St. Cloud, County of Stearns, State of Minnesota.  On January 4, 2017, officers learned from St. Cloud State University staff that defendant was cleaning out his office. A subsequent search of his vehicle revealed a 750 ml bottle of Pendleton 1910 Rye whiskey, several unlabeled prescription bottles, a partial bottle of Centenario Rum, two 50 ml bottles of Woodford Reserve, and a 50 ml bottle of Finlandia vodka.  Complainant has reason to believe and does believe that all of the above information is true and correct.  The above facts constitute your complainant's basis for believing that the above-named defendant, on or between February 10, 2016, and August 31, 2016, in the Cities of St. Cloud and Paynesville, County of Stearns, State of Minnesota, committed the offense(s) described herein. 2 73-CR-17-2220 SIGNATURES AND APPROVALS Filed in Seventh Judicial District Court 3/13/2017 10:56:26 AM Stearns County, MN Complainant requests that Defendant, subject to bail or conditions of release, be: (1) arrested or that other lawful steps be taken to obtain Defendant's appearance in court; or (2) detained, if already in custody, pending further proceedings; and that said Defendant otherwise be dealt with according to law.
