MEMORANDUM OF UNDERSTANDING FOR LAW ENFORCEMENT ON THE METROLINK SYSTEM THIS MEMORANDUM OF UNDERSTANDING is made and entered into this 17th day of May, 2017, by, between and among THE DEVELOPMENT AGENCY OF THE MISSOURI- ILLINOIS METROPOLITAN DISTRICT (hereinafter ST. CLAIR COUNTY, ILLINOIS (hereinafter CLAIR THE CITY OF ST. LOUIS (hereinafter the and ST. LOUIS COUNTY, MISSOURI (hereinafter the WHEREAS, METRO was created through an interstate compact between Missouri and Illinois and ratified by the U.S. Congress and serves to enrich the region, in part, through its public mass transportation system; and WHEREAS, METRO operates its public mass transportation rail system including the rail system known as MetroLink (hereinafter ?MetroLink?) in the jurisdictions of ST. CLAIR COUNTY, the CITY and the and WHEREAS, it is a priority for METRO, ST. CLAIR COUNTY, the CITY and the COUNTY to work together to provide a safe and secure transit system for the residents of the jurisdictions and users of MetroLink; and WHEREAS, METRO, ST. CLAIR COUNTY, the CITY and the COUNTY all wish to state in this Memorandum of Understanding, which is a non-binding document, their respective intentions and expectations to provide for and improve the safety and security of MetroLink; and WHEREAS, METRO, ST. CLAIR COUNTY, the CITY and the COUNTY understand that this Memorandum of Understanding is not a contract and the use of the terms "will" or "shall" shall merely relate to intentions and expectations; NOW, THEREFORE, METRO, ST. CLAIR COUNTY, the CITY and the COUNTY agree that their respective intentions and expectations are as follows: 1. TASK FORCE: ST. CLAIR COUNTY, the CITY and the COUNTY shall form a MetroLink task force (hereinafter "task force?) which shall consist of members of COUNTY Police Department, CITY Police Department, and the ST. CLAIR COUNTY Sheriff?s Department. A designated captain within the Police Department shall serve as the operational commander of the task force. Law enforcement officers from the COUNTY Police Department, CITY Police Department, and the ST. CLAIR COUNTY Sheriff?s Department will report to the operational commander. Rail?Related Public Safety personnel and Contract Security personnel will report to a designated lieutenant within the CITY Metropolitan Police Department, who will work in concert with and will report to the operational commander. Each agency participating in the task force is considered the employer of its own law enforcement officers who participate in work with the task force, and no law enforcement officer shall be considered a borrowed servant of the task force or of the other participating agencies or entities. Neither METRO nor any member of the task force intends, through this Memorandum of Understanding or the formation of this task force, to assume liability for the actions of law enforcement officers, Rail-Related Public Safety personnel, or Contract Security personnel employed by another entity. METRO shall not decrease its level of publicly funded security services, Rail-Related Public Safety personnel, or Contract Security personnel without the urging of the task force. TRANSIT ADVISORY WORKING GROUP: The Task Force shall pursue the establishment of a Transit Advisory Working Group that would meet quarterly and that would consist of prosecutors from ST. CLAIR COUNTY, the CITY and the COUNTY, law enforcement leaders from ST. CLAIR COUNTY, the CITY and the COUNTY, Amalgamated Transit Union Local No. 788, and Citizens for Modern Transit. CONTACT: ST. CLAIR COUNTY, the CITY and the COUNTY shall identify the Law Enforcement leaders who shall serve as the contact point for outside transportation agencies including the National Highway and Transportation Safety Administration (NHTSA), Transportation Security Administration (TSA), Rail Agencies, and Emergency Management. STAFF: Staffing goals shall be established by ST. CLAIR COUNTY, the CITY and the COUNTY that will: 1) evaluate the roles of each component; 2) delineate appropriate authority; and 3) establish oversight and accountability structures for security resources. COMMUNICATION BY METRO: METRO shall establish direct lines of communication with the designated Law Enforcement leaders identified by ST. CLAIR COUNTY, the CITY and the COUNTY with regard to access control and environmental design issues. CENTRAL FACILITY: A central police facility for MetroLink shall be created at 5977 Delmar Boulevard for the daily operations of the task force. This facility shall be adequate to house and support the office of the commander, supervisors? offices, space for roll calls/meetings, and other unit functions as determined by members of the three law enforcement agencies from ST. CLAIR COUNTY, the CITY and the COUNTY. CITIZEN REPORTING CAPABILITIES: The task force and METRO shall improve citizen reporting capabilities and police radio communications by: 1) placing police officers on a 10. police radio centered in a PSAP (Public Service Answering Point?Designated 911 Console); 2) endorsing 9-1?1texting and working to bring this technology to the MetroLink system; and 3) acknowledging that COUNTY, CITY and ST. CLAIR COUNTY law enforcement is the primary responder and will address all calls for service within their respective jurisdictions. The task force and METRO shall promote citizen crime reporting and provide a variety of methods to contact law enforcement. marked "Emergency" phones shall be connected to a Public Safety Answering Point (PSAP) and shall be made distinct from the Passenger Assist Telephones (PAT). RESOURCES: In order to provide for operational economy and proper allocation and utilization of available resources, the task force shall: 1) use complaints and patron input to generate logic model goal periods; 2) institute daily interagency patrol plans in accordance with the logic model; 3) establish goal-specific special enforcement and plainclothes operations; and, 4) utilize the Transit Working Group to categorize passenger offenses that require special attention. VIOLATIONS: METRO, ST. CLAIR COUNTY, the CITY and the COUNTY agree that the task force may pursue procedures to ban from the MetroLink system individuals who commit on-going violations of a serious nature that jeopardize the safety of the traveling public. POLICIES: METRO, ST. CLAIR COUNTY, the CITY and the COUNTY shall work cooperatively to obtain information on safety and security grants; to develop a policy regarding response protocols and times; to develop a policy regarding sharing customer complaints and compliments; to develop a policy regarding access to METRO informed by federal train safety and security rules, information, guidelines and strategies; to develop a policy 11. 12. regarding any third-party security agreements, contracts, memorandum or expectations; to develop a policy requiring connecting cars for future light rail vehicle purchases; and to develop a policy to reduce pass/transfer fraud and to explore ticketing and fare structures that eliminate the validation of tickets, including the cost and feasibility of installing a barrier system for MetroLink. The task force shall work with METRO and coordinate the establishment and revision of all such policies currently in existence or to be created in order to achieve the goals set forth in this paragraph and any other policies that are desired to enhance safety and security on MetroLink. STATUTORY COMPLIANCE: Uniform prosecution procedures for COUNTY and CITY shall be in compliance with Section 70.441. METRO shall not directly employ law enforcement officers and shall only employ individuals serving solely as security officers in compliance with applicable laws. Law enforcement officers from ST. CLAIR COUNTY, the CITY and the COUNTY, the task force and METRO shall coordinate with the Transit Working Group to ensure conformity with Section 70.378 and all work together when any component of METRO operations indicates there may be issues of public safety or security. REVIEW: The task force shall conduct a review of its efforts pursuant to this Memorandum of Agreement 120 days after its execution. WHEREFORE, METRO, ST. CLAIR COUNTY, the CITY and the COUNTY have set their hands the day and date first above written.
