CASE: 2017 36921 COMPLAINT NO. ?20 @0090 THE STATE OF TEXAS MUNICIPAL COURT COUNTY OF HIDALGO MCALLEN, HIDALGO COUNTY, TEXAS I, DET. STEVE AYALA #5445 do solemnly swear that I have good reason to believe, and do believe and charge, that heretofore, on the day of MAY A.D.2017, in the County of Hidalgo and State of Texas, GILBERTO LOPEZ JR, hereinafter called Defendant, did then and there while in the course of committing theft and with the intent to maintain control of property of international Bank of Commerce, Desserei Segundo to wit: $5,130 in US currency, without the effective consent of the said International Bank of Commerce and with intent to deprive the said international Bank of Commerce of said property, did then and there intentionally and knowingly place Desserei Segundo in fear of imminent bodily injury. PC STATEMENT On Monday, May 15, 2017 at approximately 0932hrs McAllen Police Officers responded to a bank alarm at the international Bank of Commerce located at 3600 N. 10"h in McAllen, Texas. Upon arrival officers were advised by bank staff the bank had just been robbed. Officers learned that shortly before the police arrived a male subject walked into the bank lobby wearing a dark colored jacket with a red bandana covering his mouth and chin. The male subject was approximately medium built, in his late 40?s with dark hair. Officers were told the male subject walked up to the bank teller and handed a note stating to give him all the money now. The bank teller later identified as Desserei Segundo feared for her life and handed the male subject a large amount of money from the register in denominations of $10, $20, $50 and $100 bills. Bank staff later confirmed Ms. Segundo handed the male subject $5,130 in cash, which included $250 of $10 bills with traceable serial numbers. The male subject then exited the bank and was seen by a customer who was in the motor bank section get into a silver?older Mercedes Benz, which sped off. The costomer was identified and radio broadcast and a RGV BOLO was made by McAllen PD communications to law enforcement agencies of the male subject and getaway vehicle. McAllen PD personnel and detectives also arrived at the bank to continue with the investigation. During the course of the investigation personnel began processing the scene and recovered the note, which was submitted as evidence. Detectives S. Ayala obtained a statement from Ms. Segundo as to the facts of the case. Ms. Segundo stated she feared for her life and wished to file the proper charges. A statement was also ta ken from another bank teller who was identified and also confirmed what Ms. Segundo had witnessed. Bank staff later provided detectives with a copy of the bank surveillance, which captured the robbery. The video will be submitted as evidence. . PC STATEMENT CONTINUED A approximately 0957h rs McAllen PD communications advised Pharr Police Officers were out with a silver Mercedes Benz at 1200 E. Expressway 83 In Pharr Texas. Said vehicle had been involved in a one car accident and Pharr PD officers were out with a female driver later identified as Elicia Martha Decker DOB ?and a male passenger identified as Gilberto Lopez Jr. - .Pharr Police Officers also advised they had also noticed several US currency bills on the floor board to the Mercedes Benz. McAllen PD officers and assisting detectives responded to the crash site and saw that a silver 2000 Mercedes Benz with Texas FFK- 5289 matched the getaway vehicle description. Standing next to the Mercedes Benz was?Mr. Lopez who matched the clothing description and physical descriptors. McAllen PD Officer H. Castellano detained Mr. Lopez and saw that he had several $1 bills coming out of his left pant leg. Officer Castellano also recovered a red bandana from Mr. Lopez?s right front pocket. Officer C. Rodriguez made contact with Mrs. Decker who had a- large brown purse on her left shoulder. Officer Rodriguez detained Mrs. Decker after noticing several US. currency bills and money bill straps in her purse. personnel also responded to the crash site and processed the scene. The red banana, brown purse with money and the US currency on Mr. Lopez and inside the Mercedes Benz were submitted as evidence. Both Mr. Lopez and Mrs. Decker were transported to the McAllen Police Departmentjail section. in total $5,045 in cash had been recovered which included all of the $250 in $10 bills with the traceable serial numbers. At the jail section Detective Ayala and Regalado met with Mrs. Decker at the jail section who agreed to speak to us Decker was escorted to one of the Persons Unit video interview room where she was read her Miranda Rights lVirs. Decker stated she understood her rights and waived them. Mrs. Decker then gave a statement ImplicatIngherself and Mr Lopez In committing the robbery at the international Bank of Commerce. Detective Ayala and Regalado then met with Mr. Lopez at the jail section who initially agreed to speak to us. He was escorted to?gne of the Persons Unit video interview room where he was read his Miranda Rights. Mr. Based on the statements and evidence to the case, this affiant respectfully requests and arrest warrant for Robbery against Gilberto Lopez Jr. Suspect Gilberto Lopez Jr. DOB . 180lbs, Black/Brown.
