On or about January 28I 2017 in Stalil'_ County, in the Southern District of Texas defendants(s) did, (Track Statutory Language of O?ense) knowing or in reckless disregard of the fact Heidy Del Cid-Grantee and Elson Ariel Lemos-Perez, citizens and nationals of the Guatemala, along with one (1) other undocumented alien, for a total of three (3), who had entered the United States in violation of law, did knowingly transport, or move or attempts to transport said aliens in furtherance of such violation of law within the United States, that is, from a location near Roma, Texas to the point of arrest near Roma, Texas, in violation of Title 8 United States Code, Section(s) 1324(a)(1)(A)(ii) FELONY I further state that i am a(n) U.S. Senior Border Patrol Agent and that this complaint is based on the following facts: On January 28, 2017, Border Patrol Agent M. Benavides arrived to the Roma, Texas Police Department to conduct an Immigration Inspection on several subjects from a vehicle stop conducted by Roma, Texas Police Of?cer Morales. Upon arrival, Of?cer Morales stated that a concerned citizen called 911 to report a white impala transporting illegal aliens; the caller also provided the vehicle?s license plate, location, and direction of travel. Based on the information provided by the caller, Of?cer Morales located the white impala and pulled it over. Of?cer Morales also stated that due to of?cer safety and the safety of the occupants he and another of?cer transported all subjects to the Roma, Texas Police Department. Agent Benavides questioned all vehicle occupants and identified the driver as Myrna Elena CISNEROS a United States Citizen. The other three passengers were determined to be in the United States illegally. Agent Benavides and another agent transported all subjects to the Border Patrol Station. Magistrate Judge Name and Title of Judicial Of?cer Signature of Judicial Officer Case Page 2 of 2 SOUTHERN DISTRICT OF TEXAS TEXAS ATTACHMENT TO CRIMINAL COMPLAINT: -M RE: Myrna Elena Cisneros CONTINUATION: At the station, agents discovered that Myrna Elena CISNEROS had been arrested on several occasions for transporting illegal aliens and was convicted for the same offense in October 2007. PRINCIPAL STATEMENT: Myrna Elena CISNEROS was read her Miranda Rights and agreed to provide a sworn statement without an attorney present. CISNEROS stated that she had lent her white Impala to a friend so he can use it to transport illegal aliens. CISN EROS was to be paid $150 USD for her participation in this smuggling attempt. She then stated that her friend left the car at a nearby store after picking up the illegal aliens. CISN EROS then drove the white Impala from the store towards the intended drop?off location but was pulled over by the police before reaching her destination. CISNEROS also admitted to knowing that her passengers were illegally present in the United States. MATERIA WITNESS 1: Heidy DEL CID-Orantes, a citizen of Guatemala, was read her Miranda Rights and agreed to provide a sworn statement without an attorney present. DEL CID stated that her father paid $2,900 USD for her to be smuggled into the United States. She also stated that once in the United States, she and others were instructed by the smuggler to get in a white car. DEL CID indicated that when she got in the vehicle, the driver told her to take off the sweater and put on the seatbelt. She claims they were in the vehicle for about one hour before the police stopped them. Heidy DEL ClD-Orantes identified Myrna Elena CISNEROS through a photo lineup as the driver of the vehicle. MATERIAL WITNESS 2: Eison Ariel a citizen of Guatemala, was read his Miranda Rights and agreed to provide a sworn statement without an attorney present. LEMOS stated that his family paid $2,500 USD for him to be smuggled into the United States. Once in the United States, he and others were guided to the pickup location and were told to wait for the pickup vehicle. After several hours, a white car showed up and the female driver told them to get in the vehicle. Once in the vehicle, the driver told them to get down and that she was going to take them to another vehicle. LEMOS also stated that they were in the car for about one hour before the police stopped them. Eison Ariel identified Myrna Elena CISNEROS through a photo lineup as the driver of the white car. Page 2
